Type Of Work: Case Study

The case M/s Networkers Eduhome Pvt. Ltd V. Ms Jeena & Co. was

assigned to me to get me started on the basics of Customs Law and to

realize that who is CHA , Exporter, Importer and what are

misdeclaration of goods, Undervalued goods, Prohibited Goods etc

and the duties of each party in either Importing or Exporting of


goods. I went through the case and realized that generally the

problems faced in Customs cases are Undervaluation, Misdeclaration,

Negligence and Prohibited Goods.

Type Of Work: Case Study

Today I was assigned to analyze another case related to Section 113(i),

117 & 118(b). The assigned case was Century Arms Corp.(Rahul

Chauhan) V. Commissioner of customs. In this case the exported

shipment said to contain stone pieces which were valued around

80USD but on further examination, the goods in question were

Antiquity (Prohibited Goods) which is illegal for exportation. Due to

absence of antiquity exporting license, the goods were confiscated and

a heavy penalty was Levied on exporter. This case covered

undervaluation, Examination by Appeal Committee & Antiquity and

Arts treasure Act 1972.

Type Of Work: Research on Cases Mentioned under Jet airways

Appeal.

Under Jet airways Appeal there were several references to different

cases along with their statements. Mam assigned me to provide her


with Judgment on all the mentioned cases in that Appeal along with

the Page and Paragraphs where such case was mentioned. I spent the

whole day researching on each and every case law mentioned in the

Appeal and was able to collect almost every case laws under the

appeal by using Manupatra, SCC Online, Indiankanoon etc and

mailed all such Documents and Judgments to Sanjana Mam, which

she than analyzed and praised my work.

Type Of Work: Brief Summary Of the Judgment

I was assigned to submit a summary on Suo Moto case of 2010 along

with its Judgment. So I logged in on Manupatra was able to collect the

initial judgment of 89 Pages, which I further spent the day in reading

and analyzing its key points and facts and was able to summarize it in

12 Pages along with conclusion and mailed it to Sanjana Mam. This

case was focusing on Abuse of Dominant Position by Sugar Mills in

Maharashtra & Karnataka to regulate the price of sugar from Rs 3 Per

Kg to Rs 30 Per Kg.

Type Of Work: Brief Summary Of the Judgment.

Today I was asked to provide summary of 2 cases which I submitted

yesterday for references. The case was Builder Association of India V.

Cement Manufacturers (Circumstantial Evidence) And M.P Mehrotra

V. Kingfisher Airline (Price Parallelism). I was able to summarize

them along with the relevant issues in the Judgment of the cases

which were mentioned at the end of each summary for quick and easy

reference .This assignment helped me understand the working of

manupatra.com , crucia.com, SCC online & indiankanoon.com to

research on assigned cases.

Type Of Work: Observations of 17 Cases

Today I was asked to summarize 17 case laws and their judgements in

excel spreadsheet for future reference for the office. So far I have

Categorized 7 case laws in excel on the basis of Nature of shipment,

sections violated, Goods in issue, Citations, subject and Observations

in each case.. The judgement were derived from manupatra website as

there judgements had citations and case note of that case.

Type Of Work: Continued Work on 17 Cases

Today I finished yesterday’s pending work which was assigned to me

by Shreya mam which was to summarize the mailed cases. On

completion of those cases I mailed the excel document to Shreya mam,

Sanjana Mam and Jasvir Sir. Before heading back home Jasvir sir told

me that he has some work for me tomorrow, so I made a note of it and

headed back home as there was no other assigned work pending on

my end.

Type Of Work: Proofreading Of a Case

Today Jasvir Sir handed me the case file of Prohibited goods

exportation by Ajay Mattal. I wasn’t told to study or research on that

case but was asked to proofread the whole document while Jasvir sir

was on his Pc listening to my narration and confirming it with the soft

copy of that document. I had to be very careful with each and every

words, symbols and numeric figures. Every narrated word must be

clear and precisely accurate to avoid even minor errors. On

completion I went back to my desk to get back on the pending work.

Type Of Work: Research Work

Today mam assigned me to research on case laws based on Article

19(1)(g) which is the right to practice any profession, or to carry on

any occupation, trade or business and 19(6) which is the right of court

to apply any reasonable restrictions on any business, of the

Constitution of India. I did an elaborate research and was able to

collect 3 case laws on these Articles.

Type Of Work: Research Work

Today Sanjana was working on SpiceJet Appeal case and asked me to

do some research work and to come up with case laws where the

commission was using their orders to create restrictions on business to

regulate tariff rates for there benefit. The commission being a

government body doesn’t work under any Private company but

answers only to the government and doesn’t regulate prices for their

benefit but can impose reasonable restrictions on businesses to avoid

any appreciable adverse effect on the market.

Type Of Work: Drafting List of Dates

Today I was assigned to draft ‘List of Dates’ for the case Sabyasachi

Mukhophadhay V. Utpal Mishra. The list of dates contains all the

relevant dates of the case such as the date of order, date of

appearance, dates of affidavits, dates of response, date of incident etc.

and every date consisted a part of fact relevant with that date. Mam

even provided me with some samples of list of dates for references,

she also asked me mail her my work after two or three dates so that

she can monitor my progress and check errors and mistakes.

Type Of Work: Drafting Memo Of Appeal

Today Shreya mam mailed me the scanned copy of memo of appeal

given by Dr. Sabyasachi Mukopadhay. She mailed me those copies

because she wanted it in written format so she asked me to copy the

complete document exactly in MS Word and mail it back to her. Mam

asked me to be very careful with each and every words, symbols and

numeric figures. After few hours I was able to complete half of the

assigned work and then I asked mam if I could submit the remaining

part by tomorrow which she agreed and then I left.

Type Of Work: Drafting Memo Of Appeal

Today I was able to complete the pending work of yesterday which

was to create a soft copy of the appeal in Dr. Sabyasachi

Mukopadhyay case and mailed it back to Shreya mam to check for

errors. This case was focused on acquisition of Medical Negligence by

Dr. Sabyasachi Mukopadhyay in implanting a pace-maker in Mr.

Utpal Mishra which caused the pace-maker pocket infection because

of which the patient was forced to get a new pace-maker from another

Hospital and prayed for Compensation from K.M Memorial hospital

in Purulia.

Type Of Work: Research Work

Today Sanjana mam asked me to do some research work on cases

related to Medical Negligence where such negligent action was taken

in support of some Medical Literature. I searched manupatra and was

able collect four cases where the doctors were depending upon

medical literature and committed a negligent act. One of the cases

were Bijoy Singh V. Sukumar Mukherjee, where the doctor

administered a non-permissible dose of ‘Depomednol’ in a patient’s


body which lead to increase in body temperature, High blood

pressure which caused dizziness and lack of balance. This act of his

was negligent because he ignored patient’s previous prescription and

medical history before administering depomedrol.

Type Of Work: Research Work

Today Sanjana mam assigned me to research on cases where Report of

an expert doctor played a major role in conclusion of a case even as

the opinion of an expert doctor is not considered an evidence. I found

a case, Smt. Shobha V. Govt of NCT Delhi in which the doctor claimed

that there was no negligence on his part while injecting paracetamol

in the patient whereas the expert doctors gave there report supporting

the fact of negligence as the dosage of paracetamol injected by the

doctor will be fatal for any healthy human. The court considered

experts’s report while passing the judgement.

Type Of Work: Research Work On Consumer Cases.

Today I continued my work on researching consumer case laws

where the CHA was a party filing an appeal for wrongful revocation
of his license. So I found around 5 cases on this matter, one of them

was UPS Jet Air V. Commissioner of customs. In this case the package

exported by UPS was consisting prohibited goods which lead to

revocation of CHA’s license and a heavy penalty was to be levied

against the CHA. An appeal was filed by CHA as he was simply

following exporter’s Order-In-Original to export his shipment. In the

end his appeal went in his favor and the penalty was removed and his

license was restored.

Type Of Work: Research Work On Consumer Cases.

Today Shreya mam asked me to submit a few case laws in which the

CHA (Custom House Agent) performed negligence in performing

KYC of the exporter or importer which lead to heavy penalty on the

CHA. So I found a case on Manupatra which was Barasakar Brother

V. Commissioner of Customs. In this case the CHA failed to perform

proper KYC of the Exporter before exporting his shipment which

consisted undervalued goods which caused CHA’s his license and a

heavy penalty was levied under Customs act,1926.

Type Of Work: Submitted List of Dates

Today I completed the pending work in List of Dates assigned to me

by Shreya mam on 11th June. I mailed her the complete list of dates,

which was then later corrected by Shreya mam for any remaining

errors. After that submission no work was assigned to me later that

day so I went back to my desk and browsed lawoctopus for any

upcoming research paper and was able to find some good ones.

Type Of Work: Correction In List of Dates

Today Shreya mam mailed me the List of dates I submitted to her

yesterday with all the corrections and the points I forgot to mention

along with my Initial work document to see how an approved list of

dates looks like. There were minor errors in my work and as this was

my first work on drafting list of dates, mam asked me to pay attention

to details and asked me to improve further. I spent the rest of the day

in checking where mam has edited and corrected my mistakes and the

facts which I missed out while drafting.

21 22.06.2018 Work Assigned By: Shreya Mam

Type Of Work: Research On Extra Consumer Cases.


The research work I submitted to Shreya mam on 5th June was missing

an extra 7 cases which were attached inside one of the documents. So,

mam asked me to study those case and write my observations for all

of them and submit it to her as soon as possible. So, I spent the

remaining working hours of the day in reading those cases while

making notes along with in my register and writing my observation

for the remaining pending cases.

22 25.06.2018 As this was the last day of my Internship at Walia & Co. the

department asked me to sit with them and discuss the whole

experience. We all use to have our lunch together while sharing

memories and home cooked food with each other which created a

sense of trust and friendship between us which made this Internship

one of the best experience of my academic journey. Spending my

Vacations in collecting this corporate experience was a complete bliss.

I thanked everyone in the office for there support and there assistance

in making this internship a fun experience. Later that day I collected

my Internship Completion certificate from Mr. Ranjit Sir and got my

diary signed and thanked him for this amazing opportunity and I

went back home
