.Facts: Month-old baby in China dies after grandfather fed him alcohol to ‘save face’.

The baby
was gone within the hour. The baby’s grandfather was carrying him around at the banquet, a
relative jokingly said, “Grandpa can’t drink if the baby doesn’t drink.” The grandfather, who was
reportedly slightly inebriated, then fell for the taunt. Wanting to save face, he fed the baby a
small cup of alcohol.

Decision:

The act was committed by dolo. There was a presumed general intent on the grandfather's side.
General intent is intending to commit the act, not the crime. ​The fact that the grandfather
committed the act that led to the death of his grandchild means that he intended for the crimez
itself to happen.Although the grandfather did not ​intend the precise harm or the precise result
that occurred which is the death of his grandchild, it is enough that the grandfather intended to
do the act, which is feeding his grandchild alcohol.

In the instant case, the grandfather’s intent to “save face” does not negate the fact that he
intentionally fed the child alcohol which has a substantial and unjustifiable risk. Intent of malice
is therefore present in this case.

The grandfather is guilty of parricide which is ​ the most terrible and unnatural of crimes​." People
v. Tibon. G.R. No. 188320 June 29, 2010. ​“​Human beings are expected to love and support
those who are closest to them. The extreme response of killing someone of
one’s own flesh and blood is indeed unnatural and tragic."
