CONTRACT TO SELL

KNOW ALL MEN BY THESE PRESENTS:

This instrument is entered by and between:

MARY ANN A. BETAIZAR, of legal age, single, Filipino and a resident of


Blk. 14, Lot 7, Rosalina 3 Village, Brgy. Baliok, Talomo Dist., Davao City,
Philippines, hereinafter referred to as the “SELLER/VENDOR” ;

-and-

MILA S. PODERANAN, of legal age, single, Filipino and a resident of Blk.


7, Lot 4, Rosalina 3 Village, Brgy. Baliok, Talomo Dist., Davao City, Philippines,
represented by ALVEY ORE GOC-ONG, of legal age, Filipino, single, and resident
of Blk 7, Lot 4, Rosalina 3 Village, Brgy. Baliok, Talomo Dist., Davao City,
hereinafter referred to as the “BUYER/VENDEE’

-Withnesseth that-

Whereas, the SELLER/VENDOR is the absolute and registered owner of a


parcel of land covered by Transfer Certificate of Title No. T-447565 with an area of
ONE HUNDRED (100) SQUARE METERS of situated in Blk. 14, Lot 7, Rosalina
3 Village, Brgy. Baliok, Talomo Dist., Davao City;

Whereas, the SELLER/VENDOR is willing to sell his property at a price of


ONE MILLION TWO HUNDRED THOUSAND PESOS ONLY (P 1, 200,000.00),
Philippine currency;

Whereas, the BUYER/VENDEE has evinced her desire to purchase the


property to the Seller at the above-mentioned price through Pag-ibig which the
SELLER/VENDOR agreed;

NOW THEREFORE, for and in consideration of the foregoing premises the


SELLER/VENDOR agrees to sell and the BUYER/VENDEE agrees to buy the
above described house and lot under the following terms and conditions;

1. The BUYER/VENDEE shall apply for a house and lot purchase loan
with PAG-IBIG in the amount of 1 MILLION TWO HUNDRED
THOUSAND PESOS (P 1, 200.000.00) Philippine currency, to pay the
SELLER/VENDOR for the house and lot. The proceeds/check of the
Pag-ibig loan shall be paid to and in the name of SELLER/VENDOR.
2. For purposes of the loan, the SELLER/VENDOR shall allow the
transfer of the title in the name of the BUYER/VENDEE, but only after
the issuance of a letter of guarantee from PAG-IBIG;
3. The Capital Gain Tax, Documentary Stamp Tax, Transfer Fee and other
related Fees shall be the account of the SELLER/VENDOR; and
4. The SELLER/VENDOR warrants to the BUYER/VENDEE the
peaceful possession of the said property and that the same is free from
all liens and encumbrance in favor of any person.

BEFORE ME, a Notary Public in and for the City of Davao, Philippines,
this personally appeared Mila S. Poderanan and Alvey Ore
Goc-ong, known to me and known to be the same persons who executed the
foregoing instrument and acknowledged to me that the same is their free and
voluntary act and deed.

This instruments refers to a Contract to Sell consisting of two (2) pages


including this page where the acknowledgment is written signed by the parties and
their instrument witnesses.
