Sirs/Mesdames:

Please take notice that the Court en banc issued a Resolution dated OCTOBER 18, 2011, which reads as
follows:

"G.R. No. 187167 (Prof. Merlin M. Magallona, et al. vs. Hon. Eduardo Ermita, in his capacity as Executive
Secretary, et al.).- Acting on the Motion for Reconsideration (of the Decision dated August 16, 2011) with
Motion to Set the Case for Oral Arguments dated September 5, 2011 filed by counsel for petitioners, the
Court Resolved to 

(a) DENY WITH FINALITY the said motion for reconsideration as the basic issues raised
therein have been passed upon by this Court and no substantial arguments were presented to
warrant the reversal of the questioned Decision; and 

(b) NOTE WITHOUT ACTION the said Motion to Set the Case for Oral Arguments in view of the
above action on the motion for reconsideration."
