Questions on pollution:

Q1: Who designated the area as a landfill in Aldabra?


A1: The Former Prime Minister of Aldabra designated the southernmost island as a landfill in
2005.

Q2: How is WPS affected by the oil spill?


A2: After the sinking of MV Joy to the World, large amount of oil was spilled into the WPS,
causing marine damage and losses on the livelihood of small scale fishermen from Aldabra. The
rains and monsoon winds also made it harder to contain the oil spill.

Q3: Was there any prior communication when Aldabra shipped back the trash?
A3: Aside from the statement made during the press conference (P.15) and the negotiations
between the two states (P.16), no other diplomatic note was sent to Ridley signifying the date as
to when the trash will be shipped from Aldabra.

Q4: What were the contents of the negotiations in P.16?


A4: The negotiations were mainly revolving around the characteristics of the wastes exported to
Aldabra, these being non-hazardous wastes and are not covered by the Basel Convention as
argued by Ridley. The binding authority of the Ban Amendment on Ridley is also questioned.

Q6: What specific species of the pawikans were found dead?


A6: Eretmochelys Imbricata, the same species of pawikans which nests at Alta Majora.

Q7: Is this species of pawikan endemic to Aldabra?


A7: No, these are not endemic to Aldabra since this species of pawikans are highly migratory.
However, Alta Majora is one of the major nesting sites of the pawikans (P.10), as well as the
islands near Alta Majora.

Questions on state responsibility:

Q8: Is Suction Queen and Joys Are Us one and the same?
A8: No, they are different entities. Suction Queen, as mentioned in P. 11 of the Record, is a
company owned by a citizen of Aldabra and registered under Aldabran Laws. On the other hand,
Joys Are Us is a private company owned by Joy Cruz, a citizen of Ridley and is registered under
Ridulean Laws.

Q9: What is the state of incorporation of Joys Are Us?


A9: Joys Are Us was incorporated under the laws of Ridley.

Q10: Who owns MV Joy to the World?


A10: MV Joy to the World is owned by Joy Cruz, a citizen of Ridley.

Q11: How did they decide to use MV Joy to the World as the one who will export the trash?
A11: Granting that this was Ridley’s first instance of shipping trash to another country, they
Government of Ridley awarded the contract to the largest cargo vessel in Ridley which was
suitable for such voyage.

Q12: What was the content of the contract?


A12: It was simply for the transport of the cargo to Aldabra. Other health or sanitary
requirements were not mentioned.
