Dear Engr. Moreno:
‘This refers to your letter dated June 11, 2018 regarding “application of CSC Resolution
‘No 001897 dated 21 August 2000 for the exemption of the lawyers of the Department of
Environment and Natural Resources-Region III from the use of the bundy clock”. Pertinent
portions of which read:
“In the said resolution, the CSC allowed the lawyers of the
Legal Services Division of the DENR Central Office to be
exempted from the biometrics considering the “special nature of
their functions which necessitates a different and more exacting
hours to address the various demands of the Department.
“The lawyers in the DENR Regional Office are in a similar
situation. They perform like duties as their counterparts in the
Central Office. xxx The nature of the duties of the lawyers are thus
special in nature, making the pressing of the fingers four times a
day on the bundy clock impractical, if not, impossible.
“In this regard, it is requested that the exemption granted to the
lawyers of the Central Office be likewise granted to the lawyers of
this Regional Office.”
The request of Antonio H. Cerilles, then Secretary, Department of Environment and
‘Natural Resources reads:
“In consideration of the special nature of the functions being
‘performed by the lawyers of the Legal Service of this Department
which necessitates a different and more exacting work hours to
address the various demands of the Department, exemption from
using the bundy clock to all lawyers in the Legal Service is hereby
requested.” (emphasis supplied)

This is to seek the application of CSC Resolution No. 001897 dated 21 August 2000 for
the exemption of the lawyers of the Department of Environment and Natural Resources-Region
III from the use of the bundy clock.
In the said resolution, the CSC allowed the lawyers of the Legal Services Division of the
DENR Central Office to be exempted from the biometrics considering the “special nature of their
functions which necessitates a different and more exacting work hours to address the various
demands of the Department.”
‘The lawyers in the DENR Regional Office are in a similar situation. They perform like
duties as their counterparts in the Central Office. The duties of the lawyers, such as hearings,
investigations, and meetings throughout the Region, are not limited to the confines of the office:
unlike the duties of the other employees who have to be present in the office in order to perform
their work. The nature of the duties of the lawyers are thus special in nature, making the pressing
of the fingers four times a day on the bundy clock impractical, if not, impossible.
In this regard, itis requested that the exemption granted to the lawyers of the Central Office
be likewise granted to the lawyers of this Regional Office.

From the aforecited provision, itis clear that the maintenance of a daily

through the use of a bundy clock Other means of recording attendance may be
allowed, provided the same shail be subject to verification,

WHEREFORE, the request of Secretary Cerilles for the exemption of
awyers in the DENR Legal Service from the use of the Bundy Clock is hereby
granted. In lieu thereof, they are directed to use an attendance logbook, which
should be under the custody of a responsible officer of the DENR.
