A Limited Depa-rtmental Competitive Exarn for promotion to the grade of SDE

(T) under 7570 quota was conducted in t.I.eyeaf 2OO7for vacancy years 2O01_02 to 2OOS-
06 as per SDE (T) RR 2002. Consequently, the successful candidates were promoted to t.Ile
gade of SDE (T)vide order dated 03.11.2008. Subsequent to this promotion, an OA No.238
of 2009 was fi1ed before the Hon'lcle CAT, Hyderabad challengint the eligibility of some of
the executives who got pronoted in LDCE 2007 by some of similarly placed Executives
(2002 recruited JTOS) who were not allowed to appear in LDCE 2OOZby Andhra pradesh
Circle.

2. In this connection, it is indeed found out by tiis office that there \Merearound 94
such executives (promoted as SDES vide order dated 03.1 1.2008) who had not completed
the requisite three years of regular service in the grade of JTO as per SDE (T) RR 2002 to
appear in LDCE 2007. Accordingly, al1 the concerned circles were directed to issue show
cause notices to such Executives as to why they should not be reverted to JTO qrade since
they did not fullill the requisite etigibility condition.

3. Some circles had issued show cause notices as directed by this office, however,
some circles had not followed the instmctions of tlris offrce in this regard. Meanwhile, vide
this offrce letter dated 24.05.2012, the issuance of show cause notices were kept in
abeyance due to some court cases. There are 56 executives against whom the concerned
circles have not served the show cause notices identilied by this office a'rld the list of such
executives is enclosed at Annexure - II.

4. Now, all the court cases which were filed against the show cause notices before the
Tdbunal at Chennai a1-ldMumbai and subsequently before the Hon'ble High Court of
Madras have attained its legal linality vide the judgment d.ated 21.02.20 17 of the Honble
High Court, Madras aid the judgement dated 06.02.2019 of t].e Honble CAT, Mumbai.

5. In view of this, it is decided by the Competent Authority to issue show cause

notices to such executives as per para {3) above, "as to why they should not be reverted
to JTO grade since they did not fulfil the requislte eligibility critelia,,. Accordingly,
all the concemed circles are hereby requested to issue show cause notices to such
executives as per Annexure - II with a direction to them to submit their repty within a
period of 15 days from the date ofissue of said notice.

6. All the telecom circles are requested to thoroughly check and if any similar cases
found, the details of such cases may immediately be sent to this office for further necessaly
actio4 at this end.
