DEED OF SALE UNDER PACTO DE RETRO

KNOW ALL MEN BY THESE PRESENTS:

This DEED OF SALE WITH PACTO DE RETRO is made and executed by


and between:

JUVY A. DAAN, Filipino, of legal age, widow and a resident of San Antonio
St., Cambaro II, Mandaue City, Cebu, hereinafter called the VENDOR; and

JUNIL ALINDAJAO ALMODIEL, Filipino, of legal age, single and a


resident of Cambaro, Mandaue City, Cebu, hereinafter referred to as VENDEE.

WITNESSTH, That:

The VENDOR is the absolute owner of one-half (1/2) of a parcel of land, being
the widow of the late Tito R. Daan, who died intestate. The parcel of land is
situated in San Antonio St., Cambaro II, Mandaue City, Cebu, and more
particularly described as follows, to wit:

“A parcel of land (Lot 671-D-1 Psd-07-067774, being a portion of Lot -


671-D Psd-07-035479), situated in the Brgy. Of Cambaro (before Looc),
City of Mandaue, Island of Cebu. Bounded on the SW. along line 1-2
with perpetual RRW 1.00 m. wide); by Lot 671-E Psd-07-035479; on the
NW. along line 2-3 by Lot 669 GSS-592 (with RRW 1.00 m. wide); on
the NE. along line 3-4 by Lot 671-C Psd-07-035479; and on the SE.
along line 4-1 by Lot 671-D-2 of the subdivision plan. XXX XXX
containing an area of ONE HUNDRED FIFTY SIX (156) square
meters, more or less. XXX XXX.”

VENDOR’s conjugal ownership over the said parcel of land amounts to


SEVENTY EIGHT (78) square meters. The title over said parcel of land being
evidenced by Transfer Certificate of Title (TCT) No. 60628, issued by the Register of
Deeds of Mandaue City on April 16, 2007, as registered under the name of Tito R.
Daan, Filipino citizen, of legal age, married to Juvy A. Daan, residents of San
Antonio Street, Cambaro II, Mandaue City.

The one-half (1/2) parcel of land being sold by the VENDOR is understood to
be the portion which is adjacent to the land occupied by Restituto and Julieta
Alindajao, fronting the road right of way. As the other half of the parcel of land
which is adjacent to the land occupied by Benjie and Sherry Trinidad is still to be
co-owned by the VENDOR and her children.

The VENDOR, a retro, in executing this conveyance, hereby reserves the


right to repurchase the SEVENTY EIGHT (78) square meters of, and the VENDEE,
in accepting the same, hereby obligates himself to resell, the property herein
conveyed on or before August 1, 2014, from and after the date of this instrument, for
the same price of ___________________________________ PESOS (Php
____________________), Philippine currency; Provided, however, that if the
VENDOR shall fail to exercise her right to repurchase as herein granted within the
period stipulated, then this conveyance shall become absolute and irrevocable,

without necessity of drawing up an new deed of absolute sale, subject to the
requirements of the law regarding consolidation of ownership of real property.

Any improvements to the property shall be valuated by the VENDEE in order


that the amount spent for the improvements will be reimbursed by the VENDOR as
part of the full repurchase of the parcel of land.

IN WITNESS WHEREOF, the parties hereto have hereunto set their hands

I, JUVY A. DAAN, Filipino, of legal age, widow, and a resident of San


Antonio St., Cambaro II, Mandaue City, Cebu, hereby acknowledge the receipt of
