HEARING FOR ROBERT CONTE:

 Ms. Stella, are the parole officer for Robert Conte?
 You had an office visit with him on October 31, didn’t you?
 And on this office visit, isn’t it true that you put him up against the wall immediately and 
started searching him?
 What was the purpose of this search?
 What did you find upon this search?
 Would you not agree that a conversation or interrogation of a parolee would not be as smooth
when they are up against the wall as if they were sitting in a chair?
 How long was Mr. Conte sitting at the Division of Parole before you took him into custody?
 Isn’t it true that you questioned him over the course of over five hours?
 Isn’t it also true that you would leave Mr. Conte for hours at a time and come back and ask 
him similar questions?
 Does it not strike you that a five hour interrogation would be stressful?
 Doesn’t it seem that being question up against a wall would be stressful?
 Isn’t it true that Mr. Conte’s answers when looked at in context were actually consistent and 
any difference in answers was a result of questions being asked over a long period of time 
and under stressful circumstances?
 Isn’t it true that you kept asking him if his mother had given him money?
 Isn’t it also true that Mr. Conte was consistent that his mother did not give him money since 
he had been home?
 Isn’t it true that the last question you asked him before you took Mr. Conte into custody was 
whether he had Ever been given money by his mother?
 And that last time, he answered in the affirmative, isn’t that true?
 Are you aware, that the only reason for his change in answer is that he was answering as to 
whether he had received money ever in his whole life, from when he was born to now?
 Are you also aware that when he answered “no” before that time, he was answering about 
receiving money since he has been on parole?
 During the interrogation, when you left Mr. Conte at the division, did you go over to his 
house?
 Was this visit not as a result of a discussion about a car that you characterized as a Green 
Jetta?
 At this point you accused Mr. Conte of driving over your instructions not to, isn’t that true?
 Isn’t it also true that Mr. Conte told you that the car you were accusing him of driving was 
under a tarp in his yard with two flat tires and undriveable? 
 And did you not tell your supervisor that this Jetta was not there when you went at other 
times?
 But when you went there, isn’t it true that when you went there, there was a Grey, not Green 
Jetta was in his front yard just as Mr. Conte Described it?
 When you were there you talked to Mr. Conte’s Mother, correct?
 Isn’t true that you are just trying to pin a violation on Mr. Conte?

 Isn’t true that Mr. Conte was consistent about the money in his pocket, that it was his?
 You are aware that Mr. Conte has money of his own aren’t you?
 You are aware that he came home from prison with almost $2000.00 from his commissary, 
aren’t you?

SUBMIT THAT RECEIPT

 What need would Mr. Conte have to lie about the source of $103.00 in his pocket if he has 
money?  
 He never did say that he had his own bank account did he?
 In addition to that money, you are aware that while he was incarcerated, Mr. Conte received 
a sizable settlement as a result of an accident, aren’t you?

SUBMIT THE LETTER AND THE COPY OF THE CHECK 

 And because he was incarcerated, you are aware that he was unable to deposit this settlement
check him self, were you aware of that?
 And were you aware that Mr. Conte gave his mother power of attorney to deposit this check 
into her account since could not do it for himself?

SUBMIT THE POWER OF ATTORNEY LETTER

 Are you aware that Mrs. Gerd Conte admits to be holding substantial amounts of money for 
her son in her bank account?

SUBMIT GERD CONTE AFFIDAVIT

 And are you further are aware that Mr. Conte’s money is intermingled with Mrs. Conte’s?
 And that about half of the money in her account is his?

SUBMIT BANK RECORDS FROM GERD CONTE’S ACCOUNT
 Given the fact that half the money was his, and although the account is still fully in his 
mother’s name, it does appear that Mrs. Conte’s account is basically a joint account, isn’t that
true?
 Further on this point, you allege that he claimed that he had a joint banking account in charge
#2, isn’t that correct?
 But nowhere do you allege that he claimed that the account is under both of their names, isn’t
that true?
 Isn’t it true that during your interrogation and this was an interrogation of Mr. Conte he 
stated that his money was in an account like a joint bank account and did not state firmly that
he had a joint bank account?
 In addition, are you aware that she asserts that she has given Mr. Conte no cash money since 
he has been home from prison?
 Are you further aware, that in this affidavit, Mrs. Conte says that while her son was 
incarcerated would pay bills of his from the money she was holding for him?
 So it would follow that, even though she wrote the check, she was not really giving him 
money is that not correct?
 Therefore, she would also routinely remove money from her account on Mr. Conte’s behalf, 
isn’t that true?
 This is a valid explanation that is consistent with what you allege in Charge #3, isn’t that 
true?

 Given the assets that Mr. Conte possesses, there is really no doubt at this point that the 
$103.00 was his, isn’t that true?
 Additionally, there is no doubt that there is sufficient explanation for each of these 
allegations, isn’t that true?
 What here makes you think that there is a violation of parole in an important respect?
 Why would Mr. Conte lie about money that YOU know to be his?
 It is because you are out to get him because he used the NYCLU and OASIS to overrule your
decision about his methadone recovery isn’t it?

A MUST:
 Are you familiar with a man by the name of Robert Krauss?
 He is Mr. Conte’s counselor at Long Beach Medical Center, Methedone Treatment, right?
 Did you have a conversation with him about Mr. Conte’s drug treatment?
 And you made a decision about Mr. Conte’s drug treatment after that conversation, didn’t 
you?
 And Mr. Conte fought you on it, didn’t he?
 He got the NYCLU and OASIS involved, didn’t he?
 And he got general counsel Terrence Tracy to mandate that you allow him to be treated in the
manner Drs. Say, not how you say, isn’t that true?
 It is not typical for decisions such as these to be taken out of your hands, is it?
 That annoyed you, isn’t that true?
 Are you aware that Mr. Krauss, thinks very highly of Mr. Conte, says that he is taking 
recovery very seriously?

 He says that Mr. Conte has been a model patient, did you know that?
 And he also, believes that these charges, based on his interactions with you and with Mr. 
Conte, are in retaliation for you being forced to let him continue his treatment, did you know 
that?

 Is that the reason for these charges based on nothing?

QUESTIONS FOR ROBERT CONTE
 Did you at any point say that you had your own bank account?
 The first allegation states that you say you had a bank account, so this allegation is false?
 Did you at any point state that you had a joint bank account with your mother?
 The second allegation states that you say you had a joint bank account, so this allegation is 
false?
 Did you at any point state that you received money from your mother since you had been 
home?
 The third allegation states that you say you regularly received money from your mother, so 
this allegation is false?
 Never mind regularly, did you ever receive cash money since you have been home from your
mother?
 Did you at any point state that you had received cash money from your mother ever in your 
life?
 When you did admit that, what did you mean by that statement?
 Tell me about the visit with Ms. Stella on October 31, 2006.
 You do think that Ms. Stella is trying to pin a violation on you to teach you a lesson, isn’t 
that correct?
 What happened previously that makes you think that Ms. Stella has it out for you?

QUESTIONS FOR MRS. CONTE
 Ms. Conte you signed this affidavit didn’t you?
 And you affirm all of its contents to be true?
 Then you agree that you are holding Mr. Conte’s money in your bank account?
 And about half of the money is his?
 And you never have given him cash folding money since he has been home from prison, 
right?
 But you have bought him food and clothes, correct?
 But never have you given him spending money since he has been home, correct?
 When Mr. Conte was a teenager, did you ever give him spending money?
 So you have given him money in the past at some point correct?
 On the date that Mr. Conte violated parole, did Ms. Stella come to talk to you at your house?
 What was the conversation about?

RE LEGAL AID SOCIETY:
 I am glad you asked about that.  I know you had mentioned your concerns with that and I 
wanted to bring up a number of points.  Mr. Conte does have a small nest egg from a 
settlement he received while incarcerated, but he presently lives in his mother’s basement, is 
not employed and has no form of income whatsoever.  Further, as will be at issue in the 
hearing, his mother still has power of attorney over that money and he does not have regular 
access to it.  Mr. Conte in his court matters over the years has never been denied legal aid.  
 After Ms. Stella brought her concerns to me about the money, I made a determination, based 
on where the money is situated, on the fact that Mr. Conte has no form of income, and the 
fact that he must rely on his mother for housing, that I could stay on the case. 
 Furthermore, I am ready to proceed today and it would be in the interest of the court for due 
process purposes to allow Mr. Conte proceed today with the assistance of counsel.  
 IF A SCHTICK IS MADE
 First it seems very vindictive for Ms. Stella to attempt to get Mr. Conte go without counsel 
though he has requested it.  It shows malice intent, which I am sorry to say has already 
stained this case.  
 As I understand it, the NYCLU has been involved, previously with Mr. Conte’s parole and I 
am aware that they are watching this proceeding rather closely.
