MEMORANDUM OF AGREEMENT

KNOWN TO ALL BY THIS PRESENTS


Cagayan Valley Computer and Information Technology College, Inc., an educational
institution located at #28 Carreon Street, Centro East, Santiago City, represented by
___________________, ___________________, herein referred to as the First Party
and
________________________ located at ________________________ represented by
________________________________________________,
________________________ herein referred to as the Second Party.

Whereas, the First Party has institutionalized an On-the-Job Training for its graduating
students to extend ________________________ free services to its partner
establishment/Second Party.

Whereas, the Second Party agrees to reciprocate the free man hours rendered services
by the Trainee with corresponding job experience.

Wherefore, the First Party and the Second Party agrees willfully to the following TERMS
and CONDITIONS:

1. THAT the training period shall start this ________________________ limited to a


maximum of extend ________________________ starting
________________________, to which the training schedule shall be as follows:

Monday - 8:00 am – 12:00nn / 1:00 – 5:00


Tuesday - 8:00 am – 12:00nn / 1:00 – 5:00
Wednesday - 8:00 am – 12:00nn / 1:00 – 5:00
Thursday - 8:00 am – 12:00nn / 1:00 – 5:00
Friday - 8:00 am – 12:00nn / 1:00 – 5:00

2. THAT the time agreed by the parties concerned shall serve as the bases for
duration of training. In addition to the regular schedule, holidays or weekends can
be used in lieu of time increment for completion provided that a parent’s waiver
shall be given by the trainee. Night shift, however, shall be discouraged.

3. THAT the Second Party shall take all necessary precautionary measures to
safeguard the welfare of the trainee while undergoing the OJT Program within its
premises.

4. THAT while not considered as an employee, the On-the-Job Trainee shall, in a


manner normally rendered by regular employees, render work and other tasks or
responsibilities agreed upon by the head or representative of the Second Party
and the representative of the First Party as stipulated in the program of work jointly
prepared for the purpose.
5. THAT the trainee will not be treated as a regular employee; hence, he/she is not
entitled to any salary, wages, allowances or any form of remuneration.
Notwithstanding, this shall not prohibit the Second Party from providing the trainee
monetary benefits on a strictly voluntary basis.

6. THAT while on this OJT Program, the trainee understands that he/she is covered
by both rules, regulation, policies and standard operating procedures of the
Second Party

7. THAT any task beyond trainee’s assignment that leads to breakage, risk and safety
shall not be designated for this matter he/she will not be liable to any damage;

8. THAT the OJT Coordinator, his representative or authorized officials of the First
Party shall be allowed to visit from time to time the trainee at the Second Party for
purposes of coordinating and evaluating the development of the program.

9. THAT the Second Party shall require and monitor the daily attendance of the
trainee.

10. THAT the Second Party shall impart theoretical as well as practical learning to the
trainee; actually expose him/her to all facets of work relevant to the course of the
trainee; and participate in the final evaluation of the trainee’s performance.

11. THAT by the end of the program, the Second Party shall assist the trainee in writing
his/her comprehensive data and technical information as necessary.

12. THAT the Second Party shall issue a Certificate of Completion with the evaluation
rating of the trainee attached to this MOA.

13. THAT this agreement may be terminated at anytime by either two parties if in its
judgment, the welfare of the party is prejudiced. Three (days) prior notice will be
required for such discontinuance.
