The said notification vide 5.0. 2330{€) was published in the Gazette of India number 2065 dated 26.07.2017 on Part li, Section 3, Sub section (I). Preliminary cadastral survey was carried out by Deputy General Manager GAL (India) Limited as requires under section 3 sub section (2) of Petroleum & Minerals Pipelines (Requisition of Right of User in Lani Act, 1962 for implementation of Jagadishpur-Haldia & Bokaro-Dhamra Pipeline Project in respect of all the Records bf Right of Mouza- Nanduka, J:L.No. 63, Block-Raghunathpuril, PS. Raghunathput, District Punulia in the state of West Bengal and the office of competent authority was requested to acquired the Right of User in Land. GAIL (India) Limited carried out the revenue scrutiny of the above mentioned proposal and the “officists of competent authority made site inspections to verify the requirement of land and area calculation ‘etc. of Records of Right of concerned village and prepared the notification as required under section 3(3) of ‘the said Act, The notification draft under section 3(1} was forwarded to Secretary Petroleum & Natural Gas Save. of India, The seid notification was got published in the Gazette of india dated 26.07.2017 on part- Ii, clause 3, Sub-clause (il) by $.0. No. 2330(E) dated 12.07.2018, ‘The Deputy General Manager {F-£) of GAll (Ind'a) Limited submitted a proposal under section 3(2) for acquisition of right of user as per actual requirement. The official of Competent Authority through site inspection verified the same. Thereafter the draft notitication under section 6(1) was prepared which was sent to Secretary, Govt of india Ministry of Petroleuin & Natural Gas. Tne said notification was got published vide 5.0. No, 3260 (E) dated 02.07.2018 in the Gazette of ‘dia number 2506 dated 05.07.2018 on parti Section 3, Sub Section (i) Determination of Rates and Compensation {As the pipelines is to be laid by GAIL (India} Limited and the Right of User in the land has been vested in GAIL (India) Limited as per Sections 3(1), 6(1) and 6(4}, the land owner are to be paid the compensation @10% of (Factorized market value of land + 100% Solatium) as per Sec. 10(4) of P & MP Act. 1962 and Memo No. 45-1748(R)/LA/SC-03/16, date 10.08.2017 and DS- 1511{3)/LA/5C-03/16, date 31.05.2018 from the Department of L & LR & RRR, LA, Branch, Govt. of West Bengal in the light of Scheduled-1 of LA & RR Act. 2013. The Sale deed of all type of land in Mouza- Nanduka, J.L.No. 63, Block-Raghunathpur-Hl, PS. Raghunathpur, District Purulia were obtained from District Sub-Registrar office, Purulia for payment of land ‘compensation as per above mention act. Total calculated amount Rs. 1,01,61,430/- (One crore one lakh sixty one thousand four huridred ‘thirty only). In my view Sale deed supplied by District Sub-Registrar Purulia of Mouza- Nanduka, J.L.No.63, Block- Raghunathpur-il, Dist-Purulia are proper as the rates given by him are prevalent in the area as approved by Collector, Purulia. ‘Therefore | agree to award the compensation based on market rates as there given rates by District, Sub-Registrar Purulia. ‘The total land area in which Right of User has been acquired in Mouza- Nanduka, J.L.No.63 works out to be 12.6376 acre. The total compensation of this land area works out to be Rs. 1,01,61,430/-/- for compensation of awardees and Rs. 10,16,143/- for administrative cost. So total amount comes Rs. (3,01,61,430/- + 10,16,143/-}= Rs. 1,11,77,573/- (Rupees one crore eleven lakh seventy seven thousand five hundred seventy three) only. ‘The land compensation shall be payable to the owners of concerned mouza of the lands notified under section 6(2), the rates of which has been declared as per above. In case of more than one person is ‘owner of the land as per revenue record, the land compensation shall be paid as per their respective share in that land. ORDER | Diptarka Basu, Special Land Acquisition Officer & Competent Authority, Land Acquisition {under P & MP Act, 1962), Purulia in the state of West Bengal declare the final award for acquisition of Right of User in Land as per the details given in Estimate which Is Rs. 1,01,61,430/- (Rupees one crore one lakh sixty one thousand four hundred thirty) only excluding 10% on cost of ROU acquisition as administrative cost ic. Rs. 10161423). As per office memo no, 925/LA/IX-8/17-18 dated 24.08.2018 GAIL(India) has already submitted tentative estimate as advance amounting Rs. 68661044/- (Rupees six crore eighty six lakh sixty one thousand forty four) only for 17 Moueas, Considering the estimate of Mouza- Nanduka Rs. 8678279.70/- say Rs. 8678280/-. But actual Estimated amount for the instant mouza comes Rs. 10161430/- so differential compensation anrount to be paid Rs, (10161430/- ~8678280/-) = Rs, 1483150/- (Rupees fourteen lakh eighty three thousand one hundred fifty) only. GAIL (India) Limited is instructed to deposit the said amount in the Head of "The Collector, Purulia, West Bengal” within 24 days. Declared under my signature and seal on 18,08.2018.
