POWER RELATIONS WITH NATIONAL GOVERNMENT, SC, PRESIDENT AND


CONGRESS; INTER-GOVERNMENTAL REALTIONS AND HIERARCHICAL
RELATIONS AMONG LGUs

LGUs and NATIONAL GOVERNMENT IN GENERAL:

 LGUs are only agents of the national government.


 Local councils exercise only delegated legislative powers by Congress.
o The delegate cannot be superior to the principla or exercise
powers higher than those of the latter.
o The LGUs cannot undo the acts of Congress, from which they have
derived their power and negate by mere ordinance the mandate of
the Statute.

LGUs and SC

 LGUs’acts are subject to judicial review


 Acts of LGUs are very well subject to judicial review, as under Section 4 (2)
of 1987 Constitution, the SC has jurisdiction over all cases involving the
constitutionality of a treaty, international or executive agreement,
which shall be heard by the SC en banc, and all other cases which under
the ROC are required to be heard en banc, including those involving the
constitutionality, application, or operation of PDs, proclamations,
orders, instructions, ordinances, and other regulations.

LGUs and PRESIDENT

 President exercises General Supervision


 To ensure that their acts are within the scope of their prescribed powers
and functions.
o The President shall exercise supervisory authority directly over
provinces, HUCs, adn ICC; through the province with respect to
CC and municipalities; through the city and municipality with
respect to barangays.
 National agencies and offices with project implementation functions shall
coordinate with one another and with the LGU concerned in the discharge
of these functions.
o They shall ensure the participation of LGU
 The President may, upon the request of the LGU concerned, direct the
appropriate national agency to provide financial, technical, or other forms
of assistance to the LGU.
o Such assistance shall be extended at no extra cost to the LGU
concerned.
 National agencies and offices including GOCC with field units or branches in
a province, city or municipality shall furnish the LCE concerned, for his
information and guidance, monthly reports including duly certified
budgetary allocations and expenditures.
