ABE iy WHEREAS, the Commission on Elections (Commission for brevity), in Resolution No. 10084 dated March 16, 2016 adopted a policy for the conduct of manual cross-out of names of registered voters in the Election Day Computerized Voters Lists (EDCVLs) and the Posted Computerized Voters Lists (PCVLs) based on the following grounds: 1. Approved Notice of transfer of registration records to another city/municipality issued by the Election Registration Board (ERB) of voter’s new residence; 2. Double/multiple registration records through Automated Fingerprint Identification System (AFIS) matching; 3. Deceased voters duly certified by the Local Civil Registrar; and 4. Excluded by court final and executory orders pursuant to Section 35 of Republic Act No. 8189. WHEREAS, the Commission has approved various requests from the Offices of the Election Officers (OEOs) for the inclusion in the EDCVLs and PCVLs the names of voters in the forthcoming May 13, 2019 National and Local Elections (2019 NLE) based on the following grounds: 1. Court inclusion order; 2.. Registration records which were erroneously deleted due to death; and 3. Abated as double/multiple registration based on AFIS due to wrong encoding of types of application in the Voter’s Registration System; WHEREAS, as part of the preparation for the 2019 NLE, the Commission needs to implement the policy in Minute Resolution No. 10184 on the manual cross out of names in the EDCVLs and PCVLs; WHEREAS, the Commission, through the Election and Barangay Affairs Department (EBAD), is receiving various requests from the OEOs for the inclusion of the names of voters in the EDCVLs and PCVLs based on the grounds afore-mentioned which include those non- extracted Sangguniang Kabataan (SK) voters in the database who will turn eighteen (18) years old on election day. NOW, THEREFORE, pursuant to the powers vested in it by the Constitution, the Omnibus Election. Code, Republic Acts No. 8189 and No. 10367 and other related registration laws, the Commission RESOLVED, as it hereby RESOLVES, to adopt the following policy guidelines in dealing with manual cross out and inclusion of names of voters in the EDCVLs and PCVLs, as follows: A. POLICY ON MANUAL CROSS OUT IN THE EDCVLs and PCVLs: 1. Adopt the policy in Resolution No. 10084 implementing the guidelines in Resolutions No. 9623 “Manual Cross-out in the EDCVLs and PCVLs of names of voters with approved application and deceased registered voters’ and No. 9764 “Abatement of Subsequent Registration Records of Voters found to be Double/Multiple through AFIS’, which directs the OEOs to manually cross-out from the EDCVLs and PCVLs the names of registered voters: a) With approved transfer of registration records to another district/city or municipality as stated in the Notices of Approval and to indicate on the top of the crossed-out name the following annotation “TRANSFERRED TO_____” indicating therein the distict/city/municipality where the voter has transferred followed by the date of annotation and signature of the EO. b) With double/multiple registration records based in the AFIS matching, that were abated during the December 3, 2018 ERB hearing for Non-Bangsamoro Organic Law (BOL) Areas pursuant to Minute Resolution No. 18-1126 dated November 14, 2018; and December 10, 2018 ERB hearing for BOL areas pursuant to Minute Resolution No. 18-1159 dated November 28, 2018 and indicate on the top of the crossed-out name the annotation “ABATED DUE TO DOUBLE/MULTIPLE REGISTRATION AS PER AFIS”, followed by the date of the annotation and signature of the EO. c) Included in the Certificate of Deceased Registered Voters from the Local Civil Registrar or based on the A pager of4 Sworn Affidavit of next of kin of the deceased voters who have personal knowledge of the death of the voters and indicate on the top of the crossed-out name the annotation “DECEASED AS PER CERTIFIED LIST FROM LCR/SWORN AFFIDAVIT OF NEXT OF KIN’, followed by the date of annotation and signature of the EO. d) Excluded by Court Orders with Certificate of Finality issued by the Metropolitan/Municipal Trial/Circuit Courts or by the Regional Trial Courts in case an appeal was made pursuant to Section 35 of Republic Act No. 8189 and indicate on the top of the crossed- out name the annotation “EXCLUDED PER COURT ORDER ISSUED BY MTC/MCTC/RTC BRANCH followed by the date of annotation and signature of the EO. B. INCLUSION OF NAMES OF VOTERS IN THE EDCVLs AND PCVLs: 1. The identification of the names of voters not included in the lists of voters shall be made before and during the conduct of verification and certification of the EDCVLs and PCVLs in accordance with the Calendar of Activities but in no case beyond the date of the last day of posting of the PCVLs, except in case of final and executory court inclusion orders. 2. Requests for inclusion in the lists of voters shall be received by EBAD not later than the last day of posting of the PCVLs to be submitted for consideration of the Commission En Banc, 3. All requests duly approved by the Commission En Bane, either through Resolution or Minute Resolution shall be applicable only to the registered voters included in the requests. The Resolution/Minute Resolution shall not be made applicable by analogy to other similar situations under the legal maxim “expressio unius est exclusio alterius”. 4. Approved names of voter for inclusion through a Resolution/Minute Resolution shall undergo the following process: a, Posting of the copy of the Resolution/Minute Resolution with attached names of voters in the OEOs bulletin boards, copy furnished the representatives of the citizens’ arm and other election stakeholders. b. Manual insertion of the names in the EDCVLs and PCVLs shall be undertaken by the EO authenticated by his/her signature and by the signature of the representative/s of the citizens’ arm or election stakeholder, if available.
