International Liability as an Instrument to Prevent and Compensate
for Climate Change
“The environment is everything that isn't me”
Albert Einstein

International environmental law or International ecological law is a field of international law

regulating the behavior of states and international organizations with respect to the environment.
Core domains for international regulation include management of the world's oceans and
fisheries, the polar ice caps, and the regulation of carbon and other particulate emissions into the
atmosphere etc.

International environmental law grew as a separate area of public international law in the late
1970s with the Stockholm Conference on the Environment in 1972. Since then interest has
steadily increased and it is one of the fastest growing areas of international law.

Author has a belief that international environmental law also includes the damage done to ozone
layer depletion by global warming, desertification, destruction of tropical rain forests, and
marine plastics pollution from ships, protection of wetlands, oil spills and other serious
environment threats.

The Author by the means of this research paper wants to draw the attention towards the
International cooperation in the form of treaties, agreements and resolutions created by inter-
governmental organizations as well as national laws and regulations are being used to protect the
environment like Convention on the Law of the Non-Navigational Uses of International
Watercourses, 1972 UN Convention on the Human Environment, Basel Convention on the
Control of Tran- boundary Movements of Hazardous Wastes and Their Disposal, North
American Agreement on Environmental Cooperation, Ozone Treaties, 1997 Kyoto
Protocol, International Convention for the Prevention of Pollution from Ships and various
other conventions and treaties formed by the United Nations under United Nations Environment
Programme (UNEP), the European Union, the OECD for protection of environment.

The research paper also deals with how human society as well as the marine ecology can benefit
with balanced use of the marine, sea
resources for sustainable development of the society and its legal impact and also how the
international treaties and conventions and laws made by international agencies help to curb
environmental change and its impacts. Author has also studied and analyzed different approaches
and steps by government of countries all around the world like India, Brazil, Countries of
European Union, and Canada etc. taken by them for protection of environment like making
various laws and setting various agencies to monitor the harm done to the environment.
