patient
The Provincial Court of Castellón has filed an investigation against a nurse who
was present during a surgical intervention in which a gauze was forgotten in the
throat of a patient and eventually died of suffocation. After the investigation, the
cause has been filed since the nurse was in training and had not intervened at
any time. Both she and her partner had been prosecuted for the death of the
patient but considered that the medical-forensic team was mistakenly matching
the level of responsibility of all staff. The event occurred on January 27, 2014
when during a surgical intervention a man died from massive bleeding due to
the lungs. The bleeding occurred due to a bad praxis since a gauze, the size of
a chestnut, had been located in the victim's throat, which had not been removed.
The forensic report referred to the responsibility of all the medical team that was
present during the intervention, including surgeons, anesthetists and auxiliary
personnel, which included the two nurses, attributing the alleged error in
counting the number of gauze.
The nurses resorted to the car distorting the testimony of the anesthesiologist
who blamed them by influencing the erroneous counting of the gauze. That is
why there was a confrontation between the two since, as the nurses alleged “the
anesthetist tries to get rid of the responsibility in the cause, attacking the rest
of the health personnel” and they stressed that they “only assist and assist the
medical staff among others reasons because their academic preparation does
not allow them to invade, they say, areas that are specific to doctors ”. Finally,

In my opinion regarding the article we all have one more legal responsibility in
the case of lives in the health field It is important to highlight the responsibility
of surgeons during the performance of a surgical procedure discusses some of
the problems with legal implications that may be involved the surgical
specialists, as well as in that case the important work of the circulating and
surgical nurses, since, their job at that time was to make the correct gauze
count, but not only them, also all the medical staff must be I agree with that

Thorough review of the abdominal cavity by the main surgeon: After the revision
of the cavity by the surgeon, the assistants can also become participants, and if
the nurse reports that the account is complete you can proceed to the closure of
the abdominal cavity. It is advisable to make the note in the postoperative report
that the abdominal cavity was reviewed, without the absence of any compress
being reported by the instrumentalist nurse. In the event that one or another

other instruments and the main surgeon dismisses that information, not

must assume his individual responsibility.
