Most respectfully showeth:

1. That the above-named defendant has never received the summons of

the instant Suit. However, we came to know about the pendency of the
instant suit before this Hon'ble Court. Therefore, as an abundant
precaution we are tendering appearance through counsel today i.e. on
__________ as per the directions of this Hon’ble Court.

2. The defendant has also notified the plaintiff regarding entering of

appearance before this Hon’ble Court on __.__.2019. The address of
the defendant for purposes of serving notices/summons is given

3. It is submitted that summons of the case and complete set of the

Suit/Plaint has not been supplied to the Defendant. Therefore, the
 Defendant pray to direct the Plaintiff to supply a complete set of Plaint
to the Defendant.

It is therefore most respectfully prayed that this Hon’ble Court may be

pleased to pass an order:

a) Directing the Plaintiff to supply a complete set of Plaint to the

Defendant;
b) And to pass such other order/s as may be deem fit and proper in the
facts and circumstances of the case.
