PETITION

PETITIONER, Anika dela Cruz, by counsel, respectfully states:

1. Petitioner is 27 years old, born on January 14, 1992, and a resident of Baleno Street,
Iligan City where summons may be served for the instant case. Petitioner is a graduate
of Bachelor of Science in Accountancy at Mindanao State University – Iligan Institute of
Technology in the year 2012 and is currently employed as an accountant in the said
university.

2. The respondent is 31 years old, born on June 22, 1984, and a resident of # 23 Purdue
Street, lligan City, where he may be served with summons for the instant
case. Respondent finished Bachelor of Arts in Political Science at San Beda University
and is currently employed as an Executive Assistant at Duralex Sedlex. He had been
employed in said job since 2011.

3. Petitioner and respondent were married when they were 16 years old only. Without any
means to support themselves, they lived with Peter’s parents while Anika took odd jobs
and Peter refused to work and was most of the time drunk. Petitioner urged him to find
work but this often resulted to violent quarrels.

4. A year after their marriage, Anika left Peter. Peter thereafter found another woman with
whom he has since lived. 10 years later, she filed a petition for declaration of nullity of
marriage under Art. 36 psychological incapacity. Anika testified on the alleged physical
beating she received.
5. The expert witness corroborated parts of Anika’s testimony. Both her psychological report
and testimony concluded that Peter was psychologically incapacitated.

PRAYER

WHEREFORE, premises considered, it is respectfully prayed that the marriage of

the parties be annulled in accordance with Article 36 of the Family Code.

Petitioner also prays for other reliefs as may be deemed just and equitable in the
premises.

City, after having been sworn to in accordance with law, depose and say:

1. That I am the petitioner in the above-entitled case;

3. That all the allegations therein are true and correct of my own knowledge and
based on authentic records;

4. That I hereby certify under oath that I have not heretofore commenced any
other action or proceeding involving the same issues in the Supreme Court, Court of
Appeals or any other tribunal or agency, and that to the best of my knowledge, there is
no other action or proceeding, which is pending before this Honorable Court, Court of
Appeals, Supreme Court or any other tribunal or agency involving the same parties and
the same issues, and that if I learn hereafter that there are other proceedings pending
before this Honorable Court, or any other tribunal or agency, I hereby undertake to
report that fact within five (5) days therefrom to this Honorable Court.
