COMES NOW, Plaintiff-Appellee thru the undersigned counsel in the

above-entitled case and unto this Honorable Court most respectfully states:

1. That the appeal filed by the Accused-Appellant has reached and became

final and executor, a copy is hereto attached and marked as Annex “A”

to wit:

Subject of the Petition for Review is the Decision of the Regional Trial
Court of Manila, Branch 45, dated February 10, 2014 which dismissed
the Petition for Certiorari filed with that Court by herein petitioner
assailing, on grave abuse of discretion, the Decision dated
March 21, 2012 of the Manila Metropolitan Trial Court, Branch 8,
which acquitted private respondent of Violation of B.P. 22 but found her
civilly liable to the petitioner.

The case initiated by petitioner with the RTC being a petition for
certiorari under Rule 65 of the Rules of Court, an original action,
petitioner’s proper remedy from the decision of said court was to file with
said Court a notice of appeal under Sec. 2(a) of Rule 41 of the Rules of
court, not an appeal via petition for review under Rule 42.

Accordingly, for being a wrong legal remedy, the instant Petition for
Review is DENIED DUE COURSE and ordered DISMISSED.”

Hence, the above-entitled cases has long reached finality and executory.

WHEREFORE, premises considered, Plaintiff-Appellee thru counsel

most respectfully prayed unto this Honorable Court that an Order for

Writ of Execution be issued.

Other relief and remedy which is just and equitable under the premises are
likewise prayed for.
