Is a fallacy in which someone tries to
win support for an argument or idea
by exploiting his or her opponent's
feelings of pity or guilt. It is a specific
kind of appeal to emotion. The name
"Galileo argument” refers to the
scientist's suffering as a result of his
house arrest by the Inquisition.Misericordiam: “a pitying
heart"
May be viewed as a special case of appeal to emotion in which the
altruism and mercy of the audience are special emotions appealed to.
EXAMPLES:
An appeal to pity can be scen in many charitable advertisements.
Charities appeal to your pity of less fortunate people in order for you to
be more likely to donate to that particular charity.
"You must have graded my exam incorrectly. I studied very hard for
weeks specifically because I knew my career depended on getting a good
grade. If you give me a failing grade I'm ruined!"
"Ladies and gentlemen of the jury, look at this miserable man, in a
wheelchair, unable to use his legs. Could such a man really be guilty of
embezzlement?”When an appeal to sympathy or pity is highly exaggerated
or irrelevant to the issue at hand, ad misericordiam is
regarded as a logical fallacy. The first mention of ad
misericordiam as a fallacy was in an article in the Edinburgh
Review in 1824.

I really deserve an “A” on this paper, professor. Not only did I
study during my grandmother’s funeral, but I also passed up the
heart transplant surgery, even though that was the first
matching donor in 3 years.
Explanation: The student deserves an “A” for effort and
dedication but, unfortunately, papers are not graded that way.
The fact that we should pity her has nothing to do with the
quality of the paper written, and if we were to adjust the grade
because of the sob stories, we would have fallen victim to the
appeal to pity.Example 2:
Ginger: Your dog just ran into our house and ransacked our
kitchen!
Mary: He would never do that, look at how adorable he is with
those puppy eyes!
Explanation: Being pathetic does not absolve one from his or her
crimes, even when it is a puppy.
Exception: Like any argument, if it is agreed that logic and
reason should take a backseat to emotion, and there is no
objective truth claim being made, but rather an opinion of
something that should or should not be done, then it could
