 CHAPTER - 1

TENDER NOTICE

1.0 On behalf of Gujarat Maritime Board, Executive Engineer(C),

ConstructionDivision, Morbi invites tender for Consultancy services for
structural consultant for“Construction of New Jetty on south side of USL Jetty
at Port Navlakhi”from empanelled consultants only.

1.1 Schedule for tendering is as under:

(i) Bid Document to be downloaded from On or before 28/09/2015up to 6 pm
GMB website
(www.gmbports.org)
(ii) Last date and time for receipt of Bid 5/10/2015 up to 06.00 pm
(Reg. AD/Speed Post only)
(iii) Tender Fees (Non refundable) to be Rs. 1,000/-
submitted to GMB in form of Demand
Draft/ bankers cheque in favors of "

Board” payable atMorbi from any
Nationalized/ Scheduled Bank through
registered A D post/Speed post only.

1.2 Issue and Receipt of Bid Document

1.2.1 The Bid Document can be down loaded from GMB's Website
(www.gmbports.org) and the same shall have to be submitted duly filled in
along with Tender fee as mentioned in the above table.
1.2.2 The printed hard copy of the bid documents shall not be issued. The
bidders shall haveto down load the same from the GMB website.
1.2.3 The bidders shall submit completed bid document only by Registered Post
AD / Speed Post only so as to reach the Executive Engineer(c),
ConstructionDivision, Gujarat Maritime Board,Morbiup to5/10/2015 up to
office hours i.e. the last date of submission of the bid. The covercontaining

 both the cover of technical & price bid shall be super-scribed by
“Consultancy services for structural consultants for - “Construction of
New Jetty on south side of USL Jetty at Port Navlakhi ”on top of the main
envelope while posting. Both the cover for technical and price bid shall be
in separate cover super scribing "TECHNICAL BID" as well as "PRICE
BID".
1.2.4 The offer shall be valid for 120 (one hundred twenty) days from the date of
opening of the bid.
1.2.5 Bid document fee of Rs. 1,000/- (non-refundable) shall have to be furnished
in form of DD/bankers cheque issued by Nationalized/Scheduled bankdrawn
in favour of " Executive Engineer(C),ConstructionDivision, Gujarat
Maritime Board" payable at Morbialong with technical bid.
1.2.6 The bid document without bid document fees shall be consider non-
responsive and shall be rejected.
1.2.7 Conditional tender shall not be accepted.
1.2.8 This tender notice shall form a part of tender document.
1.2.9 The Empanelled consultantsare advised to read carefully all the Instructions
and conditions stipulated in the tender documents.
1.2.10 Empanelled consultantsare bound by Government rules and regulation
being issued from time to time.
1.2.11 The Tender Bids will be opened on7-10-2015 at 12.00 hrs.( If
Convenient) in the office of the Executive Engineer (Civil),
Construction Division, Gujarat Maritime Board, Char Godown, Near
V.C. Fatak, Morbi.
1.2.12. GMB reserves right to reject any or all offer without assigning any
reason/reasons thereof

 CHAPTER – 2

SCOPE OFTHE WORK

1 SCHEDULE OF SERVICES
The consultant shall render following services: -
1. Preparation of economical structural design for Construction of New Jetty
on south side of USL Jetty at Port Navlakhi including retaining structure
with section of back filling material to develop back up area. The
dimension of the proposed jetty is 485X 25 m .The top of jetty shall be
considered +8.50m.

2. Tidal data are as under.

MHWS : + 7.20 m
MHWN : + 6.20 “
MLWS : + 0.80 “
MLWN : + 2.10 “
MSL : + 4.20 “

The consultant shall be designedJetty,bollard & fender, and retaining

structures for backup area etc and detail drawing of the same.

The maximum 3000 MT cargo capacity barges can be used in the

proposed jetty.

The proposed jetty is to be used for bulk cargo, feeder container cargo
and general cargo.

The consultant shall be submitted the detail drawing of jetty& retaining

structures for back up filling including section of back up filling material.
3. GMB shall provide available input data/ information such as layout
plan& Bore details & relevant marine information,

4. You are required to verify the data and if any doubt/ambiguity observed
shall be verified mutually. If required, site visit shall be made for
confirmation.

5. You are required to prepare preliminary design of the structure and

submit to GMB. Any, suggestions mutually agreed shall be incorporated.

 6. You are required to clarify/explain design & drawing details /concept
adapted to GMB engineers and at the time of submission of preliminary
design.

7. If GMB desire to cross check / scrutinized the prepared design by any

other expert / technical institute than Consultancy firms /Individual
designer shall attend meeting with such expert appointed and will comply
the remarks.

8. Preparation of detailed design, structural working drawings of various

elements as per stages of construction and specifications for structural
items for the execution.

9. You shall have to make occasional site visit prior/during construction as

required and for requested with a view to guide the field staff regarding
interpretation and clarification of drawings and specifications as and
when deem necessarywithout any extra cost.

10. Attending the meeting with officers of the GMB, Gandhinagar as and
when required without any extra cost.

4. Term of Reference

4.1 General

The Term of Reference covered under structural consultancy includes: -

1 Structural design shall be based on all relevant latest Indian Standards code
of practice. Wherever Indian Standards are not available for the specific
design (especially in Marine structures), other country’s code of practice
shall be used with proper design justification.

2 Specific marine condition shall be considered while designing the marine

structure with proper justifications.

3 Agency has obtained approval / NOC certificate from local

 authority/bodies. The required fee will be borne by the GMB.

4 You are required to submit “Structural Stability Certificate” after

completion of the construction. You are required to visit site to inspect the
completed structure prior to issue the said certificate.

5 You are required to make any suggestions/recommendation during your site

visit which will be helpful to the construction.

6 You shall allow verifying quality control register, material testing report
and quality of construction during your site visit. If any ambiguity found in
use of materials and also in deviation from your general specifications,
which are likely to affect adversely, you shall give your candid opinion
about the same in writing.

4.2 Indian Standards

The work shall be carried out in conformity to relevant Bureau of Indian Standards
(BIS)/IRC/MORTH of latest revision for respective types of structures.

5. REPORTS
I Preliminary design:
Drawings in hard copy (3Nos)
II Final design:
Drawings in Soft/Hard copy in 5-set
Design Calculation Report in Soft/Hard copy 5-Set
Full set of work in copy

TIME SCHEDULE
3.1 Schedule of Services
The activities shall be completed after issuing work order in following
schedules.

3.2 Levy Compensation

Consultant shall be responsible to complete the entire Services within the
prescribed time schedule. If the Consultant fails to complete the Services
within the Contract Period than GMB reserves its right to recover an
amount at the rate of 0.5 % of the Contract price per day of delay due to
reasons solely attributable to Consultant up to a maximum of 10% of the
Contract Price.

PAYMENT SCHEDULE

4.1 Payment schedule for the work will be as follows:

 CHAPTER – 5

GENERAL TERMS & CONDITIONS

5.1 Definitions and Interpretations

"Site" means location of proposed site.
"Service" mean the Services performed by the Empanelled consultants.
5.2 Representation and Warranties
TheEmpanelled consultantswarrants and covenants that the Services shall
be performed to the highest professional standards in a safe manner in
accordance with accepted practices.
5.3 Taxation
All taxes, duties and statutory levies as applicable as per existing law shall
be deducted at source as per rules.
Empanelled consultantsshall quote rate inclusive of all taxes (Excluding
service tax).
5.4 Termination
GMBshall be entitled to terminate this contract at no cost to;
(i) In the event of force majeure in accordance with later Para.
(ii) Forthwith by notice in writing to consultant in the event consultant is
adjudicated or found bankrupt of insolvent or any order is made or
resolution passed for the winding up, liquidation of dissolution of
consultant.
(iii) Forthwith by giving written notice to Empanelled consultants, if
Empanelled consultantsabandons this Contract or if Empanelled
consultantsfails to perform or observe any of the obligations on its part to
be performed and observed hereunder and in the case of a breach capable of
remedy fails or refuses to take steps to remedy the same within seven (7)
days of written notice from GMB requiring the same to be remedied or for
any other reason by giving 10days written notice, stating the reasons for
termination
Consequences of termination
(i) Termination of this Contract shall be without prejudice to any rights or
remedies accrued to either Party prior to such termination
(ii) No further payment shall become due to Empanelled consultantsin respect
of any period after termination of this Contract with the exception only on
any payment previously accrued and due to Empanelled consultantsunder
the terms of this Contract.
5.5 Force Majeure
(i) A delay in or failure of performance of any one or more of its obligations
by either Party shall not constitute default hereunder nor give rise to any
claim for damage if such delay or failure is wholly and directly caused by

 any occurrence which the affected Party is unable to prevent including Acts
of God by the exercise of reasonable diligence the continuation of which by
the exercise of reasonable diligence the affected Party is unable to control
and the consequences of which the affected Party is unable to prevent,
provided that the affected Party gives prompt written notice to the other
Party specifying the circumstances constituting the occurrence and has used
all reasonable endeavors to minimize the effects thereof.
(ii) If such a delay in or failure of performance caused the suspension of the
services hereunder for a continuous period of seven (7) days. GMB shall be
entitled at any time thereafter to terminate this Contract forthwith by
written notice to consultant.
5.6 Permits, laws and regulations
Empanelled consultantsshall have to comply with applicable laws. The
Empanelled consultantsshall in carrying out the Services observe and be
bound by all applicable laws and hereby undertakes to comply (and to
ensure compliance by any Sub-consultants) with all laws, ordinances, rules,
regulations, bye-laws, decrees and orders whether of Government or other
authority or agency having jurisdiction in relation to the Parties. Services or
to the Site and the Empanelled consultantsshall give all notices and furnish
any bonds, deposits and securities required by official authorities to permit
the performance of the Services.
5.7 Safety
The Empanelled consultants shall at his own expense arrange for all the
safety provisions normally called for by the nature of the Contracted
Services and as ordered by the competent Authority Representative in
respect of all labour directly or indirectly employed for performance of the
Services while taking samples in core area either in sea or along the coastal
area.
The Empanelled consultantsshall be responsible for the safety of the
equipment /material during the performances of the Services during while
process. consultant shall also take such additional precautions as may be
indicated from time to time by the Representative with a view to prevent
pilferage's accidents, etc.
5.8 Dispute Resolution
This Contract shall be subjected to the Indian laws and regulation and shall
be governed by the Indian laws that may be in force during the Contractual
period.
5.9 Settlement Of Disputes
Any difference of opinion between the GMB and Empanelled consultantsin
respect of matters arising out of this Contract shall be resolved through
good faith negotiation the unresolved dispute shall be referred to
arbitration. The provisions of the Indian Arbitration and Conciliation Act

 1996 or any statutory modification or reenactment thereof for the time
being in force shall govern such arbitral proceeding.
5.10 Levy Compensation
Empanelled consultantsshall be responsible to complete the entire Services
within the prescribed schedule of the Contract agreement of work. If the
Empanelled consultantsfails to complete the Services within the Contract
Period than GMB reserves its right to recover an amount at the rate of 0.5
% of the Contract Price per week of delay due to reasons solely attributable
to Empanelled consultantsup to a maximum of 10% of the Contract Price.
