Vide this PUC Chief Secretary office has forwarded a


representation of Mr. Abdul Hamid, Water Management Officer, BS-17 (on
adhoc basis) presently working as Assistant Director (Tech) office of the
Director General Agriculture (Water Management) Punjab, Lahore wherein, it
has been desired to submit a report in the matter by 15-5-2010 in the shape of
summary note alongwith all relevant annexures for perusal/orders of the Chief
Secretary Punjab. In his application the adhoc officer has requested to
regularize his services in the light of his 21 years length of service.

In this regard it is submitted that a summary for Chief Minister,


Punjab was sent with the request to regularize the services of seven adhoc
officers (including the name of the representationist). Copy of approved
summary is available at pages-95 to 103/C and 209 to 220/C. After approval of
the competent authority i.e. Chief Minister, Punjab, the case was sent to
Punjab Public Service Commission with the request to consider it by giving
them an opportunity of appearing in interview before Commission to finalize
their cases for regularization (Page-221/C). The case is still pending with
PPSC.

In view of above if agreed, the position explained above may be


conveyed to Chief Secretary Office in the shape of summary note in response
to their reference at Page-273-C.

PUC is a request of Mr. Bilal Tufail, AAE, (Contract employee),


NPIW, Mandi Bahauddin for his transfer from Mandi Baha-ud-Din to District
Sheikhupura.

He has stated that since his appointment as AAE (OFWM) w.e.f.


20.02.2008 he is working at Mandi Baha-ud-Din. His parents are old and there
is no body to look after them as they are residing at Muridke. To see the old
parents he has to proceed Nuridke frequently.

The transfer / posting of a contract employee is made under the


policy instructions (Flag”A”). According to these instructions the competent
authority, for reason to be recorded in writing. “to allow one time transfer
during the tenure of 3 to 5 years as a special dispensation. However, local
candidates may be adjusted locally so that demand for further transfer may
not arise”

In view of the above, Mr. Bilal Tufail, has requested that he may
vary kindly be transferred from Mandi Baha-ud-Din, to District Sheikhupura
enabling him to look after his old parents and pay full attention towards his
official duty.

Keeping in view the fact stated above, the request of Mr. Bilal
Tufail, seems to be genuine which merits favourible consideration

153. Mr. Muhammad Shahbaz S/O Muhammad Riaz, was appointed
as Water Management Supervisor, on contract basis and posted at Field
Team, Fortabbas District Bahawalnagar. His services were terminated by the
District Officer (OFWM), Bahawalnagar with effect from 30.09.2008, on
account of poor performance. He requested for his reinstatement into service
and for provision of four months salary. He was afforded an opportunity of
personal hearing on 02.12.2008 at 12.30.p.m. in the Commissioner Officer
Bahawalpur Division, Bahawalpur before the undersigned. He appeared for
the said hearing and was heard accordingly. Departmental Representative
was also present in the personal hearing.

154. After gone through record of the case and hearing Mr.
Muhammad Shahbaz S/O Muhammad Riaz, the applicant, and D.R. as well, I
am of the view that contract employee has no right of appeal as a civil servant
but the applicant was on right in his pleadings and was terminated on false
grounds. By taking a special kind view in this case, the District Officer
(OFWM), Bahawalnagar, is directed as, being a Competent Authority in the
case of Water Management Supervisors (BS-11), allow Mr. Muhammad
Shahbaz S/O Muhammad Riaz, to work as Water Management Supervisor on
contract basis in the project of NPIW, in which he was already working. This
contractual appointment shall be considered as fresh contract appointment.

This case of Mr. Afzal Ahmed, Naib Qasid regarding extension in


the deputation with NPIW.

In this regard it is submitted that vide P-167/C the services of


Mr. Afzal Ahmed, Naib Qasid were placed at the disposal of PD, PMU, NPIW
on deputation basis w.e.f. 26.10.2005. Later-on PD, PMU, NPIW vide his
letter at page 273/C requested to this Department for extension in his
deputation period for further one year i.e. for fourth year w.e.f.27.10.2008. The
case for extension for fourth year was forwarded to F.D. vide page 276/C.

Now vide PUC (P-289/C) convey its concurrfence to the grant of


extension in deputation for a period of further one year in respect of Mr. Afzal
Ahmed, Naib Qasid.

Accordingly audit copy has been prepared and placed on board


and submitted with the request to forward the same to F.D. for
signature/authentication please.

In this regard it is submitted that vide page 275/C, PD,


PMU, NPIW Lahore has submitted his requisition for the services of Mr.
Shahbaz Hussain, Jr. Clerk O/O Dir. WMTI, Lahore to DGA (WM) for
deputation for the period of two ;years. DGA (WM) vide his letter at page
274/C accepted this proposal and stated that his office has no objection if the
services of Mr. Shahbaz Hussain may be placed at the disposal of PD, MPU,
NPIW on deputation. The case was previously dealt in vide paras 257/N to
258/N. Vide para 60/N, worthy Addl. Secy. (Admn) raised some quires which
were forwarded to DGA (WM) (P-277/C).Now vide PUC (P-290/C), DGA
(WM) has stated that the reply of that quires may be obtained from PD, PMU,
NPIW.
If agreed the quires available at para 60/N may be
forwarded to PD, PMU, NPIW, with the request to furnish the reply of the same
to this Department at the earliest, as per DFA please.

PUC at page 289/C is from Project Director, PMU, NPIW,
Lahore, stating that Mr. Shoukat Ali, Ex-AAE, Mustafabad District Kasur was
proceeded under PEEDA Act, 2006.

Gist of charges is as under:-

i. He got released funds for construction of watercourses in


an unplanned manner and could not complete the civil works
which resulted unspent balance from Water Users Associations
during the year 2005-2006 under NPIW over and above the
amount incurred. He did not recover this amount from the Water
Users Association, and the Government sustained a loss of Rs.
595,027/-.
ii. Similarly while posted as WMO o/o DDO(OFWM), Kasur
he did not recover unspent balance amounting to Rs.214,369/-
including Income Tax amounting to Rs.40915/-.
iii. He made advance payment without works of Ch. Jhangir
S/o Ch. Alamgir resident of Mustafabad, district Kasur of Rs.
647,980/- by drawing amount from the Water Users Associations
accounts with the connivance of the contractor. Resultantly, the
works on watercourses have not been completed and government
has sustained a loss of Rs.647,980/-.
iv. Due to use of 3rd class material and poor quality
construction work, the Field Engineer, PWMC, has rejected some
portion of the lined watercourses constructed under his
supervision. An amount of Rs.243,499/- is also recoverable from
him in this regard.
The DO(Ext), Kasur was appointed as Inquiry Officer in this
case. The Inquiry Officer conducted the inquiry and proved all the allegations
against the accused officer. Secretary Agriculture / Authority served show
cause notice upon the accused and offered an opportunity of personal
hearing. Secretary Agriculture / Authority awarded major penalty of
“Compulsory Retirement from Service” with effect from 01.08.2007. The
accused officer filed an appeal before the Chief Secretary / Appellate
Authority, which was rejected. Reportedly the accused officer was also
awarded the penalty of dismissal from service in another case on similar
charges which were finally set aside by the Appellate Authority.
The Project Director, PMU, NPIW, has further stated that the
case has been examined in the PMU and observed that the officer has been
awarded the penalty of “Compulsory Retirement from Service” without
affecting the loss caused to government ex-chequer.

He has further requested that the case may be registered under


Anti Corruption Rules, against the accused the accused officer to recover
embezzlement amount and a copy of FIR may be communicate to the PMU.

In view of the above, it is proposed that we may forward the case


to the Anti Corruption Authority, for registration of FIR against Mr. Shoukat Ali,
Ex-AAE, Mustafabad.

selection grade from 1993 due to want of ACR. His ACR became

Muhammad Sharif, A.A.E, office of DO(OFWM), T.T.Singh, has applied

medical grounds as he was remain under treatment in the Punjab Institute of
Cardiology, Lahore for Coronary Angio Bye Pass Grafting. The DGA(WM) has
provide the necessary documents / medical certificate in original.

The application of the officer is available at page 16/c. according


to the leave titled page 17/c, issued by the DAO. T.T.Singh, leave applied by
the officer is due to him on full pay. The DGA(WM), Punjab, has recommended
that the leave applied by the officer may kindly be sanctioned, in his favour.

If agreed as recommended by the DGA(WM), the leave for 94


days, applied by the officer w.e.f. 30.05.2009 to 31.08.2009, may be
sanctioned as ex-post facto on full pay in favour of Mr. Muhammad Sharif,

The DGA(WM), Punjab Lahore vide PUC in response to this


department letter at page 298/C, has submitted that DO(OFWM), Pakpattan
has reported vide his letter dated 04.07.2009 (page 304/c) that Mr. Ahmed
Hassan, Senior Clerk, was proceeded under the PRFS (amendment) Act,
2003 on account of arrangement / managing fake currency notes amounting to
Rs. 47,000/- and its further disbursement among the staff on 02.1.2005
alongwith monthly disbursement of salary. He was, therefore, imposed major
penalty of “Compulsory retirement from service” w.e.f. 17.05.2006 vide order
dated 17.05.2006 (page 305/C. Afterwards, he is no in contact with his office
and his whereabouts are not known. He has sent many letters at his home
address, which were received back undelivered. This office has, however,
directed DO(OFWM), Pakpattan, vide letter at page 307/c that he may check
that whether Mr. Ahmed Hassan, Ex-Senior Clerk, is drawing pension or
intentionally hiding himself. The report from his side is still awaited.

The DGA(WM), has further added that the accused has been
imposed penalty of compulsory retirement more then three years ago. He
could have been proceeded against within one year of his retirement under
Section 1.8(b) of the PCS Pension Rule. Under the circumstances mentioned
above, departmental proceedings against Mr. Ahmed Hassan, Senior Clerk,
cannot be initiated against him as any action at this stage against him will not
be fruitful.

The DGA(WM), Punjab has requested that enquiry proceedings


against Mr. Ahmed Hassan S/o Muhammad Sharif, ex-Senior Clerk
compulsory retired on 17.05.2006 ordered by Government of the Punjab,
Agriculture Department vide No. SO(A-II)2-42/97 dated 23.08.2007 may
please be dropped.

If agreed as recommended by the DGA(WM), Punjab, may be


forward to the Section Officer (A-II), of this department, in response to his
latter dated 07.12.2007 (page-11/c), for further necessary action at his end.

Administrative Approval of “Pilot Project for Promotion of Cotton Cultivation in

start from 01.01.2010, to complete the preliminaries like establishment of
project offices and opening of assign account of Project Director for release of
funds by the FD for current fiscal year, the posting of Project Director of the
project is essentially required.

He has further pointed out that additional charge of Project


Director of said project may be assigned to Mr. Ghulam Shabbir s/o Lal Din,
Regional Deputy Project Director, Water Conservation and Productivity

here that this office have received several application of Mr. Rizwan Naseer,
Ex-Supervisor from certain forums vide which he plugs his loyalty with
different parties for the sake of his own restoration in service.

Prime Minister’s Secretariat, Governor’s Secretariat, Chief Minister’s Punjab,

It is submitted that vide page 43/c, a reference was forwarded by


the DCO, Vehari, to the Finance Department regarding approval for
conversion on Development Scheme “Establishment of offices of
DDO(OFWM), Vehari and Mailsi” to the Non Development Scheme, with the
request to accord sanction and a copy was endorsed to this office. This
department endorsed a copy to the DGA(WM), with the request to provide the
requisite information to this department for submission to the quarter
concerned.
Now vide PUC DGA(WM), has examined the case in detail and
requested that Finance Department may be approached for the purpose
according to the yardsticks approved by the Finance Department as
recommended by the DCO, Vehari.
In view of the above, the comments provided by the DGA(WM),
may be accepted and the PUC alongwith its enclosures may be forwarded to

Assistant Registrar (Writ), LHC, Lahore alongwith order sheet passed by the
Honourable Judge, Lahore High Court, Lahore in the said WP. The case was

annual increment for one year, under Section 4(i)(a)(ii) of

He may be awarded minor penalty of stoppage of one


annual increment for one year, under Section 4(i)(a)(ii) of
the PEEDA, Act, 2006 and strict warning to be careful in
feature.

It is pointed out that the instant enquiry was initiated


under PRFS (SP), Act, 2003, as clearly mentioned in the enquiry order dated
06.01.2009 page 232/C, whereas the above penalties which have been
recommended by the E.O, are under PEEDA Act, 2006, which is the clear
violation of the rules.
In view of the above if agreed the enquiry report received
may be return back to the E.O with the directions to submit his
recommendations in accordance with PRFS(SP), Act, 2003, within seven days
positively without fail.

It is submitted that vide page 112/c, a representation was


received from Mr. Javaid Iqbal, ex-DDO(OFWM), Pakpattan, now working as
Soil Scientist, WMTI, Lahore was received in this department wherein he has
requested that adverse remarks recorded in his ACR for the period
23.05.2005 to 31.12.2005 by the first countersigning officer may kindly be
expunged. The DGA(WM), was asked to provide copy of the said ACR page
172/c.
Now vide PUC DGA(WM) has provided the same which is
available 173 to 181/c.
It is pointed out that the ACR of the said period was initiated by
Mr. Zafar Iqbal Mirza, EDO(Agri), Pakpattan, being reporting officer in clause
A, whereas, the countersigning officer Mr. Inam-ul Haq, ex-DCO, Pakattan
presently Member Board of Revenue, has countersigned the same with the
following remarks:-
“He maneuvered his transfer to Pakpattan politically and took no
interest in the work. He could not even achieve easy target of
lining of watercourses, an important launched by the President
of Pakistan”.

In view of the above, we have following options:-

It is submitted that vide page 353/c, a reference was received
from Assistant Registrar (Writ), LHC, Lahore alongwith copy of order sheet
dated 17.02.2010 passed in WP. No. 3007/10 filed by Mr. Tahir Rafiq,
Supervisor, regarding his promotion as AAE, BS-17, with the following
directions:-
“let a copy of this petition alongwith application of the petitioner
be dispatched to respondent No. 01, which will decide the same
strictly in accordance with law through a speaking order within a
forth night from the receipt of this order”

In this regard it is submitted that worthy Secretary Agriculture


being Authority has been pleased to announce the date for DPC on
01.04.2010 to decide the case of petitioner page 520/c. Accordingly the case
of eligible WM Supervisor was discussed and Mr. Zafar Abbas, out of four
Water Management Supervisors was promoted as AAE, in BS-17. Copy of the
promotion order is available at page 539/c.
Note for Chief Secretary was forwarded which was received
back wherein Chief Secretary has desired to resubmit the case file alongwith
DPC, whose meeting was held on 01.04.2010 for disposal of the application of
Mr. Tahir Rafique, as per directions of Hon’able Lahore High court, Lahore in
WP. No 3007/2010.
Accordingly, the application of Mr. Tahir Rafiq was examined and
it is pointed out that the following supervisors were considered in the above
said DPC meeting and Mr. Zafar Abbas, was declared / recommended for
promotion to the post of AAE.
i. Mr. Zafar Abbass, having seniority No. 31.
ii. Mr. Tanveer Ahmed, having seniority Mo. 115.
iii. Mr. Muhammad Murtaza, Having seniority No. 134.

of similar nature of Mr. Tahir Rafique, has been received from Chief Secretary,
wherein he has desired that action taken in the matter may be intimated to his
office as well as to the petitioner directly. To dispose-of the instant case, if
agreed, we may forward a note for Chief Secretary office in compliance of
para 14/ante as well as in the light of present directions. DFA is added

Secretary Punjab, alongwith an appeal of Mr. Javed Iqbal S/o Ghulam Nabi,
r/o Shakargarh (Narowal) regarding reinstatement in the service as Field
Assistant with the request that contents of the appeal may be examined and
report in this regard may be submitted to his office by 10.03.2010 positively for
orders of the Chief Secretary Punjab.
In this regard it is submitted that the case of above said official
was put up to the Competent Authority in the shape of Summary for Chief
Minister which was finalized by the Chief Minister, Punjab. Original approved
summary is available at pages 63-69/C. In the light of decision of he Authority
a reference was moved to the DGA(WM) with the request to direct the official
to submit his request directly to the S&GAD for the purpose (page 89/C).
If agreed we may inform the above said situation to the Chief
Secretary office as already approved in the summary mentioned above.

Ahmed Bajwa, ex-Junior Clerk of Water Management Wing wherein he has

same page 131/C. Vide page 144/C DGA(WM) has requested that the case of
Mr. Irshad Ahmed Bajwa may kindly be considered for joining in the surplus
pool of S&GAD and to regularized adhoc services alongwith other staff. The
above said situation was conveyed to the S&GAD vide page 156/c. In
response to the SO(P-IV)S&GAD requested to this department for some
documents page 157/C, which was endorsed to the DGA(WM) for compliance.
