Kind attention: Lokpal to Govt. of India, Cabinet Secretary with Department of Personnel and
Training, as annual Increments along with ACP benefits were not released after order dated 4-9-
2006, dispatched on 5-10-2006, created major hardship, great mental torture with financial loss,
besides it appeal against order dated 4-9-2006 also claimed to be decided on 22-3-2018, badly delay
of a period more than 12 years, whereas Faridabad Police refused to lode FIR, keeping in view
orders passed by the Chairperson as on 22-3-2018.

Kindly refer to then CE orders dated 4-9-2006 but why dispatched after 30 days as on 5-10-2006
bearing No. 11253 read with the appeal against the said orders still undecided even after personal
hearing before present Chairperson, even her decision conveyed on CM window 18948 dated 10-2-
2015, complaint moved as GOVHY/E/2018/00943 on 30-3-2018 to the Faridabad Police to lodge
FIR as per decision of Chairperson being effected person as breach of trust but Faridabad Police
endorsed against the observation of Chairperson, whereas KVIB again concealed facts while
mishandling ID No. ACS Ind/CA/SDIT Deptt./2707 dated 5-3-2019, replied vide ID No.
HRB/Admn/EA-1/1735 dated 8-4-2019.

I offer my deducted amount with interest be donated to the Prime Minister Relief Fund being
Chowkidar as Justice delayed Justice denied, why should I suffer for nothing in Supervisory
capacity, when tainted subordinate staff were very much duty bound, then they should penalized,
bear the loss instead me? Please find attached here with all relevant evidences to grant me personal
hearing to explain orally as this matter is badly delayed, mishandled as well since beginning till
today, inviting unnecessary harassment, mental torture, financial loss with unnecessary litigations,
pain & sufferings: Intolerance of competent person in KVIB sector: सर्वे भर्वन्तु सुखिनः सर्वे सन्तु ननरामया।

If I being District Khadi & Village Industries Officer at Faridabad, hold accountable for gross
negligence in supervision when subordinate officials violated their duties & functions, who were
appointed by the Board itself to assist me as DKVIO but they were breach my trust:

1. Whether I being TSL was entitled – eligible for the promotion to the Development Officer
(Leather) after the retirement of Shri JL Jggi and Hukam Chand?
2. Whether I being TSL senior then Shri Yash Parkash Goyat and Chiman Lal as
Demonstrator, if yes then who is responsible for fabricated facts submitted false report
before the Human Rights Commission, Haryana in the complaint case No. 1095/14/2016 as
claimed TSL was junior then Demonstrator (Leather) at serial 5 of point 7, vide letter No.
HRB/Admn/EA-1/3418 dated 29-8-2016?
3. Whether sickness as on 4-3-2013 and fitness certificates as on 1-5-2013 of Sarvodaya
Hospital, Faridabad, which was approved by the Govt. of Haryana for treatment, verified
as genuine by the Faridabad Police vide DRGPO/E/2016/00420, never examined by both
Inquiry Officers, while processing the replies against two charge sheets for same reason,
leave on medical grounds was rejected unlawfully, forcibly adopting double standards as
order dated 25-4-2013, dispatched on 4-6-2013 after many months later?
4. Whether TSL was entitles – eligible for all service benefits, which were withheld due to
charge sheet. Same was decided as on 4-9-2006, orders dispatched on 5-10-2006 but service
benefits were illegally withheld after order 4-9-2006?
5. Whether Section Officer (Legal & Recovery) proposal dated 15-12-2009 was justified, which
proposed to file the legal right of service benefits to TSL?
6. Whether TSL was reinstated after obtaining Inquiry report on 1-4-2014, conveyed May 29?
7. Whether TSL, continued under suspension till 5-8-2014 was justified?
8. Whether TSL was granted subsistence allowances as per rules during May 2013 to August
2014, increased @ 75% after six months suspension without charge sheet?
9. Whether TSL was granted personal hearing against all three charge sheets – Inquiry

Subject: FIR for breach of trust, concealing facts, temporarily embezzlement of criminal
nature, violating the IPC 120-B, 409, 420 etc. by Jagdish Chander, Assistant (Rtd) with
Gautam Dutt, Clerk, working as In charge, District office at Gurugram.
It is humbly submitted that:
1. I had been District Khadi and Village Industries Officer at Faridabad with certain duties
and functions, to perform effectively, subordinate staff with specific duties and functions
were also deputed.
2. Shri Jagdish Chander, Assistant was posted to monitor the accounts and Audit aspects of
the District along with the work of the Clerk, besides it Assistant / Junior Auditor duties
and functions were also defined by the Board, whereas if any suspicious activities observed
at the level of Assistant / Junior Auditor then he was duty bound to place the same on
record and to intimate DKVIO at once.
3. Shri Gautam Dutt, Clerk was also posted, to perform as per duties and functions, vested
in the post of Clerk, which were already defined and in practice.
A special Audit was conducted for District Faridabad and some malpractices were
reported as per report, which were neither been observed nor reported by the Assistant /
Junior Auditor to me as DKVIO, similar act at the level of the Clerk, which is a clear cut
matter of breaching of trust as subordinate staff Shri Jagdish Chander and Gautam Dutt,
jointly.
Shri Jagdish Chander, Gautam Dutt along with me as DKVIO were charge sheeted, both
these were accepted the punishment of deduction as recovery but I moved protest petition
against the decision of the Chief Executive of the Board about deduction of Rs. 9031/- from
my pay, because I was hold accountable for poor supervision over the subordinate staff, my
appeal before the Chairman of the Board, against the order Dated 5-10-2006 arrived at
conclusion at the level of the Chairperson of the Board with observation that matter was
temporarily embezzlement of criminal nature, violation of the IPC 120-B, 409, 420 as per
her order Dated 22-3-2018 (Copy attached). It would also be pertinent to mention here that
Chief Executive provide the services of these both subordinate staff to perform certain
duties and functions, if they concealed facts and commit any offense, breaching trust of
their seniors then these both officials be responsible and I can’t be hold accountable.
Hence, FIR against these both Shri Jagdish Chander, Assistant (Rtd) and Gautam Dutt,
Clerk, working as In charge of the District office at Gurugram and Mewat may kindly be
lodged.

Yudhvir Singh Malik (born 19 March 1959) is a 1984 batch IAS officer of Haryana cadre, he has
served in various key positions for both the Union Government and the Government of Haryana,
like as Additional Chief Secretary (Mines and Geology), Additional Chief Secretary (Industries
and Commerce), Additional Chief Secretary (Revenue and Disaster Management), Additional

has concealed appeal against CE orders, which was moved by TSL working as DKVIO, whereas
he was duty bound to correct the legal partition of Haryana KVIB from Punjab KVIB adopting
proper partition and amendment in the Act existed, hence he needs immediate punishment,
placing him under suspension during Investigation of the matter.

Yudhvir Singh Malik, IAS enjoyed top positions of Department of Industries Haryana during
Congress led Government and now his services were handed over to the Center as CEO of
FSSAI because they smell that Congress is not going to repeat back in power, after 2014
Assembly election, where as he had been in HSIDC and responsible for all wrong things,
malpractice, corruption and favoritism, hence top vigilance inquiry required of his tenure in
HSIDC and we demands white paper along with strict action against all offenders. For example
Media reports: Government auditor CAG has rapped the state-owned HSIIDC for accepting the
undervalued rate of land which was sold to real estate giant DLF Ltd for setting up a recreational
project in Gurgaon leading to a financial loss of Rs 438.91 crore. In its latest report on Haryana's
PSUs for the year 2011-12, CAG while auditing Haryana State Industrial and Infrastructure
Development Corporation Ltd (HSIIDC) observed that the valuation of the property which was
to be developed for recreation and leisure activities in Gurgaon was wrong. ILFS Infrastructure
Development Corporation, which was appointed as consultant for assessment of land cost (in
March 2008), valued the land cost by using a mixed approach which means multiplying average
market rate of land with average District Collector (DC) rate. "The value of property was worked
out at Rs 1,683.58 crore (by consultant) whereas the valuation of the property by considering
average factors of 2.79 times for residential area and 3.105 times for commercial plots works out
to Rs 2,142.11 crore," CAG said. However, HSIIDC approved the reserve price at Rs 1,700 crore
for bidding on the basis of the consultant's valuation while the government accepted the DLF's
bid at Rs 1,703.20 crore. "The company (HSIIDC) by accepting the consultant valuation without
any analysis and study suffered a loss of Rs 438.91 crore," CAG noted. HSIIDC invited bids for
sale of 350.715 acres of land in Gurgaon in January 2009 for setting up recreational and leisure
project. DLF Limited submitted the bid at Rs 12,000 per square meter, though it sought clearance
of legal and procedural complexities. The bids were again advertised in July 2009 for the same
project. Then Haryana's Town and Country Planning Department decided that additional Floor
Area Ratio (FAR) at the rate of 20 per cent of area should be allowed to the successful bidder. In
the second attempt, three bidders including DLF, Country Heights Holding Berhad and Unitech
showed interest in the project. But HSIIDC rejected the bids of Country Heights Holding Berhad
and Unitech for not fulfilling minimum criteria. The project ultimately went to DLF in February
2010. The HSIIDC management in the exit conference stated that the bid parameters along with
the benefit of extra 20 per cent FAR were revised before the re-advertisement and expenses on
getting clearance was the liability of DLF, and no financial burden accrued to HSIIDC. "The
reply was not convincing as HSIIDC had fixed the reserve price of the land on the lower side due
to wrong costing of land," CAG said. CAG also recommended that ILFC IDC should be
debarred from entering into any business with HSIIDC. Besides, the auditor has also found the
transfer of 253 acres out of total land of 350.715 acres of land under the proposed project in
violation of Punjab Land Preservation Act (PLPA). It is pertinent to mention here that Punjab
and Haryana High Court terminate the allotment of land to the DLF recently and he defended
Govt. in press conference, hence he may kindly be placed under suspension during investigation.

and present system is compelling my husband Shri Naresh Kadyan, leading activist with
International reputation, either to resign or to get suicide because his pay and allowances are with
held under instructions of Yudhvir Singh Malik, IAS, baseless charge sheet needs attention, to be
quashed and inquiry against responsible IAS officers, needs to be punished, who with held pay
and allowances,not granting annual increment due as on 1-4-1995, not crossed efficiency bars,
not granting second ACP, regular annual increments to Naresh Kadyan, Technical Supervisor
(Leather) Haryana Khadi and Village Industries Board, revoke Naresh Kadyan suspension, after
90 days no charges are framed against Naresh Kadyan to justify the suspension, double standard
in Haryana one TS to head office but another one TS in field?, where as TS and DKVIO at par
with equal pay scale, all baseless charge sheets needs to be dropped with counter action against
baseless charges frame by the tainted IAS responsible for mental torture and unnecessary
harassment, suspension be revoked. My husband junior officials are getting much higher pay
scale and basic pay in Khadi Board, where as my husband is well qualified then existed staff of
the Board. If anything happen to my husband Naresh Kadyan then Yudhvir Singh Malik, IAS
along with all CE of Khadi Board, Haryana will be responsible.

Complaint against Shri Yudhvir Singh Malik, IAS working as Principal Secretary to the Govt. of
Haryana (Department of Industries) holding this position since long, besides this position he had
been Chairman, Haryana Khadi and Village Industries Board, during his stay as Chairman he
managed illegal appointment of Shri R.K. Sharma in Haryana KVIB as Member Secretary in
addition to his position as Consultant in another Department, it would be pertinent to mention
here that R.K. Sharma was retired from Industries Department itself, after retirement then
Director Sh. T.L. Satparkash, IAS holding position as Chief Executive, Haryana KVIB along
with the MD, Haryana Small Industries and Export Corporation in addition and R.K. Sharma
was reappointed as Consultant in Export Corporation, other side as CE, KVIB asked Export
Corporation to appoint R.K. Sharma as Member Secretary, Haryana KVIB, only to do favoritism
of R.K. Sharma, this melafide activities needs attention. On December 20, 2012 Haryana Khadi
and Village Industries Board meeting was held under Chairmanship of Yudhvir Singh Malik, in
this meeting most competent, result oriented and well qualified Naresh Kadyan, who was
holding 7 positions as District Khadi and Village Industries Officer at Faridabad, Palwal, Mewat,
Gurgaon, Rewari, Narnaul along with the In charge Consignment Agency, Faridabad was placed
to Head Office at Panchkula being an original post as Technical Supervisor (Leather), where as
another Technical Supervisor (HMP) left unattended in the field offices as DKVIO in many
District, it was totally biased decision of KVIB under pressure of Yudhvir Malik to harass
Naresh Kadyan, double standard applied by Yudhvir Malik, IAS, these kinds of biased action
cannot be expected from a senior IAS officer. Hon'ble Chief Minister of Haryana passed order to
cancel the transfer orders of Naresh Kadyan from Faridabad to Panchkula but Yudhvir Singh
Malik managed this order to suspension of Naresh Kadyan misrepresenting and twisted the facts
before the CM Office, till date no charge sheet has been issued, baseless charge sheets has been
issued, two annual increments stopped, many annual increments with held along with 1-4-1995
annual increment, second ACP was not yet granted, efficiency bar not yet crossed, Naresh
Kadyan junior officials are getting more basic pay and pay scale then senior Naresh Kadyan,
who has been compelled to move voluntarily retirement from service, without any reason, many
time pay and suspension allowances are with held for a long period, applied Medical leave
rejected by the CE of KVIB under pressure of Yudhvir Malik. Hence a senior level officer may
kindly be deputed to inquire all the points, harassment and double standard applied in Haryana
Khadi and Village Industries Board, during inquiry Yudhvir Singh Malik, IAS may kindly be
posted in Delhi instead of Haryana for natural justice because as PS to Govt. of Haryana
(Department of Industries) I cannot expect any justice because he can managed the investigation.

Reference: DKVIO Dispatch No. 254 dated 16-10-2006 & 258-59 dated 16-10-2006, still pending.

Greetings,

Kindly refer to the above said appeal before then Administrative Secretary cum Chairman along
with the re-consideration application before then Chief Executive of the Board, the decision on the
same still pending, whereas personal hearing was granted, all evidences were placed on record but
Hon’ble Chairperson decision on the CM window 18948 dated 10-2-2015, conveyed vide letter No.
1909-1914 dated 22-3-2018, whereas I never moved said CM window 18948 dated 10-2-2015 before
the Chairperson of the Board, besides it I moved complaint before the Faridabad Police to take
cognizance on the decision conveyed by the Chairperson of the Board. In continuation KVIB letter
No. 6270 dated 9-8-2018, which was addressed to the Faridabad Police, KVIB placed on record that
Chief Executive Order, conveyed on dated 5-10-2006 were challenged as appeal and same was filed
by the Appellate Authority Chairperson of the board, which is not true because:

1. Personal hearing was granted as on 1-3-2017, I was very much present, heard by then Chief
Executive, No decision was taken due to absence of then Chairman.

2. Personal hearing was again granted as on 12-12-2017 but till today No decision has been
conveyed, which was taken as on 12-12-2017 by the Appellate Authority, besides it many
representations are being sent regularly.

In fact, there was a great hardship, double standards applied being sufferers of heavy financial loss
and mental torture for a long period because all regular service benefits as annual increments with
ACP’s needs to be released at once, while passing order dated 4-9-2006, conveyed on 5-10-2006 but
it was not done till under protest voluntary retirement. It’s very funny as No responsibilities fixed
on the tainted black sheep’s of the system.

As per orders conveyed by the Chairperson on dated 22-3-2018 read with the material supplied to
the Faridabad Police, matter was dropped and no cognizance was taken, hence the allegations
leveled in the said orders have No material, in the eye of the Faridabad Police.

Whereas Junior Auditor is No more, besides it Gautam Dutt, Clerk very much in the service of the
Board and both officials accepted their guilt, not moved any appeal against orders dated 4-9-2006,
conveyed on 5-10-2006 but I still protesting against unlawful and illegal deduction, appeal after
personal hearing also not decided as there was No allegation of embezzlement against me, only
breach of trust committed by the duty bound subordinate officials, for their guild I can’t be held
responsible, hence impugned order dated 4-9-2006, conveyed as on 5-10-2006 may kindly be set-
aside, releasing deducting amount without any further delay for natural justice. All concerned
papers are attached here with as ready references. Justice delayed Justice denied.
