AFFIDAVIT OF LOSS

KNOW ALL MEN BY THESE PRESENTS:

We, SPS EDWIN D. MAGPANTAY AND MARIE ANCILLA F. MAGPANTAY, both of legal age,
Filipinos, married, formerly residents of 792 F. CRUZ STREET, ZEPHYR HOMES, MALIBAY, PASAY
CITY, and current residents of 30 MANILA BAY DRIVE, SOUTHBAY GARDENS, PARANAQUE CITY,
having been sworn in accordance with law, hereby depose and state:

1. That, we are the registered owners of a condominium unit in SEA Residences identified
and described in Condominium Certificate of Title (CCT) No. 003-2015-008667, as:

Phase 3 – Building E
Floor Level – 16th Floor
Unit No. – 11
Description – 1 Bedroom Unit
Unit Area – 24.00 sqm

2. That, on May 16, 2016, we received from SM Development Corporation (SMDC, the
developer of SEA Residences), a package containing the original owner’s duplicate copy
of CCT No. 003-2015-008667 and other documents related to said condominium unit.

3. That, in the summer of 2016, our family transferred to our new residence in Sucat,
Paranaque, which was still under renovation at that time. Because of our busy work
schedules on weekdays and time spent supervising the renovation of our new house on
weekends we only made few personal visits to our old residence in Malibay, Pasay to
sort personal documents and belongings that we will transfer to our new residence in
Sucat, Paranaque. Most of the time, but on an irregular basis, we instructed our helper
to gather our personal belongings and place them in bags and boxes when these are
transferred to our new residence in Sucat.

4. That, in February 2018, we executed a deed of absolute sale to sell the aforementioned
condominium unit to SPS ANTONIO QUIMBO ABAN AND ELVIRA VELASQUEZ ABAN (new
owners). During the course of compiling documents that we will submit to the Registry
of Deeds of Pasay, specifically, the surrender of the original owner’s duplicate copy of
CCT No. 003-2015-008667 that will be cancelled in favor of a new CCT that will be issued
in favor of the new owners, we discovered that the original owners duplicate copy of
the CCT No. 003-2015-008667 we received from SMDC on May 16, 2016 was missing.

5. That, all diligent efforts were exerted to locate and retrieve the missing CCT were in
vain. We conducted repeated searches in our files that remain in our old residence in
 Malibay, Pasay, all our files in Sucat, Paranaque, including all bags and boxes that
originated from our old residence. We also went as far as personally asking the new
owners if the missing CCT was included in some of the documents we exchanged with
them. However, despite all these efforts, the original owners duplicate copy of the CCT
No. 003-2015-008667 cannot be located anymore. Hence, for all legal intents and
purposes, the aforementioned CCT is now deemed lost and beyond recovery.

6. That, except for our sale to SPS ANTONIO QUIMBO ABAN AND ELVIRA VELASQUEZ
ABAN, we certify that the condominium unit covered by CCT No. 003-2015-008667 of
the Registry of Deeds of Pasay City was never sold to any other person or entity.

7. That, we also certify the said property was never mortgaged, conveyed, disposed of, or
encumbered, to any other person or entity. We certify and confirm the said document
was neither confiscated nor relinquished in favor of any government entity of authority.

8. That, we attest to the truth of the foregoing statements to the best of our personal
knowledge and based on authentic documents or records. We are executing this
Affidavit of Loss to support our application for a new owner’s duplicate copy of CCT No.
003-2015-008667 to satisfy the requirements of the Registry of Deeds of Pasay for the
release of a new CCT to be issued under the name of the new owners of the
condominium unit, as well as for all lawful intents and purposes it may serve.
