AFFIDAVIT OF EXPLANATION

I,PSSg Richard Chris Sevilla,of legal age, active member of the Philippine
National Police, and office address c/o Police Community Precinct No. 5 of Malabon City
Police Station, after having been duly sworn to in accordance with law, depose and say:

1. That I am Police Non-Commissioned Officer currently assigned with Police

Community Precinct 5 located along Don Basilio Bautista Blvd. Brgy. Hulong
Duhat, Malabon City.

2. Pursuant to order to explain dated November 4, 2019 I was directed to

explain in writing for absent during the routine inspection of duty SDO PMAJ
BUDDY D PEREZ on November 4, 2019 2:10 AM at PCP 5 office.

3. With meekness and humility, I would like to elucidate the facts and
circumstances surrounding the defect noted against by duty SDO. Truth be
told is that, I was precluded to render duty because of insuperable cause of
sickness.

4. On November 3, 2019 I suffered high fever and for the same reason I went
to FKM Medical & Surgical Clinic for check-up. Therein, I was examined and
diagnosed of having viral influenza.

5. Noli M. Miclat M. D. recommended me to have rest for two (2) days. He also
furnished to me Medical Certificate attesting his findings and
recommendation. The same would serve as proof that on November 3, 2019 I
went before him for medical examination. Hereto attached Medical Certificate
dated November 3, 2019 to uphold my claim.

6. As a necessary consequence, forthwith, I notified PCP 5 Commander PLT

ARQUILLO of my inability to render duty on that day. I said to him that I
have medical certificate to attest my claim. I also vouched to him that on the
next day I will render duty. In effect, he concurred.

7. As night shift personnel, I was supposed to render duty on November 3, 2019

from 7:45 PM to 8:00 AM of November 4, 2019. The inspection was
conducted at 2:10 AM of November 4, 2019 wherein I was marked absent by
duty SDO upon his routine inspection.

8. As regards to the defect noted by duty SDO, I would like to interposed

defense of sickness. My absence is not intentional as the same was
unforeseen brought about by insuperable cause. I have not deserted my duty
much less manifest willful defiance of lawful order.

9. I believe that the cardinal rule in holding me responsible for being absent is
the determination of intent. Stated more completely the presence of malice.
Otherwise stated and absence of the former would exculpate me from
administrative liability.
 10. Justice and fair-play dictates that insuperable cause of sickness, absence of
intent, and concurrence of my immediate superior, utterly negates the
presumption of neglect of duty on my part. Therefore, I could not be held
administratively liable.

11. In the light of the circumstances, I am executing this Affidavit to enlighten

my side that I have cogent reason to persuade the authority that
compassionate justice be extended on me in such way spare myself from
administrative liability.

12. That I attest to the truthfulness and veracity of the foregoing facts narrated
above and I submit to the legal and administrative consequences hereof if
ever my statements are wanting of truth and substance.

From the foregoing, I pray that I will be absolved from administrative liability
based on facts and the pieces of evidence I proffered.
