Helmets While Driving and Providing
Penalties Thereof

Section 3.
Mandatory Use of Motorcycle Helmets

All motorcycle riders, including drivers


and back riders, shall at all times wear
standard protective motorcycle
helmets while driving, whether long or
short drives, in any type of road and
highway.

are appropriate types of helmets for
motorcycle riders that comply with the
specifications issued by the Department of
Trade and Industry (DTI).

Section 4. Exemption

Drivers of tricycles shall be exempted


from complying with the mandatory
wearing of motorcycle helmets as
provided in this Act.

Section 5 .
Provision of Motorcycle Helmets
A new motorcycle helmet which bears the
Philippine Standard (PS) mark or Import
Commodity Clearance (ICC) of the Bureau
of Product Standards (BPS) and complies
with the standards set by the BPS shall be
made available by the seller and/or buyer

1. The ICC stickers in hologram was introduced in 2009


2. It has a silver grey color.
3. The capital letters of ICC is in the middle of a gear.
4. Under the gear is the unique serial number.
5. The hologram sticker has security features.
It is tamperproof and serialized for better protection.

1. The improved ICC sticker in hologram format was


introduced in 2012.
2. The new ICC hologram sticker was manufactured via
electron beam.
3. It is in rainbow colors.
4. Still the capital letters of ICC is in the middle of a gear.
There are wave lines to demonstrate genuineness of the
logo.

1. The logo is a globe with a check at the lower right.


2. The capital letters of BPS is on the right of the check.
3. Before the logo is the word CERTIFIED in capital letters.
4. Under this is “Product Safety”
5. The next in line is the license number that was issued in the
PS license of the manufacturer of the motorcycle helmet.

Section 7. Penalties
Any person caught not wearing the
standard protective motorcycle helmet
in violation of this Act shall be
punished with a fine of the following:

First Offense One thousand five hundred pesos
(Php 1,500.00)
Second Three thousand pesos (Php 3,000.00)
Offense
Third Offense Five thousand pesos (Php 5,000.00)

Fourth Ten thousand pesos (Php 10,000.00)

TYPE OF HELMETS
1. Full-Face
- covers the whole head;
has a chin bar that
extends outwards,
wrapping around the chin
and jaw area; a plastic
face shield (clear or
tinted) resting over the
cutout eyes and nose
section allows access to
the face if pushed up.

TYPE OF HELMETS

2. Open-face (3/4)
- covers the back of the skull, but
rids itself of the lower chin armor
and the face shield, thus
allowing for increased airflow,
hearing and peripheral vision.
Some open face helmets are
equipped with visors of various
lengths and tints that blocks out
sunlight and headlights.

3. Half-head
- These helmets provide
protection by means of a
hard outer shell and a
crushable inner liner. They
do not offer protection for
the chin or jaw area and
are rarely equipped with
visors.

Definition of Terms

1. Standard Protective Motorcycle Helmet


refer to helmets and visors that are appropriate types
of helmets for motorcycle riders that comply with the
specifications prescribed by DTI and which bear the
Philippine Standard (PS) mark or Import Commodity
Clearance (ICC) of the BPS.

2. Philippine Standard (PS) Safety


Certification Mark
refers to a mark of conformity to product
safety standards, which appears on a
product or product packaging

3. Import Commodity Clearance (ICC)


refers to a document issued by the DTI/BPS attesting
that the imported product, which is covered by a
mandatory PNS, conforms to the specific Philippine
National Standard.
4. PNS UN-ECE 22:2007
refers to the uniform provisions concerning the
approval of protective helmets and their visors for
drivers and passengers of motorcycles and mopeds in
the United Nations Economic Commission for Europe
(UN-ECE) Protocols.
