AFFIDAVIT IN SUPPORT OF THE PLAINT

In the matter of Trin Trin Foods (Pvt.) Ltd.

Affidavit of Mr.and Mrs. Apple

1. I, say that I am fully conversant with the facts of the present Plaint and I am therefore able to depose to
the same. I have filed the above Suit, seeking prayers more particularly mentioned in the Plaint.

2. That Mr. and Mrs. Apple are the only Directors and shareholders in Trin Trin Foods Pvt. Ltd. A company
incorporated under the Laws of India.

3. That on June 22nd, on page 7 of 2014 edition of “Darpan” (the only weekly newspaper of Shimla) there
was an advertisement from Rabbit Infrastructure Pvt. Ltd. promoting the lease and sale of shops in the
newly constructed shopping complex near Central Avenue Road. Mrs. Apple read the advertisement and
showed it to Mr. Apple.

4. That Having interest over the property both Mr. and Mrs. Apple visited Mr. Rabbit at his office Rabbit
Infrastructure Development Pvt. Ltd., No. #16, Chowringee Lane, Shimla to know more about the project.
While the discussion was on Mr. Rabbit told the benefits of the project to Mr. Apple and Mrs. Banana
representing Trin Trin Foods Pvt. Ltd. and said that the shops will be advertised in the local newspaper
every week and also said that there will be a super store coming up next to the shop of Trin Trin Foods
Pvt. Ltd.

5. That Rabbit Infrastructure Development Pvt. Ltd. convinced them to go for a lease of Five (5) years term.
The construction was complete by December 2015 and the Trin Trin Foods Pvt. Ltd. inaugurated their
shop on January 1st, 2016.

6. That until March 2017, there was no super store next to the shop of Trin Trin Foods Pvt. Ltd. and never
had they seen any advertisement on any of the local newspaper. After opening of the Super Store in April
2017 the business of the shop run by Trin Trin foods Private Limited drastically went down and
subsequently they were facing huge losses in the operation of the business.

7. On March 29th, 2018 Trin Trin Foods Pvt. Ltd. handed over a Notice of Termination of Lease to Mr.
Rabbit which was not accepted by the Rabbit Infrastructure Development Pvt. Ltd. Trin Trin Foods Pvt.
Ltd. decided to institute a legal suit in the court of law.
