1. That the matter is pending for adjudication before this Hon’ble court
and fixed for today DT. 05.12.2022.
2. That on dt 7.07.2022 the Defendant No.1 counsel filed an application
under order 9 rule 13 of CPC, 1908 for setting aside ex-parte order
passed by the honble court and the said application was set aside by
the Hon’ble court with cost imposed of Rs. 10, 000/- on the defendant
No.1on dt.08.09.2022.
3. That the Defendant No.1 is not financial stable and dependent on
relatives for expenses and unable to pay the cost amount i.e. Rs
10,000/-

PRAYER:-

It is therefore most respectfully prayed that the cost of Rs.10,000/-

imposed upon the Defendant No.1 may kindly be waived off, in the interest
of justice .
