Tour Booking & Cancellation Policy for Kailash Manasarovar Yatra 2019
Dear Pilgrims / Travelers
It is strictly recommended that you carefully read
the Kailash Mansarovar Yatra tour booking
conditions, payments / cancellation / refund
policy mentioned below and sign on each page of
this document as a token of your acceptance on
the same. While completing and submitting this
document to our office, you agree having
completely read, understood and accepted our
policy of booking the Kailash Yatra tour with us
and you abide yourself by the same. This
document constitutes the ‘Agreement’ between
Max Holidays India Pvt. Ltd. (Herein after
referred as ‘Company”) and you. The conditions
mentioned herein below and others posted on
our website http://www.kailash-yatra.org
and/or other information / conditions / policies
supplied to you by the ‘Company’ during the
course of correspondence will apply to the
exclusion of any other term or conditions unless
they are set out here in this document or are
otherwise agreed in writing between the
‘Company’ and you. Previous dealing between
you and the Company shall not vary these
conditions. No claimed variation of these
conditions will be effective unless in writing and
signed by the Director or an authorized Manager
of Company.
1. BOOKINGS »
To reserve your place in one of our ‘Fixed
departure group tours’ or in order to organize a
private group tour for you to Mt. Kailash and
Lake Manasarovar (Tibet, China), you need to fill
and sign the ‘Registration Application Form’ &
confirm your acceptance to our ‘Booking &
Cancellation Policy’ and send the same to us via
email or post. The original copy of these
documents should be sent to our New Delhi head
office by post/courier, duly signed by the
traveler. These documents should also have in
attachment clear self-attested copy of valid
passport (both pages), PAN Card (Indian
Nationals only), a copy of Voter ID Card (Indian
Nationals only) and Adhaar Card (Indian National
only). In the event of non-receipt of the original /
self-attested copy of these documents, the
electronically sent copy of the same shall be
considered as original for our official purpose
and further action. An advance payment for INR
15,000 / US$500 for Bus trips via Kathmandu and
INR 25,000 / US$750 for Helicopter trips, Inner
Kora, EBC and overland yatra via Lhasa must be
paid to our bank account immediately. The
advance deposit includes a non-refundable
amount of INR 10,000 / USD 250 (for Overland
trip from Kathmandu) and INR 20,000/ USD 500
(for Kailash Heli trip, via Lhasa, Kailash with EBC,
Kailash Inner Kora and other trips), disregard to
the cause of cancellation of the trip from either
side. Such non-refundable amounts are
charged as our service fee and professional
charges and the same cannot be refunded. All
bank fee and bank service charges for sending
payment and receiving refunds from us shall be
borne by the traveler only. All credit/debit card
payments are subject to 3% online bank fee
payable by the card holder in addition to the
actual payments, at the time of initiating the
online transaction.

2. DOCUMENTS »
As stated above, to enrol with us in one of our
groups you must provide us a copy of valid
Passport (coloured scanned copy only),
Registration Application Form along with
Booking & Cancellation Policy duly filled and
signed by the traveler, two recent passport sized
coloured photographs (Please check
specifications for the required photograph) of the
traveler (including one affixed on the form) and
Registration fee as described above in ‘para 1’.
We will also require a photocopy of valid
Doctor’s Clearance Certificate, copy of valid
Travel insurance and arrival/departure flight
information prior to the commencement of your
trip. Normal visa and various travel permits to
visit Kailash Manasarovar region are included in
our package cost and shall be taken care by us.
Transport to/from source destination, travel and
health insurance, mule and porter for Mt. Kailash
parikrama, emergency evacuation expense,
medical expense, tips, personal expenses,
additional transport charges, additional hotel
stay charges, additional meals etc are to be paid
by the traveller only.
Special remark for Passport: It is to be noted
that hand written passports are no more valid in
India and the same should not be sent for
booking. It is the responsibility of the traveller to
ensure that his/her passport is valid for atleast
six months from the first day of his/her entry in
China.
Special remark for Photograph: Kindly send us
coloured photograph only for visa as required by
China embassy for visa.
We bear no responsibility for any loss and non-
grant of permissions by the concerned
authorities if the documents/photograph are not
clear and are not acceptable to them
3. PAYMENTS »
Advance Payments - An advance payment as
stated above in ‘Para 1’must be made to our
office through Bank Transfer or Cheque or DD or
Cash or Credit Card. The advance deposit
includes a non-refundable amount as detailed
above in ‘Para 1’, which is charged as our service
fee and professional charges .
Incase the trip gets cancelled for any reason from
either sides, this amount will remain non-
refundable, after you have submitted the
‘Registration Application Form’ and have signed
this Agreement’ with the ‘Company’. All cheques
and other payments are subject to realization
and the booking is not considered as confirmed
unless timely payments are received in our
account for your bookings. We retain the right to
cancel the trip in the event of your failure to
make timely payments against your bookings. All
advance payments will be forfeited in such case.
Balance Payments – Full balance payments must
be received by us atleast45 days prior to the
yatra date. No booking will be considered as
'confirmed' unless full payment is received in our
account before the mentioned deadline. It is the

responsibility of the traveler to ensure timely
payments for his/her/their bookings. In the
absence of timely payments or incomplete
information / documentations from your end, we
retain absolute right to refuse to take you
onboard with our group by canceling your
participation. In such case no refund will be
applicable.
Bank Fee and Charges – As stated above, all
bank fee and charges for making payment to us
or receiving refunds from us are to be paid
by the remitter only and the same shall be
debited from the amount received by us for the
bookings.
Taxes : India GST (Goods & Service Tax) is not
included in our price offers and it is mandatory
for the customer to pay such taxes in addition to
the cost of the services / travel bookings.
4. CANCELLATION »
Unlike other tour and travel packages, the
cancellation policy for a Kailash Mansarovar tour
is very strict and tough. You must understand
them well and agree on the same before booking
a trip with us. If you do not agree to those
policies, you must not book a trip with us.
Cancellation by the traveler : After booking your
Kailash Manasarovar tour, if you wish to
withdraw your participation at any given time
after depositing the advance payments and
signing this ‘Agreement’, you must notify our
head office immediately through email only (no
telephonic cancellations will be entertained).
Kindly take a note that your advance payments
made for Kailash Manasarovar tour bookings
include a non-refundable amount of INR 10000 /
USD 250 (for Overland trip from Kathmandu) and
INR 20000/ USD 500 (for Kailash Helicopter trips,
Overland trip via Lhasa, Kailash with EBC trip,
Kailash Inner Kora and other trips) which is
non- refundable for cancellation due to any
reason. Other cancellations are subject to the
following fee and charges:
> 45-31 days prior to yatra – 25% of trip cost
> Less than 30 days – 100% of the trip cost
> Air ticket cancellation as per airline policy
Remark: It is to be noted that we usually apply
for the necessary Tibetan permits one month
prior to the trip and application submission and
issuance of the permit is totally at the discretion
of the concerned bodies/authorities. For any
delay or refusal in grant of travel permits or visa
by the concerned authorities/bodies, the traveler
will have to adjust his/her travel plans
accordingly. Any additional expenses incurred
due to such delay or non-grant of permit or visa
etc. are to be taken care by the traveler only and
the ‘Company’ shall not have any liability for it. If
the traveler wishes to cancel his/her trip for such
issues, all additional expenses including charges
for flights change, hotel stay etc are to be paid by
the traveler only. Once Tibet travel permit is
applied by us, no refund is applicable against any
sort of cancellation, even if the traveler is unable
to adjust his schedule with the changed date,
due to any personal reason.

Cancellation of bookings made under special
deals and offers : The bookings made under
‘Early Bird’ discount, ‘Last Minute’ deal, ‘Loyalty
Discount’ and other ‘promotional offers’ etc are
bond with strict cancellation terms which are
specified in various promotional schemes time to
time and they are either non-refundable or they
attract heavy cancellation fee. Such bookings
come usually with heavy discounts and they are
mostly non-refundable, non-adjustable and non-
transferable, in the event of cancellation due to
whatsoever reasons, unless not specified
separately by the Company during bookings.

Before availing such lucrative price
offers kindly do read all booking terms
carefully on our website www.kailash-
yatra.org too and ensure that you agree
to them.
Cancellation of the trip by the Company: In the
event when the pilgrim has fulfilled the
requirements of all necessary valid documents,
health check-ups and payments etc but Yatra has
been cancelled by the Company due to non-grant
of permit or visa by the concerned authorities
(except in force majeure conditions), full balance
amount shall be refunded to the pilgrims upon
receiving the same from the third parties in
India, Nepal and/or Tibet. However the non-
refundable amount for service fee and
professional charges as explained in Para1 above
will remain non-refundable and shall be debited
from the refund amount. For receiving refunds,
all bank fee applicable on refund transactions are
to be paid by you.
Force majeure cases : As stated above, the trips
to Mt. Kailash and Lake Manasarovar are
organized in very remote areas of Tibet
Autonomous Region in high mountains, under
extremely tough climatic conditions and with
availability of very basic infrastructure for food,
lodging and other tourism services etc. The level
of uncertainty in Kailash Yatra is ‘very high’ not
only due to climatic conditions but also due to
diplomatic reasons, political interference,
frequently changing policies of concerned
authorities, and local Govt. bodies, delay or
refusal in grant of travel permits/visa etc. Our
crew members, local partners and staff ensure
success and fulfilment of the trip but the same is
always subject to such force majeure situations.
The Company do not take any responsibility for
cancellation or amendment or delay of the yatra
(or any part/s of the trip) due to reasons beyond
its control which include, but not limited to,
climatic conditions, natural hazard, industrial
disputes, technical failures, road conditions,
flight rescheduling, delay in grant of permit or
visa, accidents, political reasons, sudden
notifications / announcement from any
concerned governmental body or vendor or yatra
organizing authorities, medical reasons of your
own or any other participant of the group, riots,
strikes, etc. No refund in such case will be
applicable and shall be at the discretion of the
Tibetan agents and other concerned authorities.
We shall make utmost effort in claiming the
possible refunds but we directly shall not be
liable for any refund unless received by us from
various service providers such as hotel, transport
agents, airlines etc. If the yatra is going and you

withdraw your name from the group due to any
force majeure reason including delay in receiving
travel permit and visa, there shall be no refund
applicable. If the yatra is not going on the fixed
date, we retain the right to offer you an
alternative departure date within the same
calendar year on same or other possible route
and with different mode of transport etc. All
additional expenses for such changes are to be
paid by the traveller. Also in force majeure cases,
all additional expense such as emergency
evacuation, chartering the aircraft/helicopter or
a seat, medical expenses for hospitalization,
additional stay and food charges, difference in
the cost of two trips, change in date of your
flights from home location etc shall be paid by
you only and not by the Company.
Cancellation after launch of the trip:
Cancellation by you : Once the trip has launched,
there is no refund applicable if you cancel the
trip in part or in whole due to whatsoever
reason.
Forced cancellation : Once the trip is launched
but interrupted or stopped by forced majeure
reasons (including but not limited to climatic
disturbance, natural hazard, political closure,
strike, riots, technical failure, industrial dispute
etc. and other reason beyond our control) no
refund or adjustment of payments will be
applicable for rest of the trip and other
unutilized services. In any case, if the travelers
wish to travel back without completing the trip
and leaving the other group members, granting
him/her/them permissions to do so will be
totally at the discretion of the guide and local
authorities and in such cases the additional
expenses for transport, stay, food and additional
permits etc will be on the traveler/s only. Such
expenses are payable on the spot, directly to the
local vendors.
5. REFUNDS & ADJUSTMENTS »
Every customer must take a written confirmation
from our office for refund against any cancelled
trip or service. Such refunds shall be initiated by
our accounts department within 30 days after
the completion of the yatra of the specific trip
and after receiving the same from various parties
and authorities in India/Nepal/Tibet etc. All
refunds shall be made in Indian Rupees only after
deducting applicable bank fee/service charges,
company service charges, taxes and other
charges as may apply and/or occur. Please note
that there shall be no refund applicable for any
unutilized service of the trip. The customers
accept not to have any right to claim such
refunds against unutilized service/s. All refunds
and adjustments will be as per the above
mentioned cancellation policy.
6. AGE OF THE TRAVELLER »
As per the rules of Tibetan government a
person with age of maximum 70 years is eligible
to apply for the Tibetan permit. The rules of the
local authorities in this regard keep changing and
the operators will have no control over the
decisions of the authorities. The travelers will be
bound to follow such rules and changes
announced by the authorities time to time. Mt.
Kailash Parikrama (Circumambulation) is
permitted to people upto 60 year age. However,
it is totally at the discretion of the local Chinese
guides and authority to allow or disallow anyone
for trekking of Mt. Kailash upon reaching
Darchen. Incase permit is granted to a person of
70 years of age or above he/she will be travelling
on his/her own risk and all the liabilities go to the
person and his/her relatives. Disregard to your
age and physical strength, it is advisable that you
consult with your doctor and get yourself
examined to know your medical status before
applying and paying for your bookings with us.
After booking the trip and before start of the trip
at any given time if the trip is cancelled for any
medical reason, cancellation charges as specified
in column 4 above will apply. At any given time
during the trip if you withdraw yourself from the
trip or if you are off-loaded by the guides from
the trip, due to medical reason you can’t go
further on the trip. Not only the trip amount is
non-refundable in such case even the additional
expenses incurred on you for medical treatments
and return journey are to be paid by you only.
7. MEDICAL DISCLOSURE »
While booking the yatra with us you declare that
you have got yourself examined properly by your
physician and you declare that you are in good
health with good mental and physical condition.
You confirm your awareness about the
challenging nature of Mt. Kailash and Lake
Manasarovar trips as it is performed in very high
altitude under tough climatic conditions and very
limited availability of tourism infrastructure. You
confirm that, you have informed the ‘Company’
in writing, about your medical conditions which
you are aware of. You confirm that the Company,
its Directors, partners, staff, associates, guides,
workers etc shall not be kept responsible for any
issue pertaining to your health or/and loss of
health/life and any additional expenses incurred
due to such cases. As a traveler, while booking
Kailash Mansarovar trip you are aware that you
shall not be allowed to proceed further on the
trip and shall have to return if you are declared
unfit by the local authorities or escort or tour
guides, at any point of the trip. No-refunds for
unutilized services will be applicable in such case
and all additional charges for return journey shall
be taken care by you only.
8. INSURANCE »
Your travel and medical insurance is not included
in our yatra price and it is the responsibility of
the trip participant to carry a valid travel and
medical insurance for Kailash Manasarovar tour.
It is advisable to get yourself insured for the
entire duration of the yatra in respect of
sickness, illness, accident, injury, death,
emergency evacuation, loss of personal
belongings, and cancellation / modification of
the trip, in part or in full. For insurance claim,
you must obtain bills against all payments made
at various points. The Company shall not be
liable for such bills and records. For insurance
claim, we shall provide bills and records only for
the payments made directly to us.
9. FLIGHTS & HELICOPTER SERVICE »
When our tour package price is inclusive of air
tickets, helicopter trips etc we will retain the
right to change the yatra price anytime before
the commencement of the trip if there is any
hike in ticket price introduced by the air
companies or even for reissuance of a new flight
ticket when the flight is cancelled by the airline.
We are not responsible for any cancellation,
delay or rescheduling of the flights. During
Kailash helicopter trip, Kailash trips via Ali and
Muktinath trips our price includes regular flight
tickets and chartered helicopter ticket charges
for Kathmandu – Nepalganj – Simikot - Hilsa
(both side), Lhasa – Ali Gunsa (both side) and
Pokhara –Jomsom – Pokhara (both side) sector
but any additional expenses incurred due to
rescheduling or cancellation of the flights /
helicopter service, the same shall be paid by the
travelers only, be it additional flight ticket
charges, additional accommodation or food
expenses or any other expense. It is to be noted
that such Kailash Manasarovar trips are totally
weather permitted and inclement weather
conditions usually causes delay in onward and/or
return trip and sometimes even force
cancellation of the trip (in full or part). Such
situations may cause discomfort to the travelers
including shortage of basic services such as
accommodation, proper food, medical facilities,
water supply etc. Such situations are very
common factor of Kailash Mansarovar trips and
one needs to be prepared for sudden and
unwanted situations in this trip and must carry
sufficient amount of money to overcome with
additional expenses due to the same.
Rescheduling of the flight : Sometimes, we offer
yatra packages including international flights to
Kathmandu or Lhasa or we book your flight
ticket/s separately for your travel, in addition to
the Kailash yatra package. All flight fares, their
operation, cancellations, rescheduling or
reissuance of the flight tickets, payments, refunds
etc are only as per the policy of the air company.
We are not the owner of the flights/ helicopters
thus neither we are liable for their operation,
cancellation, change in reschedule, behavior,
policies etc nor we take any guarantee for error
free service from them. Any additional expense
incurred on ticket date change, cancellation,
reissuance or loss of flight tickets due to delay in
the trip or due to any other situation or condition
occurred in your travel plan, the same shall be
paid by the travelers and not by the Company.
10. MODIFICATIONS IN TRIP »
It is to be noted carefully that all Kailash
Yatra groups are operating on ‘fixed departure
date’ basis therefore no modification or
amendment for individual is possible. For any
modification / amendment / additional service
required, you must notify the ‘Company” in
writing, well in advance. If possible, necessary
amendments shall be made by our staff and in
such case all additional expenses incurred on the
same will be payable by the traveler immediately
upon receiving confirmations.
11. TRIP PRICE, DEALS AND OFFERS »
The price for the Kailash Mansarovar Yatra are
inclusive of accommodation, veg meals,
transport, guide services, fuel charges, permit,
visa etc. and other items as specified with each
itinerary. We take utmost care for not increasing
the price for trip during the year. But in the cases
of sudden hike in fuel price, govt taxes / fee, visa
/ permit charges, currency exchange rate
fluctuation, air-fare increase, ground operator
service fee increase, Max Holidays India Pvt. Ltd.
retains the right to increase the price of the trip
or a part of the trip without any prior notice at
any time before or during the yatra. While
booking the trip with us you accept to be liable
to pay such additional amount, if the case occurs.
Special Schemes, Discounts & Offers: None of the
two (or more) schemes / offers / deals (including
early bird offer, last minute discount, festival offers
and other discounts etc) can be clubbed with each
other or any other discounted offers. All such
schemes and offers introduced by us are only our
‘business promotion offers’ and the terms of such
offers can be changed anytime thereafter without
assigning any notice. We also retain the right to
withdraw or modify the offers/scheme anytime
without assigning any written notice. It is totally at
our discretion to confirm or reject any booking
under such schemes. To bring more travellers we
keep floating attractive schemes and offers time to
time, which may be seen on our website or in our
promotional advertisements. While making the
trip enquiry with us, you clearly need to mention
the details of our special offer under which you
wish to book the trip. Services and bookings for all
schemes and offers are subject to availability only.
Trips once booked under one scheme/offer cannot
be shifted to any other scheme/offer introduced
by us at a later stage even if the new price is
lower. Such deals and offers are a part of our
marketing strategy and we retain the right to
decide upon the price of the yatra for any date or
season. No claim whatsoever will be entertained in
this regard. All bookings, cancellations and refunds
will be only as per the booking conditions signed
between the Company and you.
12. TRIP ITINERARY & HALTS »
Kailash Manasarovar yatra trips are based on
fixed departure dates and are bound with certain
permissions and policies imposed by the local
authorities. It is compulsory for the travelers to
strictly follow the scheduled route and halts and
remain with the group only. Max Holidays India
Pvt. Ltd., its employees, guides, escort, partners
etc will not be held responsible in any manner

objectives set out in the itinerary,
 Offer substitute or equivalent route or
alternative date for the yatra in place of

trip due to adverse or threatening conditions
such as climatic disturbance, political reasons,
military directions, terrorist acts, riots,
strikes, technical failure, flight
delay/cancellation, industrial dispute, non-
availability of accommodation or
transportation or any other service due to
heavy tourist rush or any other conditions
which may be acknowledged having no right
to claim any refund in the event of changes /
modifications / cancellation / postponement
or delay of the trip, whether in whole or in
part and also no right to claim any
compensation for any injury or loss or
damage to the person or its belongings or any
other additional expenses incurred due to
such reasons ,
 Company and its guides, escorts, tour leaders,
staff, its office/s, associates, partners etc
retains the absolute right to change / cancel /
stop the trip due to any governmental travel
warnings / advice or non- issuance of permits
of the yatra. Once the yatra has started but
stopped due to unforeseen / unavoidable
reasons, no-refund shall be applicable for the
unutilized services
 Company retains the right to cancel the trip
of any individual or group and off-load
him/her/them from the trip incase the
traveler/s does not comply with all the
formalities required by the Company, any
Nepalese or Chinese authority during the
Yatra or if the traveler/s does not follow the
law of the land of his/her/their visit,
 Any participant not complying with the travel
formalities or not obeying the law of the land
or carrying unlawful drugs, objectionable
material, political propaganda, firearms or
pamphlets, restricted items/articles will
immediately be excluded from the tour and
Company shall not be responsible if any
action from the concerned authorities is
taken against such traveler.
14. RISK ASSUMPTION & WAIVER OF
LIABILITY »
While booking the tour to Mt. Kailash and Lake
Manasarovar, you acknowledge having
understood completely and accepted to assume all
possible risks associated in this highly
unpredictable and challenging trip in far
Himalayan mountains. You confirm that Max
Holidays has made you aware of the same through
its websites / brochures / publications and during
the course of written or telephonic conversation.
You confirm that in the event of illness, accident,
inclement climatic conditions, political
disturbance, technical failures, flight rescheduling,
industrial disputes, riots, strikes and other reasons
beyond the control of the Company, you will not
held Max Holidays and its owners or directors,
agents, guides, offices, staff, associates etc. liable
for any loss or damage to an individual or his/her
belongings etc. In the consideration of Max
Holidays accepting your booking and including you
in its tour you confirm and release Max Holidays,

all liability, cost, injury, damage incurred or
suffered by you directly or indirectly before or
during the course of the trip and resulting to
personal injury, loss, illness, death or damage to a
person or its properties / belongings etc. You
accept to be aware and liable for any danger and
risks associated with this trip and you confirm not
to make any claim or demand any compensation
against Max Holidays India Pvt Ltd. its owners or
directors, agents, guides, offices, staff, associates
etc. You understand that the trip to Kailash
Mansarovar is a challenging adventure filled
uncertainties and with high risks, and you accept
that you are travelling on your own free will and at
your own risk.
You are aware that the Company do not
guarantee exactness and accuracy of the
information and services offered to you. For an
example the pictures of the hotel, road
conditions, distance, weather information,
vehicles conditions, flights, places etc may differ
from its current conditions. We do our utmost to
offer the best possible information and services
but we do not and cannot guarantee that the
same will match with your perception or
imagination.
15. MULE, PORTERS & AMBULANCE»
Services of mule, porters, ambulance etc are not
a part of our package. One can hire mule and
porter for parikrama at additional cost (approx
Chinese Yuan 3000 for a horse & porter) which is
payable directly by the yatri. Any sort of issues
related to hiring of porters / ponies / horse etc
during the yatra is not under our control or
responsibility and will not be entertained by us.
The tour guides traveling with you may assist you
to communicate with the owners or booking
officer of horse and porters etc but availability
and price of these services will not be in their
control. We neither take any responsibility of the
price of such service, behavior of the animal and
its owner, porter etc nor we guarantee the
availability of the same/ The yatri understand
that these services and its price are beyond our
control and the same are on their own decision
and risk.
16. ACCOMODATION & FOOD »
Kailash Mansarovar trips are operated in high
mountains in far remote lands of Tibet and the
trips include 3 star hotel in Kathmandu for
overland trip, 4 or 5 star hotel in Kathmandu for
helicopter trips and 3 star hotels in Lhasa. At
some places like Nepalgunj, Taklakot, Shigatse,
Darchen, Saga some hotels or guest houses offer
3 star equivalent services but flood of travelers
might create shortage in availability of those
specific hotels/guest house and we will offer next
best available hotel/guest house only. It is
suggested that you do not carry expectation for
any sort of high comfort or luxuries and adjust
with the best possible services made available by
our local partners/guides/escorts. At most places
except Kathmandu, Nepalgunj, Lhasa the stay
will be dormitory style and you will be sharing
room with your co-travelers. No choice for single
room / double room / family room / privacy can

be entertained. Also take a note that the toilets
and bathrooms are not upto the mark and clean
sometime, even in the reputed guest
houses/hotels and the travelers will have to
manage with this situation, if occurs.
Pure vegetarian buffet food is served on Kailash
trips. From 2017-18 on Kailash Manasarovar
route food is organized in the hotels/guest
houses by the local authorities only and they
follow their own timings and menu. It is the
responsibility of the traveler to reach the
restaurant during designated time for food. Be
aware that rush of the travelers may create
acute shortage of food and water supply even in
those restaurants.
17. UPGRADATION & ADD-ON SERVICES »
The list of inclusions is supplied with the trip
during the course of correspondence and all
additional charges for arrival before the start
date of the trip, additional night stay exceeding
the total no. of nights quoted in the trip itinerary,
up-gradation of the services and other additional
services and trips will be payable additionally by
the traveler. In the event of non-payment by the
traveler against the additional services booked
and/or consumed by you, the tour Company
and its authorized persons retain the right to
exclude you from the trip at any given time
and refuse to offer further services unless full
payments are received by Max Holidays for
those additional services.
18. UPGRADATION AND ADD-ON
SERVICES »
As per the policy of Tibetan government all
trips to Kailash Manasarovar operate in the
form of groups only for which various fixed
departure dates have been introduced by the
‘Company’ every year. For such trips dates,
routes and itinerary remains ‘pre-decided’
and ‘fixed’ hence no up-gradation in services
or change in route or date is possible for
individuals in such trips. In the event of a
private group there are limited modifications
and up-gradations possible which can be
made at an additional cost with advance
request. Individual trips to Kailash
Manasarovar region are not permitted by
Tibetan Government. For up-gradation of
services in Kathmandu and Lhasa and other
major cities we welcome your requirements.
All additional expenses incurred for such up-
gradation or amendments shall be charged
extra and are to be paid in advance by the
traveler only. For any additional service
rendered by the traveler out of the inclusions
of our tour package and sale invoice, it is the
liability of the traveler to pay for the same
before consuming the service.
19. EMERGENCY EXPENSES & PRICE
HIKE »
All additional expenses, including rescue and
emergency evacuation, incurred due to any
unforeseen circumstances such as weather
disturbance, political closure, technical

failure, health reasons, sudden change in trip
route, accommodation, date, type of trip etc
due to any reason or any hike in price of
permit / visa / services or tax introduced by
Indian / Nepalese / Chinese authorities shall
be payable by the traveler only. Max Holidays
will take no responsibility of expenses other
than the package inclusions.
20. LOSS, THEFT, DAMAGE OF GOODS »
It is the responsibility of the traveler to take care
of his/her belongings especially the valuable
items such as camera, clothing, luggage, mobile
phone and other material / items. We take no
responsibility for
loss, theft or damage of your belongings. In the
event of loss, theft or damage of the goods, the
traveler must inform immediately to the insurer.
21. RIGHT TO REJECT »
Max Holidays India Pvt. Ltd. retains the right to
reject any booking without assigning any
reason thereof at any point of time. Also during
the trip the company, its guides and escorts will
retain the right to reject any traveler from the
trip and exclude him/her from the tour
immediately if he/she is not following the law of
the land, creating unbearable and /or unethical
atmosphere, norms of the trip or not behaving in
a proper manner, interfering or creating
problems in the job of our guides and escort, not
complying with the manner with other
members on the trip including our guides or
escort or other staff etc. If excluded from the
trip, all expenses for further return journey from
the point of exclusion will be taken care by the
traveler himself/herself and no refund
whatsoever for unutilized services will be
applicable.
22. LIABILITY OF THE COMPANY »
We take utmost care and ensure to provide you
all the services offered in the package and
promised to you. In case of non-delivery of any
service arrangements (in part or full) due to the
fault of our employee / representative; we will
compensate the same subject to the limited
liability to the cost paid by you to us for that
particular service / item. However, we do not
accept any responsibility for fault of any third
party such as hotel staff, transporter, drivers,
guides, escorts, porters etc. We also do not take
any responsibility for any delay in the trip due to
delay from the transporters or inefficient service
from the hotels and their staff. We only act as an
intermediary to arrange your travel, we
therefore will not be responsible for your acts,
misdemeanor, omission and we will also not be
responsible for damage or lose of your personal
belongings and travel documents etc. before,
during or after the trip.
22. JURISDICTION »
All disputes arising out of this agreement are
subject to jurisdiction of Delhi, India.

` I, ________________________________________ (name of the traveler), holder of passport no. _________________________, wish to
confirm my participation in the challenging pilgrimage trekking tour to Kailash Manasarovar in China, organized by M/S Max Holidays
(India) Pvt. Ltd (herein after referred as ‘Company’) in collaboration with various other local service providers in Nepal, Tibet, China
etc. I hereby declare, that, I have carefully read and understood the policies of the Company regarding bookings, payments, cancellations,
refunds, claims, services etc. and I, with my free will, accept all mentioned terms and policies and request the Company to proceed with
my trip booking formalities. I further declare that I will not pursue any legal action against the Company, its owners, directors, employees,
staff, vendors, guides and/or partners etc. I also confirm:

I. That, I am aware about the risky and challenging nature of trip to Mount Kailash and Lake Manasarovar. I know that these trips are
organized in high mountains in far remote lands of Tibet Autonomous Region (TAR) under inclement weather conditions, inhospitable
tourism infrastructure, tough and frequently changing policies of local government, concerned authorities, embassy etc.

II. That, while planning to travel on a fixed departure group trip to Kailash Mansarovar, I know the unpredictable nature of services for
Kailash Mansarovar travel due to reasons, including but not limited to, adverse climatic conditions, strict and frequently changing rules
and policies of local authorities, lack of tourism infrastructure, delay or non-grant of permits/visa and availability of other services related
to the trip etc. I accept to adjust all my schedule, family priorities, business priorities, flight bookings to and fro the point of start and end
of the trip etc according to the group tour schedule, and at any given time, due to any change or delay in the trip schedule, if I wish cancel
my trip, I will respect the booking and cancellation policies set by the Company for my trip and will pay all compensations for trip
cancellation as per their business policy.

III. That, I release the ‘Company’, its offices, directors, employees, agents, partners, contractors, licensees, guides, escorts and all other
representatives and the trip organizing local authorities in the countries in which the trip is conducted, from all cost, liabilities, loss or
damage incurred or suffered by me directly or indirectly during booking process and/or during the course of my travel and resulting from
my personal injury, illness or death or damage to or loss of my property unless caused by the willful negligence or wrongful act of the
Company and its employees.

IV. That, I waive all claims I have, or may have at any time, against the Company, its owners, directors, employees and partners, by accepting
the additional inherent danger and risks that are involved in a trip to Mt. Kailash and Lake Manasarovar. I confirm not to make any claim
against or seek any compensation from the Company and/or its employers and/or its employees and/or its partners in respect of any
personal injury, illness or loss of life suffered by me or damage or loss of property sustained by me as a result of my participation in the
trip.

V. That, I understand that, due to certain rules and conditions imposed by the authorities and agencies, I will not be eligible for any refund
once the trip is launched. I know that, if I cancel my trip after completing the initial booking formalities, all payments and refunds will be
as per the policies mentioned in the Registration Application Form and/or also conveyed to me by the Company, during the course of
correspondence. I declare to abide by those policies set by the Company based on their past experience and nature of the trip.

VI. That, I accept my liability to pay the remaining amount to Max Holidays India Pvt. Ltd. as per the payment terms mentioned (or agreed in
writing during the course of correspondence) failing to which I know that my tour will be automatically cancelled and I will lose all
payments as per the cancellation policy.

VII. That, I also understand that, incase of cancellation of the trip due to unforeseen circumstances at my end, I will be liable for no refund from
Max Holidays India Pvt. Ltd.

VIII. That, if the trip is not going due to any unforeseen circumstances or non-grant of permit or visa by the concerned authorities, or even if the
trip gets postponed due to such reasons, I will be included in the next possible trip going to Kailash Manasarovar. In such cases if I wish to
withdraw my participation at any time, the cancellation and refunds will be strictly as per the cancellation policy only.

IX. To undertake this trip I have a passport with more than six months validity from the date of commencement of the trip. I am also aware
that as per the rules of Indian authorities, hand written passports are no more eligible for outbound visa.

X. I completely understand the unpredictable nature of the trips to Mt. Kailash and Lake Manasarovar which may force situation of sudden
alteration in the route, itinerary, dates, services, accommodation or cancellation / postponement of the trip (in part or whole) or delay in
onward or return travel, anytime before or during the yatra. I accept to participate in the trip under such conditions and release Max
Holidays India Pvt. Ltd., its directors, employees, staff, guides and partners etc from any liability of claim or compensation in such
conditions. I understand that if I wish to cancel my trip (in part or in whole) all refunds will be as per the cancellation policy only and if
there is any additional expense incurred due to my cancellation, the same will be payable by me immediately to Max Holidays

XI. I have also carefully read and fully understood Kailash Yatra information, booking conditions and service terms of Max Holidays, detailed
in this documents and/or posted on their website www.kailash-yatra.org / www.maxholidays.com.
