RULE I- GENERAL PROVISIONS

Secticm 1. Short 'fitle and Pllrpose. - This Implementing Rules and Regulations,
hereinafter called the 1RR, is promulgated pursuant to Section 7 of Republic Act No.
10930, for the purpose o£ prescribing the n ecessary rules an d regulations to rationo.lize
an d st-rengthen th'= policy regarding d river's license by exten ding the validity period of
driv·~r's licenses, and to en sure that driver's licenses are issued only to deserving
appli cants with std Eicient driving sblls and knowledge on road saiety and proper road
courtesy .

code/s for the type of motor vehicle to be operated by the student driver.

e. Point System - a method of accrui ng demerit points over a period of tim e wh ich
serves as basis fo r the determination of conditions for d river's license renew<1 l,
prohibition frc)m the availn1ent of certain. transactions and revoca tion of a dri ver's
license. lt has as its basic element a grad uated scale of points g iving relative values
or weights to ::he various traffic viola tions depending o n thei r g ravity.

f. Dem erit Point - CUI arithmetica l val-ue, specified by integer numbers, assigned to
and accumul;1ted by a driver-v iolator for every corresponding traffic v io lati on
co mmitted as used in the Poi nt System.

g. Traffic Viola:ions - acts and omissions, whether intentional o r unintentional,


prohibited and penalized by traffic laws, rules and regul2 tions and locc:l ortlinances
which are classified as follows:

l. Gr ave Violation - a traffic viola tion comn1itted in willfu l or wanton


disreg;:.rd fo r the rights or safety of persons which poses a rea l th reat of
serious injury to the d river, his/her passengers or the general public, o r which
may cc. use und ue ruin or substantia l damage to property as lis ted in the
Vi.olation Demerit Point Schedule (Appendix 1).

cornmicted so as to endanger or be likely to endanger any person or property

RULE II - ISSUANCE OF DRIVER'S LICENSE, FEES AND VALIDITY

Section 4. Issuan.:e of Driver' s License. - ff, after the theoretical und practical
exam inations as p t" escribed, the Land Transportation Office (LTO) !-lead or his/her
deputies fi.nd that t 1e applicant possesses the necessary qua lifications and proficiency in
the operation of mc• tor vehicles, is able to read and w rite any of the official languages or
a major dialect ano knows how to read and interpret vario us traffic signs, signals and
road markings, a pl ofessional or nonprofessional license may be issued to such applicant
upon payment of the fee prescribed in accordance with law but prior to the issuance of
said license, the applicant shall present hi mself/herself in person and have his/ her
photograph taken c·y the LTO. All d river's li censes issued sha ll be signed in the p resence

Section 5. Pr escrib,! d Fees. - The LTO shall collect reasonable fees t r~ver1h c§'S\'l:anc((}irt"'

procurement expense.

Section 6. Validitr of Drivel''s License. - Except for the student-driver's permits, al l


d rivers' licenses shall be valid for five (5) years reckoned from the birthdate of the
licensee, unl ess socner revoked or suspended. Provided, however, That subject to Section
26 of Republic Act No. 4136, as amended by Batas Pambansa Blg. 398, any holder of a
professional or nonprofessional driver's license w ho has not committed any viola tion of
Republic Act No.4 L36 and other traffic laws, rules and regulations shall be entitled to a
renewal of such license for ten (10) years.

Section 7. Safegua rds agains t Falsities and Forgeries. - ln. the issuance of licenses, the
LTO shall use such process 6~: adopt such measure as will preven t any alteration or
falsification of a lic1!11Se or will enable the LTO to d etect <~ny unauthorized li cense.

RULE III - PREREQUISITES AND GUIDELINES FOR THE ISSUANCE OF


DRIVER'S LICENSES

Section 8. Es tablishment of Stricter Rules Before the Issuance of Driver's Licen se. -
P ursuant to Section 23-A of Republic Act Nc. 4136, as amended by Republic Act No.
10930, the Land Transportation Office shall promu lgate prerequisites and gu idelines to
ensure that driver's licenses are issued only to deserving applicants with sufficient
driving skills and knowledge on road safety and proper road courtesy.

The conduct of the·)retical and practical examinations, among others, shall be designed
to sufficiently measure the competency of drivers and in <1ccordance to the type of license
applied for and it~; corresponding restrictions. Provided, That for professional driver-
applicant, the tests must be appropriate to the vehicle and type of service <1nd applicant
intends to operate.

Section 9. Creati,)n of a Point System and LTO Point Registxy. - The Land
Transportation Off ce shall institutionwlize a point system which shall be used to assess
tl1e fitness and eligibility of driver applicants for their desired license transactions. The
system shall likewi.;e be utilized as a primary tool to identify, deter, and perwlize r.e peat
offenders of traffic laws and ordinances. For this purpose, the LTO shall establish ;:md
maintain a registl') where demerit points incurred by every driver shall be recorded,
stored, and accesse .:1 for converuent m onitoring.

Section 10. Recordmg of Demerit Points.- Subject to Section 20 hereof, demerit point/s
incurred by a driwr fo r a traffic violation are to be recorded in the LTO demerit point
registry in respect of the day on which the violation was committed.

The LTO shall rec,nd against the apprehended driver the number of demerit points
corresponding to the violation/s comn1itted, if:

a. the person admits the apprehension, or the person has not filed an
appreher,sion contest and the prescribed contest period has lapsed; or
b. the person contests the apprehension bu t obt<~i ns unfavorable resolution after
adjudication.

Demer it points shall be individually counted for every violation committed in a single
apprehension.

Section 11. V iolati J n Demerit Point Schedule1 • - Every violation of Republic Act No.
4136, otherw ise kll•)Wn. as the Land Transpo rtation and Traffic Code, and other traffic
laws, rules and regulations including local ordinances, subject to repo rtor ial
req uirem.ents p rovided under Sectio n 23 of this IRR, shall automa ti cally b e assigned a
corresponding demerit point depen ding on the gravi ty of the tra ffic violation and
habitu ality of its commission based on the succeeding table:

Th e Secreta ry of the D OTr shall have the a ut hority to review th e Point System and its
m ech an isms. U p on the recomm.en da tion of the LTO, after due hea ri ng an d publica tion
the Secretary may <.djust the dem.erit p oin t attrib u tion herein above provided as he may
deen1 proper and n=cessary.

Section 12. Doublt! Demerit Points. - Drivers of p ublic utility veh icles (PUV) shall be
me ted do ubl e the r.umber of demerit points for every tra ffic vio lation committed while
operating a For H ire motor vehicle. This provision sha ll likewise appl y to a d r ive r of a
priv ate moto r veh ide operating as a PUV b ut without proper authority from the Land
Transportation and Franchisi ng Regulatory Board (LTFRB) .

Section 13. A ccumulation P eriod. - The to tal demerit points accu mulated by every d rive r
shall be recko ned :ron1 th e date of initia l issuan ce or last renewal of h is/he r driver's
licen se to the day immediately p reced ing the date of his/her subsequent renewal.

Subject to the exan inatiort requirement under Section 26 of Republ ic Act No. 4136, a
d river who shall accumulate ten (10) or more total demerit points shall, in add ition to
the comp letion of the driver's reorientation cou rse, be required to pass the theoret ical
examination before he/she may be a llowed to renew his/her driver's license.

Secti on 15. Interve ntion Pr ogram. - The drive r, after n otification from the LTO, shall be
required to u n dergo i.l mandatory drive r's reorientation course to be condu cted by t he
Land Transportation Office or a du ly accredited service provider for every ten (10)
accumulated demerit points or whenever the san1e violation is committed for a t least
th ree (3) tin1es during tl1e valid ity of th e driver's license. Provided,jurther, Tha t in add iti on
to the foregoing renrientation course, a public utility vehicle driver who h <1s comm itted
any franchise-relat{·d violation s h all undergo the tr aining sem inar condu cted by the PUV
Drivers' Academy <)f the LTFRB.

Failure of the driver to complete the said intervention program within th irty (30) days
from the date of th~ last apprehension shall c;:,use the suspension of the driver's license
upon prior notice until the required attendance to the course is compli ed with.

Section 16. O utrig ht Revocation. - Without p rejud ice to tl1e auth ority of the cou rt in
appropriate cases a :td except as otherwise provided in Rep u b lic Act No. 41.36 as amended .
and other laws ancl issuances, the d river's license of a person w h o has accum ul a ted at
least for ty (40) demerit points, even if confiscated by, and/or in the possession of, any
other law enforcexnent agencies, shall be revoked immediately without need fo r any
proceeding for a pe1"iod of two (2) years reckoned from the date of settlement of fi nes and
penalties.

Upm1 the revocation of any driver's license, the Land Tran spor tation Offic~ shall serve a
notice of such revo.:a ti on to t he subject driver at his/her address as registered in th e LTO
da tabi.lse by registered mail. If no registry service is available in th e locality of either the
sender or the addressee, service n1.ay be done by ord inary mail which s hall likew ise
constitute presumptive notice to ,the person concerned.

Secti on 17. Perio1i of Prohibition for C hange Classification of N onprofessi onal


Driver's License to Professional D riv er's License and/or Application for A dditional
D river's Licen se C.Jde/s. - A driver who shzlll r>t:'cu mulate a pi.lrticular number of demerit

Section 18. Deme1 it Points Accumulated During the Validity of a Student-driver's


Permit. - Jn addition to the accessory penal ties provided under existi ng laws and
issuances, incurrin;~ at least five (5) demerit points during the validity of the stude nt-
d river's permit shall cause the confiscation and revocation after due notice thereof, one!
bar the student driver from applying for anotl1Pr student-driver's perm it ror one (1) yee1r
from the dClle of re'.rocation. In no case shall a p erson whose student-driver's permi t hils
already been revok.~d for the third time be 2diowed to apply for a student-drive r's perm it.

The licensed d river duly accred ited by the LTO, acting as instructor to the stud ent-d ri ve r,
sha ll be equally resJonsible and liable as the latter for any viola tion and for any inju ry o r
damuge done by th2 motor vehicle on acco un t or as a result of its operation by a stud e nt-
d river Lmder his diJ ection. 2 Hence, such driver-instructo r shall likewise be meted demerit
point/s corresponding to the violat ion/s incurred by the student driver without prejudi ce
to possible sanctior.s by the LTO against the accredit<J tion of the driver-i nstructor.

Section 19. No Cau y-over of Accumulated D emerit Points. - Demerit points for every
d river shall revert back to zero upon the renev,raJ of his/he r driver's license. H owever, the
history of cormnitl(:d traffic violations from which previous demerit points were incur red
sha11 be archived and shall fonTt part of the driver's permanent reco rds wi th the end view
of preserving and .:lisclosing such records to public officers and private persons for a
legitimate purpose.

RULE IV - PENALT IES

Section 20. Unlawful Acts and Correspondin g Penalties. - Wi thout prej ud ice to th e
penalties provided Ltnder the Revised Pen al Code and other appl icable laws, the penalties

Any or all oJ the acts abov-2mentioned shall be p Lmishe w et 1er o r not a license

ln addition lo the abovementioned fin e, the driver's license of errin g applicant, if


one is grant =d by reason of such misrepresentation, connivance, falsificatio n or
che<~ tin g, sh<1ll be revoked, and th e applicant shall be prohibited from applying for
a p eriod of two (2) years. Th e repetition of s uch offense shall warr<mt the perpetua I
disqLwlificalion from being g ranted driver's license in add ition to the fine <~bove­
s tatecl; and

c. A holder of :he driver's license who acts in violation of the provisions of Rep ublic
Act No. 413{· and other existing tr<~ ffi c la ws sh all suffer corresponding pena lties as
rnay be provided by law an d other issuances.

1n case of death or physicu l inj uries resulting in th e loss of any p<~rt of th e vic tim's
body o r the t.lse thereof, insani ty, imbecili ty, impotence or blind ness, or ine<:1pa cily

his authority to s uspend or revoke the lice:1se of th e driver who h<td ca used such

improper pe,·son to operate motor vehicles.

Section 21. Review of Pe nalties.- The Secreta ry of the D OTr, upo n the recom mendati o n
o f the LTO, a fter d t1e heari ng and pub lica ti on, sha ll have the p ower to increase o r adjust
the fine herein imposed once every five (5) years: Provided, Tha t in no case shall the
increase be more than five percent (5%) of the fine sought to be increased.

R ULE V ·-RESPONSIBILITIES OF IMPLEMENTING AGENCIES

Section 22. Reposi,·ory of Records. - The Land Tran sportation Office sha ll serve as the
centrul repository of a ll traffic vio lution records.

Section 23. Reporh)l'ial Requirements. - In consonance wi th the p receding secti o n, th e


local government Lmits (LGUs), the Metropolitan Manila Developrnent Authority
(lvJM D A) or othe r ~genci es lawfully issuing traffic violation receipts sha ll upload t he
<1pprehension report online to the LTO facility to be d eveloped fo r this purpose.

Jn the meantime, the local government units (LGUs), the Me t ropoli tan Man ila
Development Aut]·,ori ty (MMDA) or oth er agen cies lawfully iss uing traffic violation
receipts shall transmit the apprehension report in the form prescribed by LTO-' conta ini n g

Driver's licenses of v iola tors included in the ,apprehension reports submitted by LGUs
and the MMDA sltall be placed on alarm in the LTO Law Enfo rcem ent a nd Tra ffic
Adjudi ca t ion Syste.n w ithin twenty-four (24) hours from receipt of the repor t. For this
purpose, no demer;t points shall be incuned by and recor ded against the driver-violator
until tbe submissio n by the LG U ·or MM DA of a com plete up d ated report on
apprehension case&.; indicating whethe r such apprehension was ad111 itted, uncon tested ,
or uffirmccl or dismissed on adjudication w hich sha ll be s ubn1itted not later than three

Section 25. In formation, Education and Communication Campaign . -The Department


of Transporta ti on (DOTr) and the LTO sha lt in coordination w ith the Land
Transportation Franch ising and Regulatory Board (LTFRB ) and other concerned agenc ies
aJ1d private stakeholders, aggressively and regu larly conduct a na tionwide information,
education and coumunication (lEC) campaign on road safety, inc1uding the list of
measures implemen ted pursuant to and violGtions punishable und er Republic Act No.
4136 and other ex isting traffic laws.

Section 26. Resear.:h and Development. -· The LTO shall cond uct continuing research
and developlT'Ient t,) ensure the efficient adrn.inistration of the driver's licensi ng system.

RULE VI - TRANSITORY AND FINAL PROVISIONS

Section 27. Transitory Provisions. - After the effectivity of this IRR, all driver' s licenses
wi th a validity of three (3) years sha ll be entitled to a renewal valid for five (5) years.

All holders of dr iver's licenses wi th 5-yea r va lid ity shall undergo comprehensive driver's
educa ti on on road safety and proper road courtesy upon the holder's first renewa l of
driver's license aftu the effectivity of this IRR.

Section 28. Separc.bility Clause. - If any provision o r part hereof is held inva lid o r
unconstitutiona l, the remainder of the ·m R o r provisions not otherwise affected sha ll
remain valid and subsi sting.

Section 29. Repealin g Clause. - All laws, rules and regulations, issuances o r parts the reo f
