Hazardous Waste Management


The Ministry of Environment and Forests (MoEF), Government of India(GoI) has notified Hazardous Waste (Management,
Handling and Transboundary Movement) Rules, 2008 on 24.09.2008 under the Environment (Protection) Act, 1986.
As per these rules, 36 categories of processes (Schedule – I) have been identified as hazardous waste generation processes. The
occupier generating hazardous waste shall obtain authorization under Rule 5 (4) for generation, handling, collection, reception,
treatment, transport, storage, recycling, reprocessing, recovery, reuse, and disposal of Hazardous Wastes as applicable. These
rules can be downloaded from the website of MoEF & CC (www.envfor.nic.in).
These rules are notified to ensure safe handling, generation, processing, treatment, package storage, transportation, reprocessing,
collection, conversion and offering for sale, destruction and disposal, of Hazardous Waste. If these wastes are not properly
handled, will cause air, water and soil pollution.

How to Apply for Hazardous Waste Authorization


Procedure for filing and processing Hazardous Waste Authorization applications:
The APPCB is issuing Consent for Operation (CFO) and Hazardous Waste Authorization (HWA) combinedly.
The occupier of industry/activity/project uploads the application along with prescribed fee and required documents (list given
below) online through the “Single Desk Portal” – www.apindustries.gov.in.
Internal processing of application:

 On receipt of online application, the official of concerned Regional Office (RO), APPCB inspects the industry.
Inspection of the industry/activity is completed within 72 hours of receipt of application from Single Desk Portal.
 As per the delegation of powers, the applications are processed at RO level or they are forwarded along with the
inspection report to the Zonal Office (ZO)/ Head Office (HO) for processing.

 The official may before or after inspection seek additional information through Single Desk Portal from the applicant for
the purpose of processing the application.
 The RO/ZO/HO of APPCB process application as per delegated powers within the stipulated timelines.
 The proposals are placed before the CFO committees of the Board for examination and for recommendations.
 The decision (issue of consent/rejection of application) on approval is communicated and the approval order / rejection
order is uploaded in the Single Desk Portal within the stipulated time lines for the user to download. The Rejection order
contains the reasons for rejection.

Hazardous Waste Authorization Renewal


In case of renewal, the applications are to be submitted prescribed Form – I along with CFO renewal application with relevant
enclosures. The applications are verified and examined at field level for specific compliance status on case to case basis by the
RO / Board Officials. All the applications with verification reports are placed in the respective CFO Committees existing at
different levels to examine the compliance status & to decide the issue of combined consent order and HW Authorization. The
person shall not handle the Hazardous Waste without having valid authorisation of the Board. The Board recently revised
renewal periods of the CFO as follows:

Grant of registration for recycling, reprocessing or reuse of Hazardous


Waste
Every person desirous of recycling or reprocessing the hazardous waste specified in Schedule- IV has to obtain registration as
recycler employing Environmentally Sound Technologies (EST).
How to apply
The following documents shall accompany the application form in Form- 5 and submitted in the RO concerned for processing of
the registration as per delegated powers:
1. Copy of Consent to Establishment
2. Certificate of registration issued by the District Industries Center(DIC) or any other government agency authorised in
this regard
3. Proof of Installed capacity of plant and machinery issued by the DIC or any other government agency authorised in this
behalf and
4. In case of renewal, certificate of compliance of effluent, emission standards and treatment and disposal of hazardous
wastes, as applicable.

The RO verifies the application and submits report to HO for issue / reject the registration.

Grant of registration for import of wastes in Schedule-lll, Part (D)


Every trader desirous of import of Metal scrap, paper waste and other wastes as listed in Schedule III (Part D) may make an
application in Form -16 to the State Pollution Control Board(SPCB). The application along with the following enclosures is to be
submitted at concerned RO for processing.

1. Name and address of the trader with telephone and Fax Numbers (With Proof).
2. TIN/VAT Number / Import Export Code.
3. Description of the waste to be imported.
4. Details of storage, if any.

Grant of registration for of wastes in Schedule-lll, Part (D)

M/s. Coastal Waste Management Project (CWMP), Pharmacity, Parawada, Visakhapatnam
In order to ensure scientific disposal of Hazardous Wastes in the State, one Treatment, Storage and Disposal Facility (TSDF) has
been established in the name of M/s. Coastal Waste Management Project with incinerator and land fill at J.N. Pharmacity,
Parawada, Visakhapatnam.
Co-processing of Hazardous Waste
Earlier, organic residues generated from Bulk Drugs & Pharmaceuticals units were incinerated in the captive / common
incinerators whereby wasting the heat value of the Hazardous waste. The energy potential of the hazardous waste is just lost. By
opting Cleaner Production technologies the high calorific value of Hazardous waste generated from Bulk Drugs &
Pharmaceuticals industries are effectively disposed off through cement kiln being operated at 1400 degree centigrade where by
using lot of heat energy resulting in saving of fossil fuels being burnt in the kilns.
APPCB is encouraging co- processing of certain categories of Hazardous Waste in cement plants.
The Central Pollution Control Board (CPCB) is issuing permissions for Co-processing of Hazardous Waste in cement kilns.
APPCB inline with the guidelines of CPCB on co-processing, is encouraging cement plants with rotary kilns to establish
facilities for co-processing of hazardous wastes.
APPCB is putting the responsibility of transportation of the Hazardous wastes either with generators of the hazardous wastes or
with the cement plants to avoid transportation problems. The authorised cement plants have been directed to obtain regular
permission from CPCB for co-processing as and when required.
Procedure for cement plants to obtain regular permission for co-processing of Hazardous Waste:
The prescribed in application under rule 11 of HW Rules, 2008 with supporting information is to be submitted at RO concerned.
After inspection, the report will be forwarded to HO for placing before CFO committee. After grant of trial run permission, the
cement plants will have to conduct trial runs. The trial run report along with RO report/remarks will be forwarded to the CPCB to
take a decision on grant of regular permission.
