STATEMENT OF FACTS
On or about May 30th, 2019, I submitted two Promissory Notes #00001 in the amount of
$704.25 [Exhibits “A”] and Promissory Note #00002 in the amount of $1,171.31 [Exhibits “B”]
to TITLEMAX OF TENNESSEE, INC. (TITLEMAX) with specific instructions to have the debt
associated with account #15986-1201-28822022 and account #15986-1840-37439172 respectfully
be settled and discharged. These Promissory Notes were sent by Certified Mail #7018 0360 0001
3018 0675, under notary presentment. TITLEMAX received these instruments on May 31st, 2019,
(Proof of Service - USPS Tracking Attached).

NOTICE OF FAULT AND OPPORTUNITY TO CURE


Formal Notice of Fault and Opportunity to Cure was sent to TITLEMAX’s as a result
of their failure to respond and failure to return said Promissory Notes siting error(s) or defect(s).
Said Notice of Fault and Opportunity to Cure was sent Certified Mail #7018 0680 0000 5336
8629 dated July 31, 2019, [Exhibit “C”]. Pursuant to Uniform Commercial Code (UCC) 3-505,
that more than 21 days has passed for Acceptance of Promissory Note #00001 in the amount of
$704.25 and Promissory Note #00002 in the amount of $1,171.31 having received these
instruments for acceptance, or dishonor on May 31st, 2019 [Exhibit “D”).

NON-RESPONSE AND FAILURE TO CURE FAULT


After 10 days of receipt by TITLEMAX, having not received and showing no record of
response to my Notice of Fault and Opportunity to Cure sent May 30st, 2019 by certified Mail
#7018 0680 0000 5336 8629 and received by TITLEMAX on May 31st, 2019. TITLEMAX is now
in Default.

NOTICE OF DEFAULT AND CONSENT TO JUDGMENT


Whereas, for reason of TITLEMAX’s failure to cure Fault and Dishonor by Non-Response,
does publicly and solemnly Certify the Dishonor against TITLEMAX by reason of Default.
TITLEMAX by its failure to cure said fault and its non-response constitutes by operation of law
admission of the facts set forth in the presentment through tacit procuration to Promissory Note
#00001 in the amount of $704.25 and Promissory Note #00002 in the amount of $1,171.31 and
the whole matter settled and deemed res judicata and stare decisis.
