G.S.R.43 .-Whereas certain draft rules further to amend the Rajasthan Shops and
Commercial Establishment Rules, 1959, was published as required by sub-section (4) of
section 40 of the Rajasthan Shops and Commercial Establishment Act, 1958 (Act No. 31 of
1958), in the Rajasthan Extra Ordinary Gazette part 4(G) sub-part (1) dated 5.9.2019 for
inviting objection and suggestions from all persons likely to be effected thereby on or before
the expiry of the period of thirty days from the date of publication of the said notification in
the official Gazette;
Whereas copies of the said notification was made available to the public on
05.09.2019 and whereas the objection and suggestions received from the public on the said
draft have been duly considered; and
Now, therefore in exercise of the powers conferred by section 40 of the Rajasthan
Shops and Commercial Establishment Act, 1958 (Act No. 31 of 1958) the State Government
hereby makes the following rules further to amend the Rajasthan Shops and Commercial
Establishment Rules, 1959, namely:-
1. Short title & commencement.- (1) These rules may be called the Rajasthan Shops
and Commercial Establishment (Amendment) Rules, 2019.
(2) They shall come into force from the date of their final publication in the Official Gazette.
2. Substitution of rule 3.- The existing rule 3 of the Rajasthan Shops and Commercial
Establishment Rules, 1959, hereinafter referred to the said rules, shall be substituted by the
following, namely:-
"3. Application for registration and grant of Registration Certificate.- (1) The
employer of every establishment shall submit to the inspector concerned a statement as
required by section 4 in Form 1 for the registration for the establishment and grant of
registration certificate along with proof of payment of one time fees. The one time fees shall
be as specified below:-

2. 11 to 50 employees 20000/-
3. 51 to 100 employees 50000/-
4. 101 & above employees 150000/-
(2) The certificate of registration of the establishment registered before the
commencment of the Rajasthan Shops and Commercial Establishment (Amendament)

Rules, 2019 shall remain valid till the expiry date of the certificate. The validity of the
certificate may be extended forever, after depositing one time fees as prescribed in
sub-rule (1)."
3. Amendment of rule 4.- In rule 4 of the said rules,-
(i) The existing sub-rule (2) shall be deleted; and
(ii) In sub-rule (3), for the existing expression “return”, the expression “statement”
shall be substituted and the existing expression “under clause (1) and (2) in rule 3”
shall be deleted.
4. Amendment of rule 6.- The existing rule 6 of the said rules shall be deleted.
5. Amendment of rule 8.- In rule 8 of the said rules,-
(i) for the existing expression “rule 6”, the expression “rule 5” shall be substituted;
and
(ii) the existing expression “for the unexpired portion of the original certificate”
shall be deleted.
6. Amendment of rule 10.- In the rule 10 of the said rules,-
(i) In sub-rule (1), the existing expression “renewals,” shall be deleted; and
(ii) in sub-rule (2), the existing expression “,renewal” shall be deleted.
7. Substitution of Form 3.- The existing form 3 appended to the said rules, shall be
substituted by the following; namely:-
"FORM 3

Name of the establishment.
Name of the Occupier/employer.
Postel address of the establishment.
Registration No.
It is hereby certified that the establishment as mentioned herein has been

8. Deletion of Form 5.- The existing form 5 appended to the said rules, shall be
deleted.
