DIRECTION OF CLOSURE UNDER SECTION 33(A) OF WATER

(PREVENTION AND CONTROL OF POLLUTION) ACT, 1974 & UNDER
SECTION 31(A) OF AIR (PREVENTION AND CONTROL OF POLLUTION)
ACT, 1981 AND AMENDED THEREAFTER.

WHEREAS, you are operating a country liquor manufacturing unit in the name
of MIs. Rajgangpur O.S Shop, AtlPo - Rajgangpur, Dist-Sundargarh without
obtaining consent to operate from the Board violating the provisions under section
25/26 of Water (prevention and Control of Pollution) Act, 1974 & section 21 of Air
(prevention and Control of Pollution) Act, 1981 and amended thereafter;

AND WHEREAS, it is found from our record that you are operating the
country liquor manufacturing unit without consent to operate of this Board and a show
cause notice was issued under section 33(A) of Water (Prevention & Control of
Pollution) Act, 1974 & 31(A) of Air (prevention and Control of Pollution) Act, 1981
vide this office letter no. 1035, dtd. 03.04.2018 for operating the unit without valid
consent of the Board.

AND WHEREAS, you have not applied through online application for consent
to operate of the Board with requisite document including Environmental Clearance
from Ministry of Environment, Forest & Climate Change.

AND WHEREAS, Hon'ble National Green Tribunal (NGT) EZB, Kolkata in

its order dtd.24.04.2017, while disposing OA No. 19120171EZ-Sangram Keshari
Mohanty Vs State of Odisha & Ors has directed that all country liquor manufacturing
units shall obtain Environmental Clearance (EC) and its shall be a mandatory pre-
requirement for consideration of consent to operate.

AND WHEREAS, Hon'ble High Court of Odisha in its order dtd. 09.08.2017,
while disposing WP (C) No. 11575/2017-Smt. Kalia Sethi vs. the State of Odisha &
Ors. as well as other similar writ petitions, has upheld the above order of Hon'ble NGT
and has directed all the country liquor manufacturing units to apply for consent to
operate and has directed the Board to dispose the CTO application as per merit.
 "

AND WHEREAS, operation of country liquor manufacturing unit without

obtaining consent to operate from the Board is a violation of section 25/26 of the
Water (PCP) Act, 1974 and section 21 of the Air (PCP) Act, 1981, and above said
direction of Hon'ble NGT and Hon'ble High Court of Odisha.

NOW THEREFORE, by virtue of power conferred under Section 33(A) of

Water (Prevention and Control of Pollution) Act, 1974 & 31(A) of Air (prevention and
Control of Pollution) Act, 1981 and the Rules made there under the competent
Authority in the State Pollution Control Board, Odisha, after careful consideration of
the situation and other relevant records available in the office, hereby directs you to
close down the operation of the unit namely Mis. Rajgangpur O.S Shop, AtlPo -
Rajgangpur, Dist-Sundargarh with immediate effect & report compliance.
