Facts:

This is a petition for review on certiorari of the decision of the Department of Labor and
Employment, affirming the order of the Regional Director in the three consolidated cases filed against
the petitioner by Teodorico Camas for illegal deductions, underpayment of wages , non-payment of
holiday pay and service incentive leave filed by the union in behalf of its member and for non-payment
of employees’ service incentive leave, underpayment of allowance, overtime pay, premium pay and
non-payment of two regular holidays in December which were discovered upon routine inspection by
the Labor Regulation Officers.

The Regional Director ordered the petitioner to refund the illegal deductions to Teodorico
Camas in the amount of P775.00 and to pay the other claimants their pays, allowances, incentives, etc.
Petitioner appealed to the Secretary of Labor and Employment but the petition was dismissed. Hence,
this appeal for certiorari.

Petitioner contends that the Regional Director has no jurisdiction over its employees’ claims and
that petitioner was denied due process.

Issue:

Whether or not, the Regional Director has jurisdiction and was the petitioner denied due
process.

Holding:

The Regional Director has jurisdiction over the case. Article 129 of the Labor Code provides that
the Regional Director of the Department of Labor and employment is empowered to hear and decide
any matter involving the recovery of wages and other monetary claims and benefits provided it is not a
claim for reinstatement and the money claim does not exceed P5,000.00.

Petitioner’s allegation that he was denied due process of law is not well taken. The active
participation of the petitioner to the proceedings and his action of filing an appeal is part and parcel of
his right to due process. Hence, he was not denied due process.

Wherefore, the petition for certiorari is dismissed for lack of merits.
