PENALTY CHARGE NOTICE (PCN) No: NP9162413A

LOCATION OF CONTRAVENTION: FOUNDRY STREET, NORTHAMPTON

Thank you for your recent correspondence regarding the above PCN.

I note from our records that your vehicle was issued with the above notice as
it was parked on a single yellow line during restricted hours.

I can confirm that the Civil Enforcement Officer’s notes first record your
vehicle at 16:01 and again at 16:08. A discretionary observation period was
therefore allowed to ascertain whether loading or unloading was taking place
and as no activity was observed at your vehicle during this time the PCN was
correctly issued.

For future information, a single yellow line indicates that a waiting restriction
applies and is usually accompanied by a time-plate located nearby but as the
single yellow line in this case is within a Controlled Parking Zone, it operates
for the same period as the zone and is covered by the information signs
located on all major entry roads clearly indicating the valid times. A vehicle
may park unrestricted on single yellow lines outside the stated hours
according to the zone entry signs.

I can advise you that Foundry Street, Northampton is within a Controlled


Parking Zone (Pay and Display Zone) and the restrictions apply every day
from 7am until 7pm; therefore the Penalty Charge Notice was issued
correctly.
The map below shows the location of the entry and exit signs indicated by the
red circles, the star indicates where your vehicle was parked.

I have included 2 photos below showing the signs in place which you may
have passed depending on your route in to the town centre.

Regrettably, the mitigation you have provided on this occasion is not sufficient
to justify cancellation of the above notice.

I am sorry that I am unable to offer you a more favourable outcome but trust
you can now understand the reasoning behind my decision.

The above PCN therefore remains due and payable to ‘Northamptonshire


County Council’. Please forward the sum of £35.00 to this office within 14
days from the date of this letter. After this period the full charge amount of
£70.00 will be due.

 By Post: Cheques & Postal Orders must be made payable to


Northamptonshire County Council and sent to Parking Services,
One Angel Square, Angel Street, Northampton NN1 1ED. Please
ensure that the PCN number and registration number of your vehicle is
written on the reverse of the cheque/postal order.

Please do not send cash and allow 2 working days for 1 st class post and
5 working days for 2nd class post.

Although your request to cancel this notice has been refused you still have the
right to make a formal representation to the council, which will be considered
afresh.

The registered keeper of the vehicle will receive a ‘Notice to Owner’


approximately 28 days after the PCN was issued and on the reverse of the
‘Notice to Owner’ are instructions about how to make a formal representation.

You should note that no formal representations will be accepted until after the
28 day period has elapsed. At this stage you will have opted not to take
advantage of the discount period, and charge of £35.00, and accordingly the
full amount of £70.00 will be due.

If you make representations and these are subsequently rejected, you will still
have the opportunity to appeal to the independent tribunal service (parking
adjudicator), who will be able to consider whether the motorist’s case falls
within any of the statutory grounds for appeal.
