Subject: RELEASE OF INMATES Revised

Standard(s): Reviewed

POLICY: Correction Staff will ensure that inmates who are being released from custody are
only those inmates who have been properly identified, their release paper work is
accurate and in order and they are released in a timely manner.

PROCEDURE:

A. Booking Officers

1. Verify all release paperwork to ensure that it is legal.

2. Complete all warrant checks as follows:

a. Check the E-Justice System for warrants.

b. Check the SallyPort system for any potential warrants/holds.

c. Check the inmate booking package to ensure no

holds or warrants exist in the package.

3. Notify the appropriate officer where the inmate is housed and ask
them to send the inmate to the Booking Room for release.

4. Get the inmate’s property from the Property Room.

5. When the warrant check has been completed and cleared, any
money balance is to be withdrawn from the BankerWeb system
and a check will be issued to the inmate.

6. Once the inmate has been changed into his civilian clothing, have
him/her sign their property release in SallyPort and give the inmate
their receipt for the money (Check) you released from their
commissary account.

7. Release the inmate from SallyPort.

8. Cut the inmate’s wristband off and destroy it.

9. If the inmate has an outstanding warrant or detainer, he/she is

placed into a Booking Room holding cell.
a. Telephone the agency that is holding the detainer or
warrant and inform them that the inmate has been
released from Sheriff’s custody. The agency will be told:

i. Inmate’s name,

ii. Date of birth,

iii. What the warrant or detainer is for.

b. Ask the agency if they are going to come for the inmate and if
so, what time they will arrive at our facility. The agency has a
reasonable amount of time to do so.

10. In the cases where the inmate sentence is expired and they are due to
be released at 0001, they will remain in their housing unit until
daylight or until their ride arrives whichever comes first.

11. If the inmate being released is a registered sex offender and has been
in custody long enough for a change of address form requirement, fill
out a new change of address form as to where they are going to be
living. If the inmate does not want to give this information fill out the
change of address form and write refused to give address.

12. If the inmate being released is on Constant Watch, you must notify a
Sergeant prior to release. The Sergeant will complete a Mental
Hygiene Form (9.41) and contact 911 to request a Deputy to respond
to the Jail to transport the Inmate to Newark Wayne Community
Hospital. All paperwork supporting the Mental Hygiene Arrest must
accompany the Inmate to the Hospital.

13. Escort the inmate to the Booking Room Slider and notify Main
Control Officer that you have an inmate who is being released.

B. Housing Officers

1. Notify the inmate that he/she is being released, to pack up and clean
the cell.

2. Go into the inmates cell and inspect it to ensure that the cell is clean,
free of damage and that all fixtures are in working order and all jail
property is accounted for.

a. If the cell is damaged and there is county property destroyed

or damage, notify the Shift Supervisor who will report to the
housing unit.

b. The Shift Supervisor will then make the determination if

criminal charges are warranted. If the Shift Sergeant
determines that charges are warranted, he/she will contact
the Criminal Investigations Division.
