AFFIDAVIT

I, NENITA C. BAJALA, of legal age, Filipino a resident of Iloilo City, after

having been duly sworn to in accordance with law, hereby depose and state:

1. That, my name is NENITA C. BAJALA, of legal age, Filipino a resident of

Iloilo City and a meat vendor at North Baluarte, Molo, Iloilo City.

2. That, I want to claim what is due to me against committed by

FRANCISCO P. DOROMAL, of legal age, and a resident of Sitio Centro,
Brgy. Tabuk Suba, Jaro, Iloilo City, I filed this small-claims complaint
against him.

3. That, sometime on September 2017, I hired the respondent to raise my

three (3) piglets within five (5) to six (6) months for disposal but she failed
to produce the raised three (3) piglets to me. FRANCISCO DOROMAL
fails to pay me until now, what he owes but ANA ROSE JURIDICO has
settled the damages about being part of this felony and pay her debt.
Sang September 2017,

4. That, the respondent said that the three (3) piglets got sick but he will pay
the prices of the piglets and her debt to me amounting to P 1,000 on May
31, 2018. Sadly, he did not pay.

5. That, I also seek the help of the Office of the the Punong Barangay in
Barangay Tabuc Suba, Jaro.

6. That, in the said Office, ANA ROSE JURIDICO and FRANCISCO

DOROMAL and I agreed in front of the Office of the Punong Barangay
on March 14, 2018, to do the following:
1) ANA JURIDICO promised to pay me on May 31, 2018 the amount
of P 7,500 cash;
2) FRANCISCO DOROMAL promised to pay me on May 31, 2018 the
amount of P 8,500 cash.

As from that, I want also to claim to them the expenses incurred in this
filing of the small-claims complaint from its filing fee up to the consultation
and notarization fees of my legal counsel.

7. That, only Ana Juridico paid the debts and the damages of not
producing the three (3) piglets but FRANCISCO did not pay even a cent.

8. That, he defrauded me in front of the Punong Barangay and Hon.

Jabonillo can testify that Francisco adamantly refused to pay up the
amicable settlement agreed upon by the parties. I relied on his statement
in the settlement but until now he is forcibly refusing to pay the agreement
disregarding the presence of the Punong Barangay which mediates the
signed amicable settlement.

 I have also filed an Estafa case against the same respondent but sadly the
prosecutor`s office dismiss the complaint (ANNEX B).1

9. That, the Punong Barangay issued the certification to file action (ANNEX
C), which states that there is a failure of settlement and I can now file an
action before the court any government agency after redressing
administrative remedies.
