Miller, Commander Subject: Internal Affairs IA17-05 (Deadly Foree Review) INVOLVED PERSONNEL, Sergeant Juan Leon Involved Officer Matthew Monteiro Involved Executive Summary: Note: This is a confidential administrative investigation protected by section 832.7 of the California Penal Code pertaining to the confidentiality of Peace Officer Personnel Records On July 12,2017 at approximately 2218 hours, Officer Monteiro and Sergeant Leon responded to 1061 Brighton Ave for a report of a disturbance. They were advised by dispatch that Kenneth Eustace was at the residence 0f Q@ARaQ@ReaiBil-causing a disturbance. Mr. Eustace began threatening to kill officers with a 2 foot long metal pipe. The pipe was 1% inches in diameter with a nail affixed to one end and a rope to the other end. Officer Monteiro deployed his Taser striking Mr. Eustace after giving him several warnings to drop his stick and to stay back. The Taser had only affected Mr. Eustace momentarily before he broke the wires by swinging the metal pipe. ‘Mr. Eustace then turned his attention back towards the residence in an attempt to get access through awindow. The Officers gave repeated wamings to Mr. Eustace not to go in the residence. Mr. Eustace then tumed his attention to Sergeant Leon. Mr. Eustace continued swinging his pipe in an aggressive manner, threatening the officers as he began to walk towards Sergeant Leon Sergeant Leon gave several warnings to Mr. Eustace to stop and drop the pipe. At one point Sergeant Leon shined his flash light into Mr. Eustace’s eyes in an attempt to stop him from aggressing with little affect. Sergeant Leon retreated and positioned himself towards the rear of a vehicle parked in the driveway of the residence, putting a protective barrier between himself and Mr. Eustace. Mr. Eustace then started striking the vehicle, smashing its windshield. Both Sergeant Leon and Officer Monteiro continued to warn Mr. Eustace to stop and drop the pipe but he continued to swing the
