A PROPOSED RESOLUTION ADOPTING AND APPROVING THE


COMMITTEE REPORT OF THE COMMITTEE ON COMPLAINTS AND
INVESTIGATION DATED JUNE 19, 2019, DISMISSING THE COMPLAINT
FILED BY HON. FERDINAND C. JUMAPAO, ET. AL., AGAINST HON.
LUCELITO B. PILAPIL, FOR: GRAVE ABUSE OF AUTHORITY, GRAVE
MISCONDUCT, GROSS NEGLIGENCE, DISHONESTY, VIOLATIONS OF
THE CODE OF CONDUCT AND ETHICAL STANDARDS FOR PUBLIC
OFFICIAL AND EMPLOYEES, AND CONDUCT PREJUDICIAL TO THE
BEST INTEREST OF THE SERVICE, DOCKETED AS SP CBU 2015-37

WHEREAS, the Sangguniang Panlalawigan as a quasi-judicial body is


vested under the pertinent provisions of Republic Act No. 7160 otherwise known
as the Local Government Code of 1991 to hear and decide administrative
complaints against erring municipal elective officials with power to impose
sanctions and penalties in relation thereto;

WHEREAS, Cebu Provincial Ordinance No. 2015- 23, entitled “Prescribing


the Rules and Procedures Governing Investigation of Administrative Cases
against Elective Municipal Officials of the Province of Cebu” was enacted to guide
the Sangguniang Panlalawigan Members in the conduct and effective
implementation of its quasi-judicial power;

WHEREAS, a case was filed with the Sangguniang Panlalawigan and


docketed as Administrative Case No. SP CBU 2015-37, entitled “HON.
FERDINAND C. JUMAPAO, ET. AL., Complainants, versus HON. LUCELITO
B. PILAPIL, Respondent.” For: Grave Abuse of Authority, Grave Misconduct,
Gross Negligence, Dishonesty, Violations of the Code of Conduct and Ethical
Standards for Public Officials and Employees, and Conduct Prejudicial to the Best
Interest of the Service;

WHEREAS, in compliance with the aforementioned ordinance, the


Committee on Complaints and Investigation, to which the case was referred to for
appropriate action, implemented the required procedure and adopted course of
action necessary to judiciously resolve the same;

WHEREAS, after a close scrutiny of the facts and circumstances attendant


to the present case, the Committee on Complaints and Investigation in its
Committee Report dated June 19, 2019, resolved to DISMISS the subject
complaint for lack of merit;

NOW, THEREFORE, on motion of ______________________, duly


seconded by ______________________________, for the approval of the Resolution
authored by Hon. Raul D. Bacaltos and co-authored by Hon. Victoria Corominas-
Toribio, Hon. Agnes A. Magpale, Hon. Glenn O. Bercede, Hon. Alex S. Binghay,
Hon. Edsel A. Galeos and Hon. Thadeo Jovito M. Ouano, be it:

RESOLVED, as it is hereby RESOLVED, to adopt and approve the


Committee Report of the Committee on Complaints and Investigation dated June
19, 2019, dismissing the complaint filed by Hon. Ferdinand C. Jumapao, Et. Al.,
against Hon. Lucelito B. Pilapil, for: Grave Abuse of Authority, Grave Misconduct,
Gross Negligence, Dishonesty, Violations of the Code of Conduct and Ethical
Standards for Public Officials and Employees, and Conduct Prejudicial to the Best
Interest of the Service, docketed as SP CBU 2015-37.

RESOLVED FURTHER, to furnish a copy of this Resolution to all parties


concerned for their information.

CARRIED UNANIMOUSLY.
