1. That I am the Respondent No. 2 in the above-mentioned

Writ Petition. I am aware of the facts and circumstances of

the case and I am filing this preliminary affidavit in the

aforesaid writ petition to bring to the attentio� of this

2. That the order dated 11.07.2019 passed by this Hon'ble
- Court in the captioned writ petition has been brought �

my notice. In this regard I have .already filed an

application for recall of the said order dated 11.07.2019 in

so far as it directs "... the Hon'ble Speaker shall take a

decision forthwith and, in any case, in the course of the

remaining part of the day•.The said Application has been

numbered as J.A. No. 100981 of 2019 in W.P. (C) No. 872

of 2019 and is pending consideration.

3. That at the time of preparing this affidavit, the Writ

Petition as filed in this Hon'ble Court has not yet been

served upon me or my counsel. However, I have been

informed by an advocate, Mr Ashwin G. Raj, who was

present in Court that certain remarks were made by the

Senior Counsel for the Petitioners before this Hon'ble

Court that "I was making myself scarce» and had avQided

even meeting the Petitioners in the captioned Writ

Petition. Though a copy of the Writ Petition is still not

served upon me or my Counsel, I have accessed a copy or

the same as published on a well-lmown social meatia \ilte.

Therein an allegation has been made against me which·

reads as follows

4. Suen allegations it is submitted not only undermine the •

authority of the office of the. Speaker but are absolutely

fallacious to say the least and h_ave been made only -.vith

an intent to mislead this Hon'ble Court.

5. In this regard, I wish to place certain factual der.ills

regarding the course of

• events as have unfolded since

February, 2019, and also some legal submissions for the

kind consideration of this Hon'ble Court.

a. It is relevant to point out that disqualification

petitions in respect of Shri Ramesh Jarkhiholli ·and

Shri Mahesh Kumathalli (P.etitioner Nos. 2 and 7 .
herein) have been filed as far back as on 11.02.2019, ·

• b. Notices under Rule 7 of the The Kamataka

- Legislative Assembly (Disqualification of Members on.

the Grounds of Defection) Rules, 1986, were issueci

on 14.02.2019,to Shri Ramesh Jdrkhiholi and Shri

Mahesh Kumathalli, Petitioners No 2 & 7 in the

captioned Writ Petition.

c. The replies/objections to the disqualification

petitions were received thereafter on 20.02.2019 .

On 07.03.2019, notice was issued to Shri Ramesh'

Jarkhiholi and Shri Mahesh Kumathalli, Petitioners

No 2 & 7 in the captioned Writ Petition, under Rule 7

petitions are currently pending consideration.

f. In the meanwhile, on 01.07.2019, Mr. Anand Singh

submitted a resignation letter. On the same day the

Hon'ble Governor wrote to the Speaker to take action

as per the Rules.

It is submitted that none of the aforementioneq

MLA's ever submitted their resignations in persqn or
by hand to· me. It is therefore patently false to

suggest that the Speaker had made himself scarce or
was unavailable. I was available throughout the
week, including on Saturday the 6th of July 2019 tilt
12:30 PM. None of the Petitioners have sought'any
appointment. As I was pre-occupied with my
personal work, I left the office at 12:30 PM. Ohly_
subsequently I came to know from my office that the
Petitioners had come to my offic�.at around 2:30 PM
to give the resignations. I advised my office to receive.

On 09.07.2019 a communication was sent to the

Hon'ble Governor by me, stating that none of the

members have ever contacted me or my office to seek

an appointment to submit these resignation letters.

Further the letters were not in accordance with the

prescribed format. It was also informed that 3 of the •

MLAs had been given an appointment on 12.07.2019

and the remaining had been given appointment on

15.07.2019. A copy of the letter dated 09.07.2019 is

annexed hereto and marked as ANNEXURE R-3 er,. \.4-1�

1. I have also sent letters to the 14 MLAs on

09.07.2019 informing that only the resignation

letters of 5 MLAs were in proper format and

requested the remaining to submit their resighation

• in theproper format if they wished to resign in .terms

of Rule 202, Rules of Procedure and Conduct, of,

Business in Kamataka Legislative'Assembly.

Shivram Hebbar (Congress) re-submitted their

resignations on 1Qth July 2019 as requested by me

as the earlier resignations was not in the proper

format. It is further relevant to t'bint out that on the

- very same day, i.e., on l0lh July 2019, the above writ
petition has been filed by them as if I am siting o�
their resignati�ns, when, as a matter of fact, they

had submitted their resignations on the very same

day. This aspect of the matter is not forthcoming in

the writ petition filed before this Hon'ble Court .

p. 1 further state that at 6.15 PM on 11.07.2019, 10

number of MLAs came and met me in my chambers

and handed over fresh letters of resignation. The

entire proceedings were videographed and are

submitted along vvith the present affidavit as

ANNEXURE R-4. The MLAs during the course of

hearing admitted that they had never tendered their

resignation to the Speaker personally. The, MLAs

also confirmed that they had neither sought time nor

the Speaker. They also stated, .
that it is wrong to state that when the MLAs had

come to offer resignation the Speaker had escaped

from the back door. All these statements of the

MLAs are available on record for perusal of fuis

Hon 'ble Court. 1 •am bringing this on record only to ·

show that tHe Petitioners have misled the Court.'

process of considering the resignations and such

6. I have placed the aforesaid facts to bring to the the kind

attention of this Hon 'ble Court the entire gamut of broad

facts so that this Hon 'ble Court can take a wholesome

view of the matter.

7. Whi� I have brought these facts voluntarily to the

attention of this Hon'ble Cow-t out of respect Etnd

reverence, at the same time however, as a constitutiQnal

functionary l may also bring to the notice off this Hon 'ble ·

Court certain legal issues which may be considered.

8. It is submitted that this Hon'ble Court before proceeding ,

ahead with the merits of the matter ought to consider

whether a direction as has been issued on 11.07.2019,

could at all have been issued given the framework of our

Constitution.

9. As a matter of fact, even a direction by the Supreme c;:ourt

to the Speaker to intimate on affidavit «how much time is

required for disposal of the petitions� under the Tenth

- Schedule was kept in abeyance uide a subsequent order.

this regard I wish to draw the attentien of this Hon'ble

to the captioned Writ Petition which is full of blunders and

distortions and crave leave of this Hon'ble Court to file a

detailed Affidavit as and when necessary .
