I, X. Sahaya Nirmal Rajan, son of Xavier Jeyaraj Freety, Christian,

aged about 34 years, residing at Flat G-2, Plot No.488, NU’s Reality,
Ram Nagar, III Main Road, Madipakkam, Chennai and temporarily
come down to Tirunelveli and do hereby solemnly affirm and
sincerely state as follows:-

1. I state that I am the Petitioner herein and the Respondent in

the above I.D.O.P. and as such I am well acquainted with the facts
and circumstances of the case.

2. I state that the Respondent/Petitioner has filed the above

I.D.O.P. against me for divorce u/s.10(i) (ix) of the Indian Divorce
Act in which I filed my counter cum Counter claim.

3. I state after filing the Counter Cum Counter Claim, I became

sick, hence neither I could appear before this Hon’ble Court nor
instruct my counsel who is from Tiruchirappalli District to
represent me before this Hon’ble Court on the hearing dates of the
 ..2..

above petition. Therefore, this Hon’ble Court was pleased to pass

an order of ex-parte against me. I state that as there is no
possibility of re-union between myself and my wife, I have also
sought for divorce, by denying the serious allegations and
averments.

4. I state that as the allegations made by the

Respondent/Petitioner are very serious in nature, I have to appear
before this Hon’ble Court by setting forth the true facts and
circumstances of the real controversy between myself and my wife
for the best interest of both myself and the Respondent/Petitioner.
Therefore, it is just and necessary that this Hon’ble Court is pleased
to set aside the exparte order dated………..passed in the I.D.O.P.No.
296 of 2018. Unless, the exparte order is set-aside I will be put to
untold hardship and mental agony.

In view of the above facts and circumstances, I, most

respectfully pray that this Hon’ble Court may be pleased to set-
aside the exparte order dated………………passed in I.D.O.P.No. 296
of 2018 on the file of this Hon’ble Court and thus render justice.

hearing date of I.D.O.P. from 16.09.2019 to any early date for
hearing. Unless, the hearing date is advanced, I will be put to
untold hardship and mental agony.

the hearing date of I.D.O.P.No. 296 of 2018 from 16.09.2019 to any
