CASE STUDY #3: Security of Tenure

The facts are as follows:


The petioners was Malicdem and Flores against Marulas Industrial Corporation and Mike
Mancilla which is the business is about manufacturing sacks for local and export markets. And
the compliant was for illegal dismissal, separation pay, money claims, moral and exemplary
damages, and attorney's fees
In 2006, Marulas hired Flores and Malicdem for the position of extruder operators which is they
were both responsible for bagging of yarns, the quality, package and the cleanliness of the work
place area which was also shown on their employment contracts which is valid for 1 year and
then fast forward they were claiming that they were illegally dismissed because Marulas told
them to just sign the papers which concludes that their employment status was just for a specific
period of time and it is already expired.

Issue of the Case:


Malicdem and Flores VS Marulas Idustrial Corporation and Mancilla due to the issue of Illegaly
dismissed.

Decision Making
They were already considered as regular employee because they have been in the company for a
year and the violation of the Marulas Industrial Corporation and Mike Mancilla is they not
clearly inform the two which is Malicdem and Flores that there’s a specific period of time only
then just suddenly He just wanted to sign the contract and with that it is clearly illegally
dismissed and also the role of Malicdem and Flores was clearly important for the production of
the manufacturing sacks and with that the Labor Code for Security of Tenure must be really
follow.
