ANNULMENT

DIVORCE

 they're still recognized as having been married previously


 legal termination of a marriage by a court in a legal proceeding, requiring a petition or complaint
for divorce by one party

NEED (Not needed)

 There are already existing laws ( Annulment and Legal Separation)


- Strengthen the Existing ones
- Revisions can be done
 Family Code focuses on the reconciliation of the family

Beneficiary( WHY NOT)

 Norms are different from the nature of divorce “CLOSE FAMILY TIES”
 Affects the children

Practicality ( WHY NOT )

 Matrimonial Tribunal – wherein the parish priest writes to this, then the church will allow
the separation of a couple even if they have no finance for it
 Not everyone knows the actual difference of divorce and annulment

POINTS:

Questionable yung Sec. 5 par i. ng Divorce bill. It says breakdown of marriage. Since court rulings ang
masusunod ditto, maraming kalse ang breakdown of marriage. Pwede lusutan at gawan ng kakaibang
rason para yun yung magamit na ground.
“ In divorce, it destroys the sanctity of marriage since it existed which is contrary to what the
Civil and Family code and even the Constitution Protects. Annulment doesn’t destroy since
the marriage is INVALID in the first place”
“ There are already existing laws that could still be strengthen and revised”
“Imagine when saying I do, in the back of the head of the person getting married, “ay dibale
let me just try this, may divorce naman” Then sanctity and the sincerity will be of no use”

that’s what the FAMILY CODE does. What annulment does. If you protect a family, yun na
mismo ang citizens and state since family is the basic unit of the community. Diba ang law, it
favors the accused? Annulment makes sure that before a family gets broken, its because of a
valid reason and a valid ground, that it’s not because ‘ayaw mo na’ or ‘hindi ko na maayos’ or
worst ‘iba na ang gusto ko.’
