PETITION FOR BAIL WITH MOTION TO REDUCED BAIL

A ccused,RETRO, through counsel, respectfully states that:

By way of prefatory:
“The Court is not unaware that in some
instances law enforcers resort to the practice
of planting evidence to extract information
or even harass civilians- the Court must then
be extra vigilant in trying drugs cases lest an
innocent person is made to suffer the
unusually severe penalty for drugs offenses”

1. Accused is currently detained at Iba Provincial Jail for


allegedly violating Sec. 5 and 11 of Republic Act No. 9165
and has been behind bars since 15 February 2019.
2. Prior to his detention, Accused was a farmer by profession
who earns a meagre amount of money, not even enough
to sustain his family.

3. That no bail was recommended for his temporary liberty


pending trial for the reason that Section 5 of R.A. 9165 was
allegedly violated.

4. The prosecution has the burden of proving that the


evidence of guilt is strong and unless this fact is
satisfactorily shown, the defendant is entitled to bail as a
matter of right.

5. To give premium to the constitutional presumption of


innocence until his guilt is proven beyond reasonable
doubt, it is prayed that his temporary liberty be granted by
the Court.
