AFFIDAVIT OF ADVERSE CLAIM

We, SPOUSES ALEX AND ZENAIDA SEÑERPIDA, of legal

ages, Filipinos, and residents of Tolotolo, Consolacion, Cebu, after
having been sworn to in accordance with law, depose and say, that:

1. We are the owners and possessors of a ½ portion of that

parcel of land known as Lot _______ under Tax Declaration
No. _______, a copy of which is attached;

2. Our ownership is evidenced by that document executed by the

Heirs Raymundo Nique known as Extrajudicial Settlement of
the Estate of Raymundo Nique and Deed of Sale in favor of
Alex Señerpida Sr. and Zenaida Cabahug-Señerpida, entered
before Notary Public Chauncey T. Boholst in his notarial
register as Doc. No. 341, Page No. 70, Book No. I, Series of
2004. A copy of said document is attached as Annex “B”;

3. We recently discovered that TD No. _____ was cancelled by

that tax declaration No. 33805 and that lot no. _____ appears
to have been consolidated with Lot ________, without
including our names in the said tax declaration as owners;

“A parcel of land situated in Tolotolo Consolacion,

Cebu with an area of SIX THOUSAND EIGHT
HUNDRED THIRTY THREE (6,833) square meters
more or less”

4. That, we have paid the Estate Tax, Capital Gains Tax and
Documentary stamp tax for our purchase of our ½ portion of
this lot;
5. Unless an adverse claim is annotated on the afore-described
Tax Declaration, the buyer’s rights and interest of the above-
described parcels of land cannot be protected considering that
the registration cannot be transferred yet in their names;

6. I am executing this Affidavit in support of my request for the

annotation of an adverse claim over the parcels of land
described herein.
