Abstract
WHAT?
On 4 August 2009, the Parliament of India enacted an act – The Right to Education Act (RTE)
also known as Right of Children to Free and Compulsory Education Act. The act is a move of
right based approach towards eradicating illiteracy. It aims to provide free and compulsory
education to children of age between 6 to 14 in India, under Article 21a of the Indian
Constitution. It makes education a fundamental right of every child between the said age range.
The act enforces private schools to reserve 25% seats for students of low economic status or
scheduled caste or tribe. All unrecognized schools are prohibited from accepting donation or
capitation fees and taking interviews of the child or parent for admission purpose, as per the
act. The Act also prevents expulsion, holding back and disallows requirement to pass a board
examination until the completion of elementary education. School dropouts are also provided
be with special training to bring them on equal level with students of the same age.

WHY?
Illiteracy has been one of the most omnipresent problem in the Indian society. As education is
a fundamental right, RTE should be praised by the society as well as leaders. Education sector
come under the concurrent list of both state and center and hence both the government will
have equal say in it. The project has been taken on implementation of Right to Education in
Gujarat as a case study. Gujarat is one of the few states which is poor in the implementation of
RTE act. Despite lack of infrastructure in the country Gujarat has been doing better compared
to other states, in the infrastructure front.

HOW?
Ministry of Human Resource Development (MHRD) is the implementing agency for RTE.
National commission for Protection of Child’s Right (NCPCR) is the statutory body for
monitoring of the scheme. It is independent of the MHRD. The independent RTE department
deals is a platform with grievance redressal.
