CONSENT TERMS executed between the Plaintiff and the

Defendant for settlement of the dispute are as under :

1. The Plaintiff has filed the u/s 138 for recovery of Rs.12,44,455/- from the
Defendant.
2. The leave to defend of the Defendant was allowed by the Hon’ble court upon
deposit of Rs. 2,00,000/- (Rs. Two Lacs only) which has been duly deposited
by the Defendant in the Company on or before 25-10-2018 and therefore, the
case has been numbered as u/s 138 case No. 23230/2018.
3. The Plaintiff and the Defendant have decided to settle the dispute amicably in
which the Plaintiff has agreed to accept a sum of Rs.8,00,000/- [Rupees Eight
Lakhs only] from the Defendant as and by way of full and final & lumpsum
settlement of the claim of the Plaintiff. The Plaintiff and the Defendant have
agreed to make the payment of Rs. 8,00,000/- as under :
A. The Defendant has deposited an amount of Rs. 2,00,000/- vide
cheque.No 345720 dated 25/10/2018 drawn.on Axis Bank Ltd in the
Company which will be adjusted by the Defendant will give `No Objection’
for the same.
B. Towards the balance amount of Rs. 6,00,000/- , the Defendant will hand
over the Cheques as under given below schedule, at the time of filing the
present consent Terms which the Plaintiff has agreed and accepted the
same.

4. Upon receipt of the amount of Rs. 8,00,000/- from the Defendant, the plaintiff
has agreed to withdraw the case unconditionally and hereby declare that there
is no further outstanding on the part of the Defendant.
5. The necessary court fee be refunded and a decree be drawn accordingly.
