PERMIT CONDITIONS e In this Permit, "Regional Director" means the Regional Director Gauteng of the Department, who may be contacted at the address below: . 441 1.2 1.3 21 Regional Director: Gauteng Department of Water Affairs and Forestry Private Bag X8007 HENNOPSMEER 0046 LOCATION This Permit authorises the establishment, development and operation of Fine Ash Dam number § (FADS) and the continued operation and upgrade of the Existing Waste Disposal Site on Portion 11-14 of the farm Middelbult 284 IS, Portion 9,10 and 20 of the farm Rietvley 320 IS, the Remainder of the farm Rietviey 320 is end Remainder of Portion 2 of the farm Rietviey 320 IS, District of Highveld Ridge, {hereinafter referred to as "the Site") according to the following reports numbered— (a) Report no 278984/2 by SRK Consulting, dated July 2000 (Permit Application for the Operation of the Waste Ash Disposal Site at the Sasol Industrial Complex in Secunda, Mpumalanga); Co) Report no 269195 by SRK Consulting dated May 2000 (Specialist Management Study for the Black Products Area, Sasol Secunda); and ©) Report no JW74/00/7338 by Jones & Wagener Consulting’ Civil Engineers dated July 2000 (Permit Application for the Fine Ash Dam 5 at Sasol Secunda), (unless specifically stated otherwise, hereinafter referred to as “the Reports"), submitted by the Permit Holder. The Existing Waste Disposal Site refers to the Black Products Area, Coarse Ash Area, Fine Ash Dam numbers 1 to 4 and Fine Coal Dams as indicated on Figure 1 of Report number 278984. ‘The boundaries of the Site must be as indicated by the co-ordinates numbered A to K in the permit application form and by the co-ordinates numbered A to K in Section 11 and the enclosed figure in the permit application form in the Report number 278984/2. PERMISSIBLE WASTE Fine Ash Dam 5 which shall be constructed and developed according to condition 4 may be used for the disposal of 760 000 tons of fine ash per month from tn date of this Permit to 2009, and for the disposal of 330 000 tons of fine ash month after 2008 22 23 25 26 3.4.2 3.1.3 Subject to the provision af conditions 3 and 15, the Existing Waste Disposal Site may be used for the interim disposal of the waste types listed in Annexure | Deposition of waste on the Black Products Area must be phased out and the Black Products Area must be closed for the acceptance of all waste by the end of 2004 on the eastern row of dams and by the end of 2008 on the western row of dams. The Permit Holder must take all reasonable steps to ensure that — () no organit’ or inorganic element or compound which may have a definite acute or chronic negative effect on human health and/or the environment, due to its toxic, physical, chemical or persistent characteristics and which corresponds with the UNEP definition of : hazardous waste; ) no medical waste; and © no scheduled pharmaceutical products registered in terms of the Medicines and Related Substances Control Act, 1965 (Act 101 of 1968) or associated containers, : are disposed of on the Fine Ash Dam numbers 1 to § and the Coarse Ash Area. Waste types listed in Annexure Il may not be disposed of on Fine Ash Dam 5. The Permit Holder must take all reasonable steps to prevent the disposal of waste on the Site for which the Site has not been approved. INVESTIGATIONS TOWARDS UPGRADE OF THE EXISTING WASTE DISPOSAL SITE AND WASTE MANAGEMENT UPGRADE OF THE EXISTING WASTE DISPOSAL SITE A Status Quo Report regarding the current impact of the Site on the environment (surface water, groundwater, and air quality) must be submitted to the Regional Director for approval by 30 June 2001. This report must include an investigation into the stability of the Existing Waste Disposal Site should any future development take place. Objectives for the upgrade of the Existing Waste Disposal Site must be submitted to the Regional Director for approval as part of the Report referred to in condition 344. Options for the upgrade of the Existing Waste Disposal Site with an indication (and motivation) of the preferred option must be submitted to the Reg Director within 6 (six) months of the approval of the Stztus Quo Report rete! in conditions 3.1.1 and 8.1.2. CONSTRUCTION GENERAL CONSTRUCTION REQUIR:. {ENTS The construction of Fine Ash D> 5 must be in accordance with the approved detail design plans numbered JV’ 7338-01 to JW 7338-03, and JW 7338-25 to JW 7338-27 dated July 2000, -3 contained in section 14 of Report number JW74/00/7338. If the Regional Director is satisfied with the construction of that portion of the Site, and has given written confirmation that the construction is acceptable, the Permit Holder may use that portion of the Site for the disposal of waste. ‘SPECIFIC CONSTRUCTION MEASURES Construction of Stormwater Control Measures Stormwater diversion! control measures constructed in compliance with condition 6.1 must be of such a capacity as to accommodate all stormwater runoff which could be expected as a result of the estimated maximum precipitation during a period of 24 hours with an average frequency of once in fifty years (hereinafter referred to as the “estimated maximum precipitation’) : Construction of Seepage and Decant Control Measures Surface and/or deep subsoil seepage interception and/or blanket-drains must be conétiucted according to the Reports to effectively intercept and drain all surface and sub-surface seepage generated on the Site. tormwater containment works (toe paddocks) must be constructed according to the Reports and must be of such a capacity as to maintain a freeboerd of half a metre and to accommodate all contaminated stormwater runoff which could be expected as a result of the estimated maximum precipitation. Engineering of Stability The entire Site must be constructed in accordance with recognised civil engineering practice, with special consideration to stability. The slope of the sides of the entire Site must be constructed and maintained in ‘such @ manner that the occurrence of erosion is prevented The Permit Holder must facilitate stormwater control and the slope of the sides of the Site must be constructed and maintained according to the Reports. GENERAL IMPACT MANAGEMENT AND OPERATION OF THE SITE DISPOSAL OF WASTE The Permit Holder must ensure that the disposal of permissible waste to the Site as approved under condition 2.1 and 2.2 and the operation of the Site is done in accordance with — (2) the Minimum Requirements; (b) the Reports; () the approved Operational Report submitted in terms of this Permit; (d) the conditions of this Permit; () any written Operational Procedures or amendments of the Operational Report submitted by the Permit Holder and approved by the Regional Director; and 0) any other written direction issued by the Regional Director to the Permit Holder. The Permit Holdet must keep a record of the following details for all waste Icads disposed of on Site according to condition 12, and must report the details regarding the waste disposed of on the Site according to condition 14.3.4 within 6 months of the date of this Permit. (a) source of the waste; (b) volume of the waste in cubic metres; () physical properties of the waste (e.g. flammable,-% liquid, etc.); (d) chemical composition of the waste; © concentration of all chemicals in the waste with a Hazard Rating of 1, 2,3 and 4; ) primary classification of the waste according to SABS Code 0228; and @) secondary classification of the waste according to the Minimum Requirements, The maximum height of Fine Ash Darn § must not exceed 40 metres above ground level. gr 544 52 5.24 5.2.2 5.2.3 5.2.4 5.2.5 5.2.68 53 5.3.4 5.3.2 Subject to the outcome of the investigations conducted in terms of condition 3, the maximum height of the Site must not exceed 120 m above ground level BUFFERZONE The Permit Holder must take all reasonable steps such as suitable zoning, written agreements with adjacent landowners, buying out land and/or obtaining a servitude to prevent the development of further residential and/or light industrial areas closer to the Site than — (a) 350 metres td the west, which is the distance to existing residential areas at the date of this Permit; and (b) 800 metres to the east, south and north, during thie operative life of the Site. The Permit Holder must submit written proof to the Regional Director of the steps taken: acvurding to condition 5.2.1, within one year from the date of this Permit. Heavy industries or industries which may create -nuisance conditions may be permitted within the bufferzone in terms of the appropriate legislation. The Permit Holder must conduct or appoint specialist to conduct an investigation on the dispersion of dust and other air quality variables through the Site in order to. determine if the bufferzone of 350m and 800m are sufficient to prevent detrimental effects or nuisance conditions. The investigation referred to in condition 5.2.4 must make recommendations regarding measures to be taken to address these detrimental effects or nuisance conditions, including the extent of the bufferzone, and such measures must be implemented in accordance with condition 5.2.6. The Permit Holder must implement the recommendations of the air dispersion modelling regarding the bufferzone in accordance with condition §.2.5 to the satisfaction of the Regional Director. GENERAL OPERATIONAL MEASURES ‘The Permit Holder must on a continuous basis, maintain all works constructed on the Site, or any portion thereof, in accordance with the Minimum Requirements, the Reports, the conditions of this Permit and any other written instruction issued by the Regional Director to the Permit Holder for a period of 48 years or for any longer period as may be determined by the Regional Director. The Permit Holder must operate Fine Ash Dam 5 in such a manner that the height of the emban‘cnent or perimeter wall is at all times maintained at a higher elevation than the level of the operating floor. Waste disposed of on Sits is not allowed to burn. x XQ 5.3.4 5.3.5 5.3.6 5.3.7 5.3.8 5.3.10 5.3.14 Except for waste disposed of on the Black Products Area, waste disposed of on Site may not be reclaimed without prior approval by the Regional Director. Waste disposed of on the Black Products Area may be reclaimed as part of the upgrading of the Site. A written report motivating the need for the reclamation activity and a plan outlining the management of the reclamation activity and the period for the reclamation must be submitted to the Department for approval before 31 December 2001. The Permit Holder must ensure that the reclamation activity is conducted in accordance with thé approved reclamation management plan and does not obstruct or interfere with the daily operational activities of the Site or lead to non- compliance with any of the conditions of this Permit or other applicable legislation, ‘The Permit Holder must keep record of the vollime and nature of the waste materials which are reclaimed and report this on an annual basis to the Regional Director in accordance with conditions 12.1 and 14.3.3. The Permit Holder must take all reasonable steps to ensure that the Site is operated in such a manner that nuisance conditions or health hazards, or the potential creation of nuisance conditions or health hazards, are prevented. The Permit Holder, must implement, maintain and at all times apply sufficient odour and noise control measures as indicated in Sasol Secunda Waste Disposal Site Management Objectives of the Reports, as well as dust contro! measures as indicated under paragraph 4.5 of the Report number 278984/2; to prevent odours, noise and/or wind-blown dust from causing nuisance conditions or health hazards. The Permit Holder must make provision for adequate sanitation facilities on the Site. ‘The Permit Holder must maintain the Site in such a manner that - (2) the formation of pools due to rain is prevented; (5) _ free surface runoff of rain-water is ensured; (©) contamination of stormwater is prevented; (4) no objects or materials which may hamper the upgrade or rehabilitation of any portion of the Site are present; and (2) little or no erosion occurs. ACCESS CONTROL Weatherproof, durable and legiole notices in at least three official languages applicable in the area, must be displayed at each entrance to the Site. POST-CLOSURE WATER QUALITY MONITORING Water quality monitoring, in accordance with conditions 7.1, 7.2 and 7.3, must continue after closure of the Site and must be maintained for a period of 30 years, or for such period and/or frequency and/or at locations as may be determined by the Regional Director. “AIR QUALITY AND DUST MONITORING AIR QUALITY AND DUST MONITORING PROGRAMME In the event that the outcome of the investigation conducted in accordance with condition 5.2.4 indicates the presence of or potential nuisance conditions and health hazards posed by the Site as a result of odours, dust generation and airborne emissions, the Permit Holder must submit an air quality and dust monitoring program to the Department for approval by the Regional Director, which must address the following aspects: @ location of air quality and dust monitoring positions; ©) on e~“ off-Site monitoring of air quality variables, including dust; ro) a monitoring procedure for the effective and accurate monitoring of air quality on the Site; @ frequency of monitoring; and ©) post closure monitoring. The approved air quality monitoring programme for the Site referred to in condition 8.1.1 must be implemented within 60 days from the date of approval by the Regional Director. Until such time as the programme referred to in condition 8.1.1 is implemented, an interim air quality and dust-monitoring programme must be implemented with immediate effect The implementation and maintenance of the programme referred to in condition 8.1.3 must be to the satisfaction of the Regional Director for quarterly monitoring 8.2.4 a3 8.3.4 94 410 104 10.1.1 10.2 10.2.4 10.3 10.3.1 10.3.2 4 INVESTIGATIVE AIR QUALITY AND DUST MONITORING Shou'd the complaints register referred to in condition 14.1.4, external audit reports referred to in condition 10.2, results from the air quality monitoring programme referred to in condition 8.1 or any other factor at any time indicate that the air quality is worsening, the Permit Holder must conduct, or appoint specialists to conduct an investigation on the cause of the problem or the suspected problem, should he be directed to do so by the Regional Director. POST-CLOSURE AIR QUALITY AND DUST MONITORING Air quality and dust monitoring, as determined and described in the monitoring programme referred to in condition 8.1 must continue after closure of the Site for such a period as may be determined by the Regional Director. : FURTHER INVESTIGATIONS If, in the opinion of the Regional Director, groundwater, surface water and/or air pollution jiave uccurred ur may possibly occur, the Permit Holder must conduct, and/or appoint specialists to conduct the necessary investigations and implement additional monitoring and remediation measures to the satisfaction of the Regional Director. AUDITS AND INSPECTIONS INTERNAL AUDITS AND INSPECTIONS The Permit Holder must conduct quarterly audits on the entire Site and must compile an official audit report on each audit occasion documenting the findings of the audit according to condition 14.2, which must be submitted to the extemal auditor and the Department according to condition 14.3.1 EXTERNAL AUDITS: The Permit Holder must appoint an independent external auditor to audit the Site annually and this auditor must compile an audit report documenting the findings of his audit according to condition 14.2, which must be submitted according to condition 14.3.2. DEPARTMENTAL AUDITS AND INSPECTIONS The Department reserves the right to audit and/or inspect the Site at any time and at such a frequency as the Regional Director may decide, or to have the Site audited or inspecte ion available to the The Permit Holder must make any records or documents the Regional Regional Director upon request, as well as any other informz Director may require. 41 44 12 12.4 12.2 123 12.4 413 13.1 13.2 13.3 16 The findings of Departmental audits or inspections shall be made available to the Permit Holder within 60 days from the date of the audit or inspection and shall not be treated as confidential. ANALYSIS OF SAMPLES The Permit Holder must ensure that all samples taken in accordance with conditions 7 and 8 are — (a) analysed ‘by a laboratory accredited by the South African Bureau of Standards, referred to in the Standards Act, 1982 (Act 30 of 1982); and (b) according to the methods prescribed in terms of Government Notice : 991 of 18 May 1984, or another method of analysis for which approval had been obtained from the Regional Director.
