MEMORANDUM OF UNDERSTANDING (MoU)

This MoU is made on this day 16th of November, 2017

BETWEEN

The Collector and District Magistrate, Jharsuguda District, Odisha, hereinafter called
Collector, which expression shall, unless repugnant to the context or meaning thereof,
include his/her successors, Nodal Officer(e-District), of the first part

AND

SANTOSH SAHANI, a Village Level Entrepreneur (VLE) having a Common Service Centre at
Ranibandh, G.P.-Gourmal, Jharsuguda District, Odisha, set up under CSC 2.0 scheme through
District e-Governance Society (DeGS)/CSC e-Governance Services India Limited (CSC SPV)
and duly registered under DeGS , hereinafter called as CSC Operator, which expression shall,
unless repugnant to the context of meaning thereof, include its successors, executors,
administrators, representatives and permitted assignees, the second part

WHERE AS
The Government of Odisha (GoO) is desirous of providing e-Governance Services listed at
Annexure-II, through Common Service Centre (CSC) Channels under ‘e-District’ project
being implemented by the Department of Information Technology, GoO through the Odisha
Computer Application Centre, [a society registered under the Societies Registration Act,
1860] (OCAC), the State Designated Agency (SDA) for implementation of ‘e-District’ project;

AND WHEREAS
The CSC Operator has accepted the proposal for implementing of such scheme for provision
of services to citizen through CSC.

Now, therefore, this MOU is executed binding two parties to the following terms and
conditions, namely:-

1. This MoU is for implementation of the e-District Project through CSC in the
jurisdiction of the Jharsuguda District.
2. The terms & conditions specified in this MoU shall be applicable for delivery of all
the services coming under the purview of Project “e-District”.
3. This MoU is executed in duplicate and all the parties shall be entitled to keep one
original copy.
4 (a). The Services are to be provided by CSC Operator through an Application software
developed and implemented by the SDA through System Integrator/Application
Developer/ Other Agency selected by SDA under ‘e-District’ Project.
4 (b). Guidelines for the CSC Operators is as per Annexure-III.
5. Responsibilities of District Administration shall be as follows:
5.1. To provide service within the prescribed time (to be informed by OCAC).
5.2. To receive the Application along with the attachments and provide a receipt of
the same to the CSC Operator as per Format prescribed at Annexure-IV.
5.3. To receive the fund deposited by the CSC Operator and issue a receipt of the
same as per Annexure V and VI (Format I to VI).
5.4. To inform the Issue of Certificate to the concerned CSC Operator.
5.5. To start processing of the application immediately after receipt of the same
from the CSC Operator online, pending receipt of the hard copies in the
following week as defined at clause V of Annexure-III.
5.6. To answer the queries of the CSC Operator regarding the status of Application
under Process/ on-hold / rejected in case of delay.

5.7. To inform the SDA/ E&IT Department in case of malfunctioning of any CSC in
their jurisdiction.
5.8. To convene ‘e-District Implementation Committee’ and ‘e-District Co-
ordination Committee’ meetings on a fortnightly basis.
6. The Nodal Officer (e-District) nominated by the Collector will be involved for day to
day operation.
7. In case of default, penalties will be levied on the CSC as per Penalty clause of this
MoU.
8. The Collector shall be overall in-charge of Service Delivery at district level.
9. The Collector shall review the Managerial Information System (MIS) reports and
functioning of the project for taking corrective steps to meet the objectives of the
project.
10. The Nodal Officer (e-District) and the monitoring cell consisting of (Tahasildar,
Nodal Officer, Official from concerned line Govt. Department office, DeGS Co-
ordinator, District Manager, CSC) will carry out sample check on weekly / fortnightly
basis to ensure that the CSC Operators are collecting the exact amount required for
providing all the services to the citizen. Nodal Officer shall submit report to District
Collector and OCAC in a fortnightly basis.
11. In case of delay in submitting application on-line to Tahasil Office within 24 hours,
the CSC Operator has to explain the cause of delay to the Tahasildar. In case of
unavoidable problems, beyond the scope of the CSC Operator, the Tahasildar shall
have the authority to take the decision on whether penalty has to be imposed or not.
The fine will be `25/- (Rupees Twenty-five) per application.
12. In case of delay in submitting Hard Copy as defined at clause V of Annexure-III a fine
upto `50/- ( Rupees Fifty) per week and part thereof will be imposed as decided by
the Collector.
13. In case there is any delay in deposit of collected Fees at Tahasil Office beyond the
Wednesday of the following week. A fine upto `50/- ( Rupees Fifty) per day will be
imposed as decided by the Collector. The CSC Operator has to collect a duly signed
receipt of Charges collected by them as per the Format mentioned at Annexure-V.
14. In case of delay in providing Certificates to the citizen within 2 days of receipt of the
same from Tahasil / Respective Office a fine upto `25/- (Rupees Twenty-five) per
day will be imposed as decided by the Collector. It may be raised to `100 (Rupees
One Hundred) per certificate per day, as may be decided by District Collector.

15.1. The CSC Operator shall be responsible for checking proper attachments on a
window provided by the system and send proper attachments along with online
application and the original documents submitted by the applicant along with
the hardcopy of the application, failing which a fine from `50/- ( Rupees Fifty)
upto `500/- ( Rupees Five Hundred) per application can be charged on the CSC
Operator by the Collector.
15.2. In case of submission of any wrong attachment/document, it is the duty of
the CSC Operator to intimate the same to the concerned Tahasildar / In-charge
official of respective line Govt Department, Office/Nodal Officer (e-District)
immediately after the fault is detected by the CSC Operator on the same day.

16. The CSC Operator has to charge the exact amount required for providing the service
requested by the citizen, violation of which shall be considered as corrupt practices
for which penal action can be initiated against the CSC Operator.
17. The CSC operator shall not use the same User ID/password for opening of multiple
centres and share the user ID/password issued for service delivery under eDistrict
project. Action deemed suitable shall be initiated by the District Administration, if
any CSC operator is found to violate this clause, which may lead to contract
termination without any notice.
18. The CSC counter shall remain operational at least for 9 hours for working days and 4
hours for other holidays except National Holidays.
19. This MoU shall be in force for a period of one year from the date of its execution
which may be further extended on yearly basis, on the basis of satisfactory
performance, with consent of both the parties.
20. A review meeting should be organized by the Collector once in a month, to resolve
issues if any. In case of exigencies the review meeting can be convened immediately
by the Collector or the Nodal Officer (e-District).
21. In the event of any dispute / disagreement on any issue or any article of the MoU, it
would be resolved by the Principal Secretary to Government in Electronics &
Information Technology Department, Government of Odisha, whose decision shall
be final and binding on the parties.
22. In case operator fails to provide services, their services can be terminated, in
consultation with the Department of Electronics and Information Technology,
Government of Odisha and SDA.
