AFFIDAVIT OF THIRD PARTY CLAIM

I, Glenn Paolo G. Aquino, Filipino, of legal age, single and a resident of No. 11
Makabud St., Amparo Village, Caloocan City, Metro Manila, under oath, states and
declares that:

1. I am the registered owner of a parcel of land covered by Transfer


Certificate of Title No. 001-2016003770 issued by the Register of Deeds of
Caloocan City, more particularly described as follows to wit;

“(LOT 24, of the subdivision plan (LRC) PSD- 65505, being a portion of
BLOCK 12, described on plan PCS-4084, LRC (GLRO) REC. NO. 6563),
situated in the district of NOVALICHES, CITY OF CALOOCAN, ISLAND OF
LUZON . bounded on the NE., and S., points 2 to 5 by ROAD LOT 7, PCS-
4084, (10.00 M. & 20.00 M Wide); on the SW., points 5 to 1 by LOT 23; and on
the NW., points 1 to 2, by LOT 22, both of the subdivision plan. Beginning at
a point marked “1” on plan being N. 12 DEG. 55’W., 1923.52 M. From CBM
NO. 18, QUEZON CITY; Thence N. 78 DEG. 57’E., 17.06 M. to point 2; thence
S. 11 DEG. 04’E., 21.34 M. to point 3; thence S. 36 DEG. 17’W., 4.34 M. to point
4; thence WEST., 12.13 M. to point 5; thence N. 11 DEG. 04’W., 21.58 M. to the
point of beginning; containing an area of three hundred ninety (390) square
meters, more or less, all points referred to are indicated on the plan and are
marked on the ground as follows: points 3 to 4 by old points, and the rest by
P.S. CYL. CONC. MONS., 15 X 60 CM., bearings true; date of the original
survey, SEPT., 1907 MARCH 1908, that of the subdivision survey, DEC. 9-13,
1966.”

Certified true copy of aforesaid Transfer Certificate of Title No. 001-2016003770 is


hereto attached as Annex “A” and made an integral part hereof.

2. I acquired the aforesaid parcel of land from Spouses Franlina Ponio


Vacaro and Deolito M. Vacaro of No. 113 Victory Avenue, Victory Heights
Subdivision, Caloocan City. Certified true copy of the Deed of Absolute
Sale from Spouses Franlina Ponio Vacaro and Deolito M. Vacaro in my
favor dated 01 February 2016, is hereto attached as Annex “B” and made
integral part hereof.

3. As a consequence of the sale of their parcel of land in my favor


Spouses Franlina Ponio Vacaro and Deolito M. Vacaro issued a notarized
acknowledgement receipt of my payment of One Million Three Hundred
Thousand (PHP 1,300,000.00) Pesos, representing the value of their
aforesaid parcel of land. Certified true copy of the said Acknowledgement
Receipt is hereto attached as Annex “C” and made integral part hereof.

4. However, on ________ 2017 I received a copy of Notice of Levy


Upon Real Property issued by Mr. Brigido Jose Santiago, Jr., Sheriff IV of
Branch 121, Regional Trial Court of Caloocan City, National Capital
Region. The aforesaid Notice of Levy was on my aforesaid parcel of land
acquired from Spouses Franlina Ponio Vacaro and Deolito M. Vacaro.
Copy of the Notice of Levy is hereto attached as Annex “D” and made
integral part hereof.

5. I am executing this Affidavit of Third Party Claim to attest to the truth


hereof and for the purpose of serving notice to Mr. Brigido Jose Santiago,
Jr., Sheriff IV of Branch 121, Regional Trial Court of Caloocan City,
National Capital Region and Jennifer P. Toledo of my adverse claim and
ownership of the aforesaid parcel of land subject of the Notice of Levy
issued by Sheriff Brigido Jose Santiago, Jr.

IN TRUTH THEREOF, I have hereunto set my hand this ___ day of August 2017
in Caloocan City, Metro Manila.
